Article 2: These regulations shall apply to the discharge of fireworks and firecrackers and supervision and management activities within the administrative area of ??this city.

The term "fireworks and firecrackers" as mentioned in these Regulations refers to fireworks and firecracker products and civilian black powder, pyrotechnic powder, fuses and other items used in the production of fireworks and firecrackers.

Article 3: The municipal and county (city, district) people's governments are responsible for the organization and leadership of fireworks and firecrackers discharge and related supervision and management, establish a joint meeting system, and comprehensively coordinate related major matters.

The public security organs are responsible for the public safety management of fireworks and firecrackers.

The production safety supervision and management department is responsible for the safety supervision and management of the production and operation of fireworks and firecrackers.

Environmental protection, education, urban management (administrative law enforcement), civil affairs, housing and urban and rural construction, transportation, culture, radio, television, news and publishing, industrial and commercial administration (market supervision), meteorology, supply and marketing and other departments should follow their respective responsibilities and carry out relevant supervision and management work.

Article 4: Township people’s governments and sub-district offices shall include the safety management of fireworks and firecrackers into the scope of comprehensive social security management, strengthen organization, coordination, guidance and supervision, and cooperate with relevant departments to do relevant work.

Residents’ committees, villagers’ committees, property service companies, owners’ autonomous organizations, units and individuals engaged in wedding and funeral services, as well as hotels, guesthouses and other units that host weddings and ceremonies should cooperate with relevant departments to prepare fireworks and firecrackers. Regarding the management and publicity of fireworks, any behavior that violates the provisions of these Regulations by setting off fireworks and firecrackers shall be informed and discouraged. If dissuasion is ineffective, a report should be made to the public security organ in a timely manner.

Article 5: People's governments at all levels and relevant departments, enterprises, institutions and social groups shall organize and carry out publicity activities on the safe discharge of fireworks and firecrackers, and increase publicity efforts during major festivals and heavy pollution weather periods.

Schools, kindergartens and other educational institutions should include the safe discharge of fireworks and firecrackers into safety education work, and strengthen the education of students and minors on the safe discharge of fireworks and firecrackers.

News media such as radio, television, newspapers, magazines, and the Internet should do a good job in promoting the safe discharge of fireworks and firecrackers.

Article 6: People's governments at all levels shall include the funds for management activities of fireworks and firecrackers into the fiscal budget of the same level.

Article 7 It is prohibited to set off fireworks and firecrackers in the following areas:

(1) Tai'an City: east of Taohuayuan Road and G3 Expressway, west of Boyang Road (including Boyang Road and The northward extension line of the intersection of Bixia Street to Tangjiazhuang Village, Liujiazhuang Village, Jimayu Village, Shajialing Village, Qijiatan Village, Wangjiazhuang Administrative Village), south of Huanshan Road, and between Tiantianmen Street in the High-tech Zone North;

Article 8 It is prohibited to set off fireworks and firecrackers in the following places outside the areas specified in Article 7 of these Regulations:

(1) Office spaces of government agencies and institutions;

(2) Cultural relics Protected units;

(3) Transportation hubs such as stations, docks, and airports, highways, tunnels, overpasses, viaducts (roads), overpasses, underground passages, and railway line safety protection zones;

(4) Places for the production, operation and storage of fireworks and firecrackers;

(5) Gas stations, liquefied gas supply stations (points), oil depots, important material warehouses, etc. that are flammable and explosive Safety protection zones for items production, operation and storage units (places) and oil (gas) pipelines;

(6) Safety protection zones for power transmission and transformation facilities such as substations and high-voltage lines;

(7) Medical institutions, kindergartens, schools, nursing homes, welfare homes, etc.;

(8) Scenic spots, mountains, green spaces, parks, nurseries, wetlands, etc.;

(9) ) Banks, parking lots (warehouses), shopping malls, cinemas (theaters), markets, public entertainment venues, public cultural facilities (venues), religious activity venues and other crowded public places ;

(10) Public corridors, stairs, roofs, balconies and construction sites of buildings under construction;

(11) Municipal, Other places designated and announced by the county (city) people's government.

In the places listed in the preceding paragraph, the operation and management unit or the property rights unit shall set up warning signs prohibiting the setting off of fireworks and firecrackers, and carry out safety reminders and precautions.

