1. Article 3 is amended as: "The areas where urbanization management is implemented in Haishu District, Jiangbei District and Yinzhou District of this Municipality are areas where the operation and discharge of fireworks and firecrackers are prohibited. The determination or adjustment of the specific scope shall be decided by the Municipal People's Government according to law and announced to the public.

"Counties (cities) and zhenhai district, Beilun District and Fenghua District prohibit the operation and discharge of fireworks and firecrackers, or restrict the operation and discharge of fireworks and firecrackers. The time limit shall be decided by the local people's government according to local conditions and announced to the public.

"During the Spring Festival, major celebrations or major public activities, if it is necessary to hold fireworks and firecrackers in areas where fireworks and firecrackers are prohibited or restricted, the municipal or district/county (city) people's government shall decide according to law and announce it to the public." Second, delete Article 4. Three. Article 11 is renumbered as Article 4, and item 5 of the first paragraph is amended as: "(5) government agencies, primary and secondary schools, kindergartens, medical institutions, and pension service institutions".

One article is added as Article 5: "Fireworks and firecrackers are prohibited within the administrative area of this Municipality during the warning period of heavy polluted weather issued by the Municipal People's Government." 5. Article 5 is renumbered as Article 6 and amended as: "The municipal, district and county (city) people's governments shall strengthen their leadership over the safety management of fireworks and firecrackers, and establish a coordination mechanism for the safety supervision and management of fireworks and firecrackers with the participation of emergency management, public security, market supervision and management, ecological environment, civil affairs, comprehensive administrative law enforcement, transportation, health, housing and urban and rural construction, meteorology and other departments.

"The emergency management department is responsible for the supervision and management of fireworks safety production and operation, and the public security organ is responsible for the safety management of fireworks.

"Departments and units such as market supervision and management, ecological environment, civil affairs, comprehensive administrative law enforcement, transportation, health, housing and urban and rural construction, and meteorology shall do a good job in the safety management of fireworks and firecrackers according to their respective responsibilities." Article 6 of the intransitive verb is changed to Article 7, and the fourth paragraph is amended as: "Grassroots mass autonomous organizations shall assist relevant departments in the safety management of fireworks and firecrackers, and report the hidden dangers of fireworks and firecrackers to relevant departments in a timely manner." 7. Article 7 is renumbered as Article 8, and the second paragraph is amended as: "The emergency management department shall set up fireworks retail outlets in accordance with the principles of total control, ensuring safety and reasonable layout."

One paragraph is added as the third paragraph: "Fireworks and firecrackers wholesale enterprises shall engage in business activities within the area specified in the business license." 8. Article 8 is renumbered as Article 9 and amended as: "Organizers of large-scale fireworks display activities shall apply to the public security organs in accordance with the provisions, conditions and procedures of hierarchical management; The public security organ shall issue a permit for the discharge of fireworks and firecrackers to those who meet the requirements, and announce to the public the time, place, type, specification and quantity of the permit. " 9. Article 12 is amended as: "Any unit or individual has the right to dissuade the units and individuals that illegally produce, operate, transport, store, carry and set off fireworks and firecrackers, or make complaints and reports to relevant departments and government service platforms; Emergency management, public security, market supervision and management, transportation and other relevant departments shall promptly accept and reply the results to the complainant and informant.

"The realty service enterprise shall discourage the illegal discharge of fireworks and firecrackers in the service area; Those who do not listen to dissuasion shall report to the public security organ in time, and the public security organ shall deal with it in time.

"Celebration and funeral service providers shall inform the service object in writing of the areas where fireworks and firecrackers are prohibited, and discourage the service object from illegally discharging fireworks and firecrackers; If you don't listen to dissuasion, you should report it to the public security organ in time, and the public security organ should deal with it in time. " Ten, delete the second paragraph of article thirteenth. 1 1. Paragraph 1 of Article 14 is amended as: "If a fireworks wholesale enterprise or a retail operator violates the provisions of Article 10 of these Provisions and operates fireworks and firecrackers prohibited by this Municipality, the emergency management department shall order it to stop the illegal act, confiscate the prohibited fireworks and firecrackers and illegal income, impose a fine of more than 20,000 yuan and less than 100,000 yuan on the wholesale enterprise, and impose a fine of more than 1,000 yuan and less than 5,000 yuan on the retail operator; If the circumstances are serious, the business license for fireworks and firecrackers shall be revoked according to law. "

One paragraph is added as the third paragraph: "If a celebration or funeral service provider violates the provisions of the third paragraph of Article 12 and fails to fulfill the obligation of written notification, resulting in illegal discharge of fireworks and firecrackers, the public security organ shall give it a warning and may impose a fine of 100 yuan but not more than 500 yuan." 12. One article is added as Article 16: "Those who are subject to administrative punishment in violation of these Provisions and are deemed as bad information according to the Regulations of Zhejiang Province on the Administration of Public Credit Information shall be recorded in the credit files of relevant units and individuals."
