Jiujiang bridge case was pronounced in the first instance.
On June 5, 2007, the Jiujiang Bridge collapsed. Afterwards, the Safety Committee of the Ministry of Communications set up an accident investigation team and made the Accident Investigation Report in September 2008. It is believed that the direct cause of the accident is that when the captain Shi Guide was sailing in the waters with poor visibility, he did not often look out, did not take measures such as sailing at a safe speed or anchoring at a selected place, and blindly sailed at full speed in the direction of the bridge. After discovering the imminent danger, the emergency avoidance measures are improper, which belongs to a unilateral accident in which the ship collides with the bridge. The ship "Nanguiji 035" should bear the responsibility. The accident investigation report of Guangdong Provincial Safety Supervision Bureau also found that the captain of "Nanguiji 035" was directly responsible for the accident.
Shi Guide's defenders have repeatedly put forward the opinions that piers No.23, No.24 and No.25 of Jiujiang Bridge are "suspended" and "collapsed due to serious safety hazards". The court held that according to the original files and relevant materials provided by the public prosecution agency, several piles of piers No.23, No.24 and No.25 all met the design requirements of being embedded in the rock stratum for 2 meters, and "short piles of piers are suspended" was inconsistent with the facts.
The court held that the defendant Shi Guide violated the laws and regulations on waterway transportation and caused a major traffic accident, resulting in eight deaths and heavy losses to public and private property, and the circumstances were particularly bad, which constituted a traffic accident crime.
The court held that according to the Accident Investigation Report of Guangdong Provincial Administration of Work Safety, the accident occurred during the construction of Jiujiang Bridge expansion project, and the relevant units did not take necessary safety measures in strict accordance with the requirements and were indirectly responsible. Therefore, the defendant Shi Guide can be given a lighter punishment as appropriate, and the above judgment was made.
The captain's wife and children refused to accept the verdict.
"Have opinions!" When the presiding judge read out the verdict and asked Shi Dao what he thought, a young man standing in the back of the gallery shouted loudly, which surprised everyone. This young man is Shi Ruican, the eldest son of 18-year-old Shi Guide. This time, he and his mother came to listen to his father's sentence. This is their first time to take part in their father's case.
After the court, Shi Ruican told reporters: "It is unreasonable. Sorry for the family of the deceased, sorry for my father. Why not salvage the bow? I didn't understand how the bridge was broken. " He said that if the boat broke the bridge, everyone on board would be injured, but they were not injured.
"The simplest point, if the ship hit the bridge, there must be traces. Please show me! " Shi Guide's wife also questioned, "Why not salvage the bow after looking for evidence for four or five years?" Both Shi Ruican and his mother said they would appeal. At about 5: 00 am on June 15, 2007, Jiujiang Bridge was sunk by the sand carrier "Nanguiji 035", and the bridge deck collapsed about 200 meters, resulting in 8 deaths and 4 cars crashing into the river. The ship was later cut, the hull was auctioned and the bow was still at the bottom of the river.
On August 2, 2007, the captain of the accident, Shi Guide, was arrested by the Haizhu District Procuratorate of Guangzhou on suspicion of traffic accident.
On August 22, 2007, Fokai Expressway claimed more than 25.58 million yuan from the owner of the collision ship and its affiliated companies.
On June 5, 2007, Guangzhou Maritime Court suspended the trial of the case on the grounds of waiting for the accident investigation report.
On February 5, 2008, 65438, the claim was filed for the first time. The accident report was not made public.
On June 4, 2009, 65438+, the claim was heard for the second time.
On June 5, 2009, Guangzhou Maritime Court issued a civil ruling, ruling to suspend the trial of the claim. The reason is that the criminal case of captain Shi Guide suspected of traffic accident is under review and prosecution.
River conditions at the time of the incident.
The defense lawyer also pointed out that according to the information, when the bridge was built, the water depth was 10 meter, but when the Jiujiang Bridge collapsed, the water depth was already 33 meters, which means that the foundation of 23 meters was missing. "As far as I know, when the bridge was completed, the bottom of the bridge was covered with thick granite. Why did it disappear 23 meters? Did the current wash away the granite? The accident investigation report of relevant units made no mention of the bridge quality. Why? " The defense lawyer questioned.
Prosecution: the captain misjudged.
