Article 1 In order to strengthen the management of the sale and discharge of fireworks and firecrackers, protect the public and personal and property safety, and prevent environmental pollution, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Provisions shall apply to the sale, discharge and related activities of fireworks and firecrackers within the administrative area of this Municipality.

Third Wuxing District, Nanxun District, Deqing County, Changxing County and Anji County of this Municipality are prohibited from selling and setting off fireworks. The specific scope of urban built-up areas shall be determined by the municipal and county people's governments according to law and announced to the public.

County (District) people's governments may, according to the actual situation of their respective administrative areas, determine other areas where the sale and discharge of fireworks and firecrackers are prohibited.

Article 4 It is forbidden to set off fireworks and firecrackers in the following places outside the area specified in Article 3 of these Provisions and within 50 meters around it:

Office of state organs;

(two) cinemas (dramas), tourist attractions and other crowded places;

(3) Construction sites, high-rise buildings and underground buildings;

(four) drinking water source protection areas;

(5) Places for religious activities;

(6) Military restricted zones and military administrative zones;

(seven) other places prohibited by laws, regulations and rules.

Article 5 The people's governments of cities and counties (districts) shall set up obvious signs or make announcements in areas and places where the sale and discharge of fireworks and firecrackers are prohibited.

No unit or individual may defile or destroy the sign prohibiting the sale and discharge of fireworks and firecrackers.

Sixth during the heavily polluted weather, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality.

The Municipal People's Government shall, through the news media, timely release to the public the warning information of heavy polluted weather and the announcement prohibiting the discharge of fireworks and firecrackers.

Article 7 These Provisions shall be implemented by the people's governments at all levels in this Municipality. City, county (District) people's government should strengthen leadership, co-ordinate and coordinate major issues in the work of prohibiting the sale and discharge of fireworks and firecrackers.

The public security department is responsible for the safety management of fireworks and firecrackers, and the safety production supervision and management department is responsible for the safety production supervision and management of fireworks and firecrackers. Quality and technical supervision, market supervision and management, comprehensive administrative law enforcement, housing and urban and rural construction, urban and rural planning, environmental protection, education, meteorology and other relevant departments. Should be in accordance with their respective responsibilities, strengthen cooperation and linkage, do a good job in the management of fireworks sales and discharge.

Article 8 State organs, social organizations, enterprises, institutions and other organizations in this Municipality shall carry out publicity and education activities to prohibit the sale and discharge of fireworks and firecrackers.

Television, radio, newspapers, internet and other news media should carry out public welfare propaganda prohibiting the sale of fireworks and firecrackers and changing customs.

The content of the autonomy convention that encourages villages, communities and residential quarters to ban fireworks and firecrackers.

Article 9 If it is really necessary to hold a fireworks party or other large-scale fireworks display activities in the area specified in Article 3 of these Provisions due to major public activities determined by the Municipal People's Government, the organizer shall apply to the public security department for permission in accordance with the provisions, conditions and procedures of hierarchical management.

When making a licensing decision, the public security department shall announce to the public the time, place, type, specification and quantity of the permitted discharge.

Article 10 The layout of fireworks retail outlets outside the area specified in Article 3 of these Provisions shall be determined by the county (district) safety production supervision and management department in accordance with the principle of strict access, ensuring safety and reasonable layout, and after consulting the opinions of the township (town) people's government and sub-district offices.

Fireworks retail outlets should implement special store sales and set up obvious sales signs; In rural areas, counter sales can be implemented or specialty store sales can be gradually implemented.

Eleventh fireworks wholesale enterprises and retail outlets shall establish business files, truthfully record the product name, specifications, quantity, shelf life and other contents of storing and selling fireworks and firecrackers, and issue and save relevant certificates. Archives and vouchers shall be kept for a period of not less than two years.

Twelfth buyers should buy fireworks and firecrackers from legal wholesale enterprises and retail outlets, and shall not buy illegal fireworks and firecrackers, and set off fireworks and firecrackers in accordance with the safety and civilization of the discharge instructions.

Advocate the use of safe and environmentally friendly fireworks and firecrackers instead of products.

Thirteenth the provisions of this Ordinance in the third area, no unit or individual may store fireworks.

Outside the areas specified in Article 3 of these Provisions, non-fireworks wholesale enterprises and retail outlets shall not store more than 30 kilograms of fireworks.

Article 14 Units and individuals engaged in catering, accommodation, wedding and funeral services in the areas and places specified in Articles 3 and 4 of these Provisions shall inform the clients of the regulations prohibiting the discharge of fireworks and firecrackers, and shall not provide related services for the discharge of fireworks and firecrackers.

Fifteenth citizens, legal persons and other organizations have the right to report violations of laws and regulations on the management of fireworks and firecrackers to the public security department and the safety production supervision and management department.

Grass-roots mass autonomous organizations and property service enterprises shall discourage acts that violate the laws and regulations on the management of fireworks and firecrackers, and report to the public security department and the safety production supervision and management department in a timely manner.

The public security department and the safety production supervision and management department shall accept and promptly investigate and deal with it; If it is verified, the whistleblower shall be given appropriate rewards in accordance with relevant regulations.

Article 16 Fireworks wholesale enterprises and retail operators who sell fireworks in violation of Article 3 of these Provisions shall be ordered by the safety production supervision and management department to stop selling, and the wholesale enterprises shall be fined between 1 10,000 yuan and 50,000 yuan, and the retail operators shall be fined between 1 1,000 yuan and 0/10,000 yuan.

Seventeenth in violation of the provisions of Article 3, Article 4 and Article 6, in areas and places where fireworks and firecrackers are prohibited, and during heavily polluted weather, the public security department shall order it to stop the discharge and impose a fine of more than 100 yuan and less than 500 yuan; Those who violate the administration of public security shall be punished according to law.

Article 18 Whoever, in violation of the second paragraph of Article 5 of these Provisions, defaces or damages the sign prohibiting the sale and discharge of fireworks and firecrackers shall be ordered by the public security department to restore to its original state, and may also be fined between RMB 100 and 500 yuan.

Nineteenth in violation of the provisions of article eleventh of these regulations, the business files have not been established, or the certificates have not been issued and kept according to the regulations, and the safety production supervision and management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of more than 1,000 yuan and less than 10,000 yuan shall be imposed on wholesale enterprises, and a fine of more than 100 yuan and less than 1,000 yuan shall be imposed on retail operators.

Twentieth in violation of the provisions of article thirteenth of these regulations, the public security department shall confiscate the illegally stored fireworks and firecrackers, and may impose a fine of not less than one hundred yuan but not more than five hundred yuan.

Twenty-first in violation of the provisions of article fourteenth, did not fulfill the obligation to inform, fireworks, by the public security department at more than two hundred yuan to five hundred yuan fine; Those who provide services related to setting off fireworks and firecrackers shall be ordered by the public security department to make corrections, and a fine of 1000 yuan to 3000 yuan shall be imposed.

Twenty-second in violation of the provisions of administrative punishment, the relevant information should be recorded in the social credit file according to law.

Twenty-third public security, production safety supervision and management departments and their staff in violation of the provisions, one of the following acts, by the competent authorities in accordance with the management authority, the responsible person in charge and other directly responsible personnel shall be punished:

(1) Failing to implement the administrative license according to law;

(2) Failing to perform the duties of supervision and management according to law;

(three) found that illegal acts have not been dealt with according to law;

(four) other dereliction of duty, abuse of power.
