Regulations of Ningbo Municipality on Meteorological Disaster Prevention (revised 20 18)

Chapter I General Provisions Article 1 In order to prevent meteorological disasters, ensure the safety of people's lives and property, and promote sustainable economic and social development, these Regulations are formulated in accordance with the provisions of the Meteorological Law of People's Republic of China (PRC), the Regulations on the Prevention of Meteorological Disasters, the Meteorological Regulations of Zhejiang Province, the Regulations on the Prevention of Meteorological Disasters of Zhejiang Province and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention, monitoring, early warning and emergency response of meteorological disasters within the administrative area of this Municipality.

Meteorological disasters as mentioned in these Regulations refer to disasters such as typhoon, rainstorm (snow), cold wave, strong wind (including tornado), fog, lightning, hail, frost, high temperature, drought, low temperature (freezing) and haze.

The prevention of marine disasters, floods, geological disasters, forest fires and other meteorological secondary and derivative disasters caused by meteorological factors shall be implemented in accordance with the relevant provisions of these regulations; Where relevant laws and regulations have provisions on the prevention of meteorological secondary and derivative disasters, such provisions shall prevail. Article 3 The prevention of meteorological disasters shall follow the principles of people-oriented, overall planning, division of labor and cooperation, prevention first and scientific defense. Article 4 The municipal, district and county (city) people's governments shall strengthen the organization and leadership of meteorological disaster prevention, establish and improve the coordination mechanism of meteorological disaster prevention, strengthen the construction of meteorological disaster prevention facilities, and incorporate the funds for meteorological disaster prevention into the fiscal budget at the corresponding level. Fifth city, county (city) competent meteorological departments under the leadership of the competent meteorological departments at higher levels and the people's government at the same level, responsible for the administrative area of monitoring, early warning, information release and other related meteorological disaster prevention work; Other relevant departments shall, in accordance with their respective responsibilities, do a good job in meteorological disaster prevention. Article 6 The competent meteorological departments and other relevant departments and units shall publicize and popularize the knowledge of meteorological disaster prevention to the society through various forms, enhance the public's awareness of meteorological disaster prevention, and improve emergency capabilities such as avoiding risks, avoiding disasters, and self-help and mutual assistance.

Schools should carry out meteorological disaster prevention and emergency self-help knowledge education, and organize regular drills. Education, meteorology and other departments shall guide and supervise the meteorological disaster prevention education carried out by schools. Seventh to encourage and support the scientific and technological research of meteorological disaster prevention, popularize advanced meteorological disaster prevention technology, and improve the scientific and technological level of meteorological disaster prevention.

Encourage citizens, legal persons and social organizations to participate in voluntary service activities for meteorological disaster prevention according to law.

City and county (city) people's governments shall commend and reward the units and individuals that have made outstanding contributions in the prevention of meteorological disasters. Chapter II Defense Planning and Preventive Measures Article 8 The competent meteorological department shall, jointly with relevant departments, formulate a defense plan for meteorological disasters, which shall be submitted to the people's government at the corresponding level for approval before implementation. Meteorological disaster prevention planning shall include the following contents:

(a) the guiding ideology, principles, objectives and tasks of meteorological disaster prevention;

(2) Forecast, investigation and evaluation of the present situation and development trend of meteorological disasters;

(three) meteorological disaster prone areas and time periods, key defense areas and fortification standards;

(4) Responsibilities of meteorological disaster prevention institutions and departments;

(five) meteorological disaster prevention facilities construction projects;

(six) meteorological disaster prevention measures. Article 9 The municipal, district and county (city) people's governments shall organize the competent meteorological departments and relevant departments to carry out the general survey of meteorological disasters and establish a meteorological disaster information database to provide convenience for public inquiries. Tenth city and county (city) District People's governments shall organize the competent meteorological departments and other relevant departments to formulate emergency plans for meteorological disaster prevention, and establish an emergency mechanism for meteorological disasters with government organization and coordination and division of labor.

The relevant departments shall, according to the meteorological disaster prevention planning and emergency plan for meteorological disaster prevention, formulate or improve the corresponding emergency plan for meteorological disaster prevention in their own departments and report it to the people's government at the same level for the record.

Management units of reservoirs, important dikes, seawalls and other key projects that are vulnerable to meteorological disasters shall prepare emergency plans for meteorological disasters and report them to the relevant competent departments or other authorities with jurisdiction for approval. Eleventh city and county (city) people's governments shall strengthen the construction of meteorological disaster prevention facilities such as meteorological disaster monitoring and early warning system, early warning information release system and emergency meteorological service system.

Islands, ports, wharves, rivers, lakes, traffic trunk lines, agricultural parks, ecological forest areas, scenic spots and other areas and places that are vulnerable to meteorological disasters such as typhoons should be equipped with facilities such as meteorological disaster monitoring and early warning information broadcasting, and ensure the normal operation of related facilities. Article 12 The municipal, district and county (city) people's governments shall strengthen the construction of defense facilities such as seawalls, dikes, safe havens, sheltered anchorages and shelterbelts in areas prone to typhoon disasters.

The construction of buildings (structures) in typhoon disaster-prone areas shall conform to the site selection standards and wind resistance standards stipulated by the state. Thirteenth no unit or individual may occupy or damage meteorological disaster prevention facilities.

It is forbidden to engage in acts that endanger the meteorological observation environment within the scope of protection of the meteorological observation environment. When the planning department examines and approves new construction, expansion and reconstruction projects within the scope of meteorological observation environmental protection according to law, it shall obtain the consent of the competent meteorological department with the right of examination and approval in advance.