It is said that at 4 o'clock in the morning of June 15, 2007, Shi Guide sailed the boat "Nanguiji 035" to load river sand from Gaoming, Foshan to Shunde, and there was light fog on the river surface during the voyage. At about 5 o'clock, when the ship was about 1 100 meters away from Jiujiang Bridge, dense fog appeared on the river surface, and the visibility dropped sharply. As the captain, Shi Guide did not strengthen his lookout, choose a safe place to anchor and adopt a safe speed as required, and still ventured to sail when he could not confirm whether the white light seen in front of the bow was the main channel light. When the ship "Nanguiji 035" approached Jiujiang Bridge, Shi Guide realized that the ship had seriously deviated from the main channel due to its collision with a navigation mark about 80 meters in front of the bridge. However, he still did not take effective measures such as suspension, but tried to transfer the bow to the pier of Jiujiang Bridge, thinking that the ship could avoid touching the pier of the bridge.
At about 5: 00 10 on the same day, the ship "nanguiji 035" deviated from the fairway, and the captain made a serious mistake in judging the fairway lights, causing the bow to touch the pier No.23 of Jiujiang Bridge, causing the piers No.23, No.24 and No.25 of Jiujiang Bridge to collapse, and the deck it carried collapsed. Four cars (license plates JY2459, B72420, J 17 175, AKW983) traveling on the bridge (identified as * * * with a value of RMB 3200 1 1 Yuan) fell into the river and were damaged. At the same time, the victims in the above-mentioned cars are Wu Moumou and. In order to prove Shi Guide's criminal facts, the prosecution presented the testimony of 23 witnesses and invited 3 of them to testify in court. Surprisingly, as prosecution witnesses, they all said in court that they didn't see the ship hit the dock.
Topaz, a sailor, said that he had just stepped onto the bridge when the accident happened. Because of the fog, he didn't see clearly whether the bow hit the pier, only felt that the bow was hit by something and pressed forward. It is reported that when Huang Yuyou was asked by the public security organs after the incident, he said that he saw the ship hit the bridge. In this regard, Topaz's explanation is "because everyone thinks so, so I say this, in fact, I can't see it clearly."
Sailor Li Yizhuan said in the public security organ that after being awakened by Shi Guide, he saw the sparks generated by the collision between the ship and the dock. Yesterday, he changed his mind and said he didn't see it clearly. This may cause a sensation. This surprised the prosecutor and questioned that "splash and spark are very different." Li Yizhuan changed his tune again, indicating that there may be cables on the bridge deck, which will generate sparks after being pressed against the bow.
Sailor Luo Zhichao once said in the public security organ that after being awakened by the captain, he felt the hull shaking and leaning to the right. Less than 10 second, there was a loud noise, and he felt the bow down and the stern up. In yesterday's trial, when the prosecutor asked Luo Zhichao to describe the first shock, Luo Zhichao said, "It's too long, I can't remember it clearly."
Captain: The ship didn't hit the dock.
On July 5, 2065438+00, Shi Guide, who had been released on bail pending trial, was somewhat slow to respond and often could not hear the questions clearly. For the accusation, Shi Guide disagreed, saying that the ship did not hit the pier, but the bridge deck suddenly collapsed, causing the shipwreck.
He said that due to the foggy weather, when he was about 80 meters away from the dock, he realized that the ship had deviated from the channel, so he slowed down and looked forward. I pushed the boat forward because the current was very fast. About 20 meters away from the dock, the stone guide slammed the left full rudder. He admitted that he had to speed up when he hit the left full rudder, otherwise the ship would never turn back. "Suddenly, the bridge deck hit my bow."
Shi Guide said that although he couldn't see the bow clearly in the fog on the bridge, he didn't feel the impact, only the pressure on the bow. "I thought it was the construction frame on the bridge that fell down. I called my boss, Lin, and said that something had happened to the boat and something was pressed down. " Shi Dao said. After the prosecutor repeatedly asked whether the ship hit the dock, Shi Guide, who had been faltering, suddenly became impatient and roared: "I didn't hit it!" " "
Fisherman: There is no dent in the ship's side.
Li Kexin, who participated in the salvage exploration after the incident, said in court as a defense witness that he touched the left and right sides of the ship, but did not touch the sinking phenomenon after the collision between the two sides. According to this, Shi Guide's defense lawyer believes that if the ship hit the bridge, there should be damage and a lot of scratches on the ship's side under such a strong impact, but according to the photos, the paint on both sides of the ship's side has not been scraped off.
The prosecutor responded that the bow and hull were cut when salvaging, and the bow remained at the bottom of the water. It cannot be ruled out that there are serious collision marks and dents on the bow.
