Provisions of Shucheng County on the Administration of Prohibiting Fireworks and Firecrackers

Article 1 In order to ensure public safety, personal and property safety, improve environmental quality, advocate civilized social customs and maintain harmonious social order, in accordance with the People's Republic of China (PRC) Air Pollution Prevention Law, People's Republic of China (PRC) Public Security Management Punishment Law, Fireworks Safety Management Regulations, Anhui Air Pollution Prevention Regulations and Lu 'an Fireworks Management Regulations and other laws and regulations,

Article 2 The area where fireworks and firecrackers are prohibited in Shucheng County refers to the enclosed area formed by the outer ring road and extending outward to the relevant administrative villages along the line, as follows (attached with a schematic diagram):

County Economic Development Zone, north of Hangbu River in Chengguan Town, Dadun Village, Fudun Village, Zhujing Village, Shigang Village, Xinghe Village, Song Wei Village, Wang Bo Village, Cangdun Village, Liming Village, Shunhe Village and Taoxin Village in Ganchahe Town.

In the area where fireworks are prohibited, no unit or individual may set off fireworks at any time, and shall not use electronic salute, electronic fireworks, electronic firecrackers and other substitutes that cause environmental noise pollution.

Outside the forbidden area, the relevant towns and villages should actively carry out the propaganda and launch of the work of banning fireworks and firecrackers in light of the actual situation in their jurisdiction. The county people's government will, according to the needs of urban development, adjust the regional scope of prohibiting fireworks and firecrackers in a timely manner and announce it to the public.

Third in the area where fireworks are prohibited, the following places in this county are prohibited from setting off fireworks all the year round:

(1) State organs, social organizations, scientific research institutions, etc. ;

(2) cultural relics protection units;

(3) Museums, archives, libraries, gymnasiums, cultural centers, theaters, etc. ;

(four) transportation hubs such as stations and docks, as well as rail transit and railway line safety protection zones;

(five) within the safety range of the production, storage and business units of inflammable and explosive goods;

(six) power facilities safety protection zone;

(seven) medical institutions, schools (including kindergartens), pension institutions, social assistance places, shopping malls, entertainment places and other crowded places;

(eight) in the safety protection zone of important military facilities;

(nine) key fire prevention areas such as scenic spots, forests, parks, green spaces and nurseries;

(ten) funeral homes, operating cemeteries, public cemeteries, cemeteries and other places;

(eleven) other places where fireworks are prohibited.

Where fireworks and firecrackers are prohibited, the owner, user or management unit shall set warning signs prohibiting fireworks and firecrackers, and do a good job in safety tips and prevention.

Fourth during the early warning period of heavy pollution weather, it is forbidden to set off fireworks and firecrackers within the administrative area of this county.

The county people's government shall timely release the early warning information of heavy pollution weather through the news media, and do a good job in prompting the prohibition of fireworks and firecrackers.

Article 5 Fireworks retail outlets shall not be set up in areas and places where fireworks and firecrackers are prohibited, and the original approved fireworks retail outlets shall withdraw from business in an orderly manner after the license expires.

Sixth County People's government set up Shucheng County fireworks management leading group, responsible for the organization and leadership of fireworks management. The leading group has an office responsible for comprehensive coordination, supervision and inspection.

Article 7 Chengguan Town People's Government, County Economic Development Zone Administrative Committee, Ganchahe Town People's Government, Berlin Town People's Government and Taoxi Town People's Government are responsible for the management of prohibiting the discharge of fireworks and firecrackers in their respective jurisdictions, and are specifically responsible for organizing implementation, publicity and education, submitting information, cooperating with law enforcement, and promptly discouraging illegal discharge of fireworks and firecrackers.

Article 8 The public security organ is the competent department that prohibits the discharge of fireworks and firecrackers, is responsible for the safety management of fireworks and firecrackers, and investigates and deals with illegal discharge of fireworks and firecrackers according to law.

County publicity, education, civil affairs, finance, ecological environment, housing construction, transportation, commerce, market supervision, emergency management, natural resources and planning, urban management and law enforcement, cultural tourism, forestry, key project construction management, meteorology and other departments and units shall, according to their respective functions, do a good job in the work related to the prohibition of fireworks and firecrackers.