Article 9 During the following periods, no unit or individual may set off fireworks, hold fireworks parties, or other large-scale fireworks display activities within the administrative area of ??this city:

(3) Other burning ban times issued by the municipal and county (city) people's governments in accordance with the law.

Article 10 In addition to the provisions of Articles 7, 8 and 9 of these Regulations, other areas, places and times where the setting off of fireworks and firecrackers are prohibited shall be determined by the municipal, county (city) people's government according to the actual situation. The scope of prohibition on setting off fireworks and firecrackers should be reasonably adjusted.

Article 11 In areas and places where the setting off of fireworks and firecrackers is prohibited, the production, operation (storage) of fireworks and firecrackers is prohibited.

Article 12 In areas and places where it is prohibited to set off fireworks and firecrackers, units and individuals engaged in wedding and funeral services, as well as hotels, guesthouses and other units that host weddings and ceremonies shall not provide services related to setting off fireworks and firecrackers. .

Article 13 Anyone who sets off fireworks and firecrackers outside the prohibited burning areas, places and times stipulated in Articles 7, 8 and 9 of these Regulations shall ensure safety and shall not engage in the following acts:

(1) Throwing towards crowds, vehicles, buildings, etc.;

(2) Throwing outwards from building roofs, balconies, windows, etc.;

(3) Obstructing the safe passage of pedestrians and vehicles;

(4) Other ways of setting off that endanger public safety and personal and property safety.

Article 14: In the event of a major public event and the need to hold a fireworks show or other large-scale fireworks display activities, the organizer shall apply to the public security organ and handle the fireworks permit procedures in accordance with the law. Discharge operating units and operators shall conduct discharge operations in accordance with the safety regulations for fireworks discharge and the approved discharge operation plan.

Public security organs should strengthen supervision and inspection of fireworks parties with higher risk levels and other large-scale fireworks display activities.

Article 15: Encourage and advocate the development, research and use of non-polluting, low-noise alternatives to fireworks and firecrackers.

Encourage to set off less or no fireworks outside areas and places where fireworks and firecrackers are prohibited, and encourage voluntary service activities where fireworks and firecrackers are prohibited.

Article 16: Any unit or individual has the right to report illegally setting off, operating, or storing fireworks and firecrackers to the public security organs and safety supervision departments. If the report is true, appropriate rewards can be given to the whistleblower.

Retaliation against whistleblowers will be investigated and dealt with by the public security organs in accordance with the law.

Article 17 Violates the provisions of Articles 7, 8, 9, and 13 of these Regulations by setting off fireworks and firecrackers in areas, places, and times where the setting off of fireworks and firecrackers is prohibited or in any manner that causes harm. If fireworks and firecrackers are set off in a manner that protects public security and personal and property safety, the public security organs shall order them to stop setting off and impose a fine of not less than 100 yuan but not more than 500 yuan; if it constitutes a violation of public security management, public security management penalties shall be imposed in accordance with the law.

Article 18 Anyone who violates the provisions of Article 11 of these Regulations by producing or operating fireworks and firecrackers in areas or places where the setting off of fireworks and firecrackers is prohibited shall be ordered by the production safety supervision and management department to stop illegal production and business activities. , a fine of not less than 20,000 yuan but not more than 100,000 yuan will be imposed, and illegally produced and operated fireworks and illegal income will be confiscated; if a violation of public security management is constituted, public security management penalties will be imposed in accordance with the law; if a crime is constituted, criminal responsibility will be pursued in accordance with the law.

Article 19 If the department responsible for the management of fireworks and firecrackers and its staff violate the provisions of these regulations, neglect their duties, abuse their power, engage in malpractice for personal gain, they shall be punished in accordance with the law; if a crime is constituted, criminal prosecution shall be pursued in accordance with the law. responsibility.

Article 20: If laws and regulations have stipulated legal liability for acts that violate the provisions of these Regulations, such provisions shall prevail; if laws and regulations do not stipulate legal liability, the provisions of these Regulations shall prevail.

Article 21: The names and functions of the administrative agencies listed in these regulations will be adjusted accordingly according to the actual situation after the reform of the municipal administrative agencies is completed.

Article 22: Fireworks and firecrackers discharge and supervision and management activities in various functional areas such as Tai'an High-tech Zone, Taishan Scenic Area, Tai'an Tourism Economic Development Zone (High-speed Railway New Area), etc. shall be implemented with reference to these regulations.

Article 23 These Regulations shall come into effect on January 1, 2019.
