Regulations of Maanshan Municipality on the Administration of Setting off Fireworks and Firecrackers

Article 1 In order to protect the public, personal and property safety, maintain social order and reduce environmental pollution, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prohibition of setting off fireworks and firecrackers within the administrative area of this Municipality and the related supervision and management work. Article 3 "Fireworks and firecrackers" as mentioned in these Regulations refers to fireworks and firecrackers products and civil black powder, pyrotechnics, initiating explosives and other articles used for the production of fireworks and firecrackers. Article 4 Fireworks and firecrackers are prohibited within the administrative areas of Huashan District and Yushan District of this Municipality.

The people's governments of hanshan county, Hexian, dangtu county and Bowang District shall, within their respective administrative areas, determine the time, place and area where fireworks and firecrackers are prohibited according to law. Fifth yellow and above heavy pollution weather warning period, the administrative area of the city completely banned fireworks. The early warning information of heavy pollution weather shall be announced to the public by the Municipal People's Government in accordance with the prescribed procedures. Article 6 The sale of fireworks and firecrackers is prohibited in areas and places where fireworks and firecrackers are prohibited. Article 7 It is forbidden to carry fireworks and firecrackers on public transport.

It is forbidden to mail fireworks and firecrackers, and it is forbidden to carry fireworks and firecrackers in checked luggage, parcels and mails. Article 8 These Regulations shall be organized and implemented by the people's governments of cities and counties (districts). City and county (District) people's governments shall establish a comprehensive coordination mechanism, and take the management of prohibiting the discharge of fireworks and firecrackers as the content of the creation of civilization and the comprehensive management of social security.

Township (town) people's governments and sub-district offices shall implement the responsibility of territorial management and do a good job in the management of prohibiting the discharge of fireworks and firecrackers.

The Administrative Committee of the Development Zone shall, in accordance with the requirements of the Municipal People's Government, do a good job in the management of the prohibition of fireworks and firecrackers in this area. Ninth public security departments are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

The safety production supervision and management department shall be responsible for the supervision and management of fireworks and firecrackers, and investigate and deal with illegal production and operation of fireworks and firecrackers according to law.

The administrative law enforcement department of urban management is responsible for investigating and punishing the acts of setting off fireworks and firecrackers that affect environmental sanitation and destroy urban greening and municipal facilities according to law.

Housing and urban-rural construction departments are responsible for urging construction, construction, supervision and other units to abide by the management regulations prohibiting the discharge of fireworks and firecrackers; Supervise and urge property service enterprises to do a good job in prohibiting the discharge of fireworks and firecrackers within the property management area, and discourage and report violations of the provisions prohibiting the discharge of fireworks and firecrackers.

The civil affairs department is responsible for guiding marriage registration offices, funeral homes, cemeteries and other units and social organizations to carry out publicity and education on the prohibition of fireworks and firecrackers, and guiding weddings and funerals to abide by the prohibition of fireworks and firecrackers.

The administrative departments of market supervision, transportation, environmental protection, culture and tourism, education, health, economy and informatization shall, according to their respective responsibilities, do a good job in the management of prohibiting the discharge of fireworks and firecrackers.

All functional departments should cooperate with each other to establish a push and sharing mechanism for important information clues such as weddings, funerals and business opening. Tenth people's governments at all levels and their relevant departments, street offices, village (neighborhood) committees, enterprises and institutions, social organizations and schools shall carry out publicity and education activities to prohibit the discharge of fireworks and firecrackers.

Radio, television, newspapers, internet and other media should carry out public welfare propaganda work to prohibit the discharge of fireworks and firecrackers.

Guardians of minors shall educate and supervise minors not to set off fireworks and firecrackers. Article 11 Village (neighborhood) committees and hotel operators engaged in property services, weddings, funerals and festive services shall promptly dissuade their clients or service areas from illegally setting off fireworks and firecrackers. If dissuasion fails, they shall promptly report to the public security department. Twelfth to encourage various forms of fireworks management model innovation.

Encourage all social forces to participate in the management activities of prohibiting the discharge of fireworks and firecrackers.

Encourage units and individuals to discourage and report violations of these regulations. After receiving the report, the public security and production safety supervision and management departments shall promptly investigate and handle it. If verified, the whistleblower shall be rewarded, and the reward measures shall be stipulated by the Municipal People's Government. Thirteenth major public events really need to be held in Huashan District, Yushan District administrative area fireworks show or other large-scale fireworks display activities, the organizer shall, after obtaining the consent of the Municipal People's government, apply for permission in accordance with the provisions of laws and regulations; Belonging to the areas, places and time periods where fireworks and firecrackers are prohibited as determined by the county (District) people's government, it shall be approved by the county (District) people's government, and the organizer shall apply for permission in accordance with the provisions of laws and regulations. Article 14 Whoever, in violation of the provisions of Articles 4 and 5 of these Regulations, sets off fireworks and firecrackers in areas, places and time periods where fireworks and firecrackers are prohibited, shall be ordered by the public security department to stop the discharge, and shall be imposed with a fine of more than 100 yuan and less than 500 yuan. Article 15 Whoever, in violation of the provisions of Article 6 of these regulations, sells fireworks and firecrackers in areas and places where the discharge of fireworks and firecrackers is prohibited, shall be ordered by the safety production supervision and management department to stop the illegal act, and be fined between 20,000 yuan and 100,000 yuan, and the fireworks and firecrackers and illegal income shall be confiscated. Article 16 Whoever, in violation of the provisions of Article 7 of these regulations, takes fireworks and firecrackers by public transport, or sends fireworks and firecrackers by mail, or carries fireworks and firecrackers in checked luggage, parcels and mails shall be confiscated by the public security department, and may be fined more than 200 yuan 1000 yuan.
