Measures of Gansu Province on the Administration of Weather Modification

Chapter I General Provisions Article 1 In order to rationally develop and utilize cloud and water resources in the air, effectively prevent and mitigate meteorological disasters, and standardize and strengthen the management of weather modification, these measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Management of Weather Modification, the Meteorological Regulations of Gansu Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to weather modification and its management activities within the administrative area of this province. Third people's governments at or above the county level shall incorporate the development of weather modification into the national economic and social development plan, and the funds needed for weather modification shall be included in the fiscal budget at the same level.

The people's governments at or above the county level shall strengthen their leadership over weather modification work within their respective administrative areas, establish and improve the command and coordination mechanism for weather modification work, set up weather modification work institutions or equip relevant personnel, and strengthen the construction of weather modification work units and the infrastructure construction of workplaces. Article 4 The competent meteorological departments at or above the county level, under the leadership of the people's governments at the corresponding levels, shall be responsible for the management, guidance and implementation of weather modification activities within their respective administrative areas.

Development and reform, finance, public security, agriculture, forestry, water conservancy, land and resources, civil affairs, environmental protection, supervision and management of production safety, civil aviation, communications and other relevant departments shall, according to their respective responsibilities, do a good job in weather modification. Article 5 People's governments at or above the county level shall encourage scientific and technological research on weather modification and the popularization and application of advanced technologies. The competent meteorological departments shall organize and carry out weather modification research in disaster prevention and mitigation, response to climate change, protection of ecological environment, protection of production safety of agriculture and animal husbandry, and development and utilization of cloud and water resources. Article 6 The people's governments at or above the county level shall commend and reward the units and individuals that have made remarkable achievements in weather modification. Chapter II Organization and Implementation Article 7 The competent meteorological departments at or above the county level shall, jointly with the relevant departments of development and reform, agriculture, forestry and environmental protection at the same level, formulate the development plan and work plan of weather modification in their respective administrative areas, which shall be implemented after being approved by the people's government at the same level. Eighth competent meteorological departments at or above the county level shall, under the organization of the people's government at the same level, formulate emergency plans for weather modification emergencies in conjunction with relevant departments and units.

When a safety accident occurs in weather modification, the local people's government shall promptly organize rescue and disposal, and report to the people's government at the next higher level and the competent meteorological department. Article 9 The weather modification operation site shall be put forward by the people's government of the city (prefecture) according to the local climate characteristics, geographical conditions, traffic, communication, population density and other conditions and the opinions of the people's government of the county (city, district), and the layout plan shall be submitted to the competent meteorological department of the province in conjunction with the flight control department.

The identified weather modification operation site shall not be changed without authorization, and if it is really necessary to change it, it shall be re-determined in accordance with the provisions of the preceding paragraph.

The township (town) people's government and village (neighborhood) committees where the weather modification operation site is located have the responsibility to protect the weather modification operation facilities. Tenth units and operators engaged in weather modification operations shall implement the qualification and qualification recognition system.

The weather modification operation unit shall obtain the qualification certificate of the weather modification operation unit, and its operators shall obtain the qualification certificate of the weather modification operation personnel before engaging in the weather modification operation. Eleventh the implementation of weather modification operations units shall meet the following conditions:

(1) Having the qualification of a legal person;

(2) There shall be no less than two operators, no less than three for each rocket launcher and no less than four for each anti-aircraft gun;

(3) Having anti-aircraft guns, rocket launchers, artificial rain bombs, rocket depots and other infrastructure, and meeting the mandatory national standards and relevant safety management regulations;

(4) Having communication tools to keep in touch with the weather modification operation command system and the flight control department;

(5) It has a sound system for declaring operational airspace, an operational safety management system and a system for maintaining, transporting, storing and keeping operational equipment. Twelfth to apply for the qualification certificate of weather modification operation units, the following materials shall be submitted:

(1) A written application;

(2) Organization code certificate of the unit as a legal person;

(3) Basic information and qualification certificate of the operator;

(4) certificate of operation equipment;

(5) Catalogue of relevant safety management systems. Article 13 An applicant shall apply to the local competent meteorological department for the qualification certificate of the weather modification operation unit, and the competent meteorological department shall complete the examination within seven days from the date of receiving the application. If it meets the conditions stipulated in Article 11 of these Measures, it shall be reported to the provincial competent meteorological department for confirmation.

The applicant may also apply directly to the provincial meteorological authorities. The provincial competent meteorological department shall complete the identification work within twenty days from the date of accepting the application. To meet the conditions, the applicant shall be awarded the qualification certificate of the weather modification operation unit; For those who do not meet the requirements, explain the reasons in writing to the applicant. Article 14 Personnel engaged in weather modification operations shall meet the following conditions:

(a) eighteen years of age or above, in good health;

(2) Having been trained by the competent meteorological departments at the provincial level, mastering the business norms, safety regulations and operational skills of weather modification operations, and having passed the examination.
