Can Cangzhou set off fireworks?

Article 1 In order to protect the public, personal and property safety, prevent environmental pollution and strengthen the management of fireworks and firecrackers, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Provisions shall apply to the prohibition of setting off fireworks and firecrackers and related supervision and management activities within the administrative area of this Municipality.

Article 3 Fireworks and firecrackers are prohibited in the following areas within the administrative area of this Municipality:

(a) expressway, Shijiazhuang, expressway, Cang Lang (Beijing-Shanghai), expressway, surrounded by urban areas;

(2) Renqiu City, hejian city City, Botou City, Huanghua City, Suning County, xian county City, wuqiao county City, Dongguang County, Nanpi County, Qingxian County, Mengcun Hui Autonomous County, Yanshan County and Haixing County.

The people's governments of cities and counties may designate other areas within their respective jurisdictions where fireworks and firecrackers are prohibited, and announce them to the public.

Article 4 Fireworks and firecrackers are prohibited in the following places within the administrative area of this Municipality:

(a) the office space of organs and institutions;

(two) cultural relics protection units and public cultural facilities;

(three) transportation hubs such as stations, docks and airports, expressway, tunnels, elevated roads, overpasses, rail transit facilities and railway line safety protection zones;

(4) Places where inflammable and explosive dangerous goods are produced and stored;

(5) Within the safety protection zone of power transmission and transformation facilities;

(six) medical institutions, pension institutions, kindergartens, schools, welfare homes, funeral homes;

(seven) forest, public green space and other key fire prevention areas, large and medium-sized reservoir management areas, drinking water source protection areas;

(eight) shopping malls, bazaars, scenic spots, parks and other crowded places;

(nine) other places stipulated by the people's government at the city or county level.

In the places listed in the preceding paragraph, the people's governments at the municipal and county levels shall organize and set up unified warning signs prohibiting the discharge of fireworks and firecrackers, and do a good job in safety tips and prevention.

Article 5 During the early warning period of heavy polluted weather, this Municipality shall implement emergency response measures such as prohibiting the discharge of fireworks and firecrackers in the whole region.

The Municipal People's Government shall, according to the warning level of heavy pollution weather, start the emergency plan in time according to the prescribed procedures, and release the warning information of heavy pollution weather and the announcement prohibiting the discharge of fireworks and firecrackers to the public through the media.

Article 6 The municipal and county people's governments shall be responsible for coordinating the work of prohibiting the discharge of fireworks and firecrackers.

Township (town) people's governments and sub-district offices shall incorporate the prohibition of fireworks and firecrackers into the comprehensive management of grassroots social security, and strengthen organization, coordination, guidance and supervision.

The people's governments at the city, county and township levels shall include the relevant funds for prohibiting the discharge of fireworks and firecrackers into the fiscal budget at the same level.

Seventh public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

Emergency management, ecological environment, market supervision, urban management, administrative examination and approval, civil affairs, meteorology, housing construction, education and other departments shall, in accordance with their respective responsibilities, strengthen cooperation and linkage, and do a good job in the control of fireworks and firecrackers.

Eighth city, county and township people's governments and their relevant departments shall strengthen the publicity and education work of prohibiting the discharge of fireworks and firecrackers.

Neighborhood (village) committees, owners' committees and property service enterprises shall assist relevant departments in the work of prohibiting the discharge of fireworks and firecrackers, and strengthen publicity, education and guidance to residents (villages) and owners.

Organs, enterprises, institutions and other social organizations shall carry out publicity and education on the prohibition of fireworks and firecrackers in their own units and industries.

Radio, television, newspapers, Internet and other media units and outdoor advertising operators and publishers shall conduct public welfare publicity and public opinion supervision on the prohibition of fireworks and firecrackers.

Schools and guardians of minors shall educate minors on the safety of fireworks and firecrackers, and it is forbidden to set off fireworks and firecrackers.

Encourage relevant social organizations and volunteers to participate in voluntary service activities that prohibit the discharge of fireworks and firecrackers.

Advocate the use of safe and environmentally friendly fireworks and firecrackers instead of products.

Article 9 To hold large-scale fireworks display activities such as fireworks evening, the organizer shall apply to the public security organ for permission in accordance with the provisions on hierarchical management. After examination, the fireworks and firecrackers discharge license was obtained. Fireworks parties and other large-scale fireworks display operations units and workers shall conduct fireworks display operations in accordance with the fireworks display safety regulations and the approved fireworks display operation plan.

Article 10 Units and individuals that provide catering, accommodation, wedding and funeral services in areas where fireworks and firecrackers are prohibited shall inform their clients of the relevant provisions prohibiting the discharge of fireworks and firecrackers, and shall not provide fireworks and firecrackers related services for them, and discourage the discharge of fireworks and firecrackers within their city appearance and environmental sanitation responsibility areas; Those who refuse to listen to dissuasion shall report to the public security organ in time.

Eleventh any unit or individual has the right to report the illegal discharge of fireworks and firecrackers to the public security organs. The public security organ shall set up a special hotline for reporting. After receiving the report, it shall promptly investigate and handle it or hand it over to the relevant departments for handling according to its functions and powers.

If the clues are verified, they shall be rewarded, and the specific measures shall be formulated by the municipal and county people's governments.

Twelfth any unit or individual in violation of the provisions of administrative punishment, the relevant information shall be disclosed to the public according to law.

Article 13 If the relevant administrative departments and their staff neglect their duties, abuse their powers or engage in malpractices for selfish ends in the management of prohibiting the discharge of fireworks and firecrackers, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Fourteenth in violation of the provisions of Article 3, Article 4 and Article 5, fireworks are set off in areas, places and time periods where fireworks are prohibited, and the public security organ shall order them to stop and impose a fine of not less than 100 yuan but not more than 500 yuan; Those who violate the administration of public security shall be punished according to law.

Article 15 If large-scale fireworks display activities such as fireworks parties are held without permission, or the fireworks display operation units and workers violate the fireworks display safety regulations and the fireworks display operation plan, the public security organs shall order them to stop the fireworks display and impose a fine of 1 10,000 yuan but not more than 50,000 yuan on the responsible units.

Sixteenth units or individuals that violate the provisions of Article 10 of these measures and fail to fulfill the obligation of informing, discouraging or reporting shall be fined between 200 yuan and 500 yuan by the public security organs.

Units or individuals that, in violation of the provisions of Article 10, provide catering, accommodation, wedding and funeral services in areas where fireworks and firecrackers are prohibited shall be ordered by the public security organs to make corrections and be fined between 1,000 yuan and 3,000 yuan.

Seventeenth acts in violation of these provisions, laws and regulations have been punished, from its provisions.

In violation of the provisions, causing personal injury or property losses, shall bear civil liability according to law; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 18 These Provisions shall come into force as of 202 1 1 day.
