Measures of Yunnan Province on the Administration of Weather Modification

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Administration of Weather Modification and other relevant laws and regulations, combined with the actual situation of this province, in order to standardize the work of weather modification, rationally develop and utilize cloud and water resources in the air, prevent and mitigate meteorological disasters, and promote the construction of ecological environment. Second in the administrative area of this province engaged in weather modification and management activities, shall abide by these measures. Article 3 People's governments at or above the county level shall strengthen their leadership over weather modification, incorporate weather modification into the development plan of meteorological undertakings, and establish and improve the command and coordination mechanism of weather modification. Article 4 The weather modification work carried out according to the weather modification work plan approved by the people's government at or above the county level belongs to public welfare undertakings, and the required funds shall be included in the fiscal budget at the corresponding level.

People's governments at or above the county level shall establish and improve the investment mechanism of weather modification funds for tobacco, insurance and other beneficiaries. Article 5 The competent meteorological departments at or above the county level shall, under the leadership of the competent meteorological departments at higher levels and the people's governments at the corresponding levels, be responsible for the management, guidance and implementation of weather modification within their respective administrative areas.

Development and reform, industry and information technology, public security, civil affairs, finance, land and resources, environmental protection, agriculture, forestry, water conservancy, safety supervision, civil aviation, tobacco, insurance and other departments and units shall, according to their respective responsibilities, do a good job in weather modification. Article 6 People's governments at or above the county level shall strengthen the scientific popularization of weather modification, encourage and support scientific research, technological development and innovation of weather modification, and promote the popularization and application of scientific and technological research results of weather modification. Chapter II Organization and Implementation Article 7 The annual work plan for weather modification shall be compiled by the competent meteorological departments at or above the county level in conjunction with relevant departments according to the needs of disaster prevention and mitigation, ecological environment construction and the development and utilization of cloud and water resources in the air, and shall be submitted to the people's government at the same level for approval before being organized and implemented. Eighth units engaged in weather modification ground operations shall have the qualifications of a legal person and meet the following conditions:

(a) anti-aircraft guns, rocket launchers, motor vehicles, operating equipment warehouses, ammunition warehouses and other facilities meet the relevant national standards and requirements;

(two) the weather modification command system is sound, and the special communication network is smooth;

(3) Having commanders and operators who have passed the training and examination by the competent meteorological departments at the provincial level and meet the requirements;

(4) The declaration system for operating airspace, the management system for operating safety and the system for maintaining, transporting, storing and keeping operating equipment are perfect. Article 9 The local competent meteorological department shall, according to the climatic characteristics, geography, traffic, communication, population density and other conditions in the operation area, put forward the layout plan in accordance with the relevant provisions, and submit it to the provincial competent meteorological department in conjunction with the flight control department for determination.

The weather modification operation point determined by the audit shall not be changed without authorization; If it is really necessary to change, it shall be re-determined in accordance with the original procedures. Article 10 The land used for the construction of weather modification workplaces belongs to public welfare undertakings and shall be settled by the local people's government according to law.

Workplaces for weather modification shall be built in accordance with the relevant national standards and accepted by the competent meteorological departments at the county level. Eleventh any unit or individual shall not occupy the weather modification work site, and shall not damage or move the special equipment and facilities for weather modification.

The township (town) people's government, sub-district offices and village (neighborhood) committees where the weather modification workplace is located have the obligation to help protect the weather modification workplace and facilities. Article 12 When carrying out weather modification operations, operating units should know the range of anti-aircraft guns and rockets at their operating points and the distribution of people and property within the falling range of debris, draw a safe shooting boundary map, and avoid densely populated areas. Thirteenth in any of the following circumstances, the competent meteorological departments at or above the county level shall organize the implementation of weather modification operations according to the weather modification operation plan approved by the local people's government:

(a) the occurrence of drought or drought is expected to continue to increase;

(two) the reservoir dam water storage is seriously insufficient;

(three) there may be hail weather that harms crops;

(4) Forest fires have occurred or the forest has been in a period of high fire risk rating for a long time;

(five) the deterioration of the ecological environment due to weather and climate factors;

(six) other circumstances that really need to implement weather modification operations. Article 14 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to formulate emergency plans for weather modification operations in order to prevent major public emergencies such as forest fires, pollutant diffusion and environmental pollution, and organize their implementation. Fifteenth need to implement weather modification operations across administrative regions, determined by the relevant state (city), county (city, district) people's government through consultation; If negotiation fails, it shall be determined by the competent meteorological department at the next higher level in consultation with the people's government of the relevant state (city) or county (city, district). Article 16 Where weather modification operations are carried out, the competent meteorological department at the place of operation shall announce the operation time and geographical scope in advance, and notify the local public security organ of the specific situation. The specific measures for the announcement shall be formulated by the provincial meteorological authorities.

During the weather modification operation, the operation unit shall set up warning signs at the operation point.