Ninth state organs, social organizations, enterprises, institutions and other organizations are responsible for the management of the prohibition of fireworks and firecrackers, responsible for the publicity and management of the prohibition of fireworks and firecrackers in their own units, and urge their staff to take the lead in implementing these provisions.

Radio, television, internet and other news media should do a good job in the propaganda work of prohibiting the discharge of fireworks and firecrackers.

Tenth village (neighborhood) committees and owners' committees shall assist in the management of fireworks and firecrackers, discover and discourage illegal discharge, and may organize the management or service of residents, villagers and government agencies and units in the region to formulate a convention on the management of fireworks and firecrackers.

Property service enterprises, hotels, hotels and other units shall promptly discourage the illegal discharge of fireworks and firecrackers in the service area or the responsibility area, and report to the public security organ if the dissuasion is ineffective.

The guardian of a person without or with limited capacity for civil conduct shall strengthen the education and supervision over the discharge of fireworks and firecrackers by his ward.

Eleventh any unit or individual has the right to discourage illegal fireworks and firecrackers, and report to the relevant departments. After receiving the report, the relevant departments shall promptly investigate and deal with it, and keep the identity information of the informant confidential.

If the report is verified, 300 yuan, the first informant, will be given a material reward.

Article 12 Whoever, in violation of these regulations, sets off fireworks and firecrackers in areas or places where fireworks and firecrackers are prohibited, or sets off fireworks and firecrackers in a way that endangers public safety and personal and property safety, shall be ordered by the public security organ to stop setting off fireworks and firecrackers and impose a fine of not less than 300 yuan but not more than 500 yuan in accordance with the provisions of Article 42, paragraph 2, of the Regulations on the Safety Management of Fireworks and Firecrackers and Article 16 of the Regulations on the Management of Fireworks and Firecrackers in Lu 'an City; Those who violate the administration of public security shall be punished according to law.

Use electronic salute, electronic fireworks, electronic firecrackers and other fireworks and other substitutes in the forbidden area to create noise and interfere with the normal life of others, and the public security organ shall give a warning according to the provisions of Article 58 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment; If no correction is made after warning, a fine ranging from 200 yuan to 500 yuan shall be imposed.

Article 13 Whoever, in violation of the provisions of these regulations, engages in fireworks and firecrackers without permission shall be ordered by the emergency management department to stop illegal business activities according to the provisions of Article 36 of the Regulations on the Safety Management of Fireworks and Firecrackers, and shall be fined more than 20,000 yuan/kloc-0,000 yuan, and the illegally operated items and illegal income shall be confiscated. If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 14 If, in violation of these regulations, property service enterprises, hotels, hotels and other units fail to dissuade or report the illegal discharge of fireworks and firecrackers in service areas and areas of responsibility, the public security organs shall impose a fine of more than 1,000 yuan and less than 2,000 yuan according to Article 15 of the Regulations on the Administration of Fireworks and Firecrackers in Lu 'an City.

Fifteenth fireworks, resulting in property losses of the state and the collective, or personal injury or property losses of others, shall bear legal responsibility according to law.

Sixteenth relevant administrative departments and their staff in violation of the provisions of this Ordinance in the management of fireworks, one of the following circumstances, the directly responsible person in charge and other directly responsible personnel shall be punished according to law:

(a) failing to implement the main responsibility of fireworks administration in accordance with the provisions;

(two) the illegal operation and discharge of fireworks and firecrackers are not investigated and dealt with according to law;

(3) Failing to set a warning sign prohibiting discharge;

(four) the report of the informant is not accepted and not handled in time;

(5) disclosing the identity information of the informant;

(six) other acts of abuse of power, dereliction of duty, favoritism.

Seventeenth relevant departments in accordance with the provisions of the administrative relative person to make administrative punishment, administrative punishment information should be published on the website of the government or department. Relevant information related to enterprises shall be publicized in the enterprise credit information publicity system according to regulations.

Eighteenth prohibit the management of fireworks into the state organs at all levels, social organizations, enterprises and institutions and other organizations to create civilized units assessment.

Nineteenth these Provisions shall be interpreted by the county public security bureau. Where this provision conflicts with relevant laws and regulations, the relevant laws and regulations shall prevail.

Article 20 These Provisions shall come into force as of June 65438+1 October1day, 2023, and the Notice of Shucheng County People's Government on Printing and Distributing (Shu Zheng [2019] No.45) shall be abolished at the same time.
