Measures of Zhejiang Province on Prevention of Meteorological Disasters

Chapter I General Provisions Article 1 In order to strengthen the prevention of meteorological disasters, avoid or reduce the losses caused by meteorological disasters, and ensure the economic and social development and the safety of people's lives and property, these measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Prevention of Meteorological Disasters and other laws and regulations, combined with the actual situation of this province. Article 2 Meteorological disasters mentioned in these Measures refer to disasters caused by typhoon, rainstorm (snow), cold wave, strong wind (tornado), low temperature, high temperature, drought, lightning, hail, frost, fog and haze. Article 3 Units and individuals engaged in meteorological disaster prevention activities within the administrative region of this province and the sea areas under its jurisdiction (hereinafter referred to as the sea areas under its jurisdiction) shall abide by these measures.

The provisions of relevant laws and regulations shall apply to the prevention of derivative and secondary disasters caused by meteorological factors such as floods and droughts, geological disasters, marine disasters and forest fires. Article 4 The prevention of meteorological disasters shall adhere to the principles of people-oriented, prevention-oriented, scientific defense, overall coordination and effective rescue, and implement the working mechanism of government-led, departmental linkage and social participation. Article 5 People's governments at or above the county level shall strengthen their leadership in meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan, establish and improve the organizational system and work responsibility system for meteorological disaster prevention, improve meteorological disaster prevention and emergency facilities, and establish and improve the government-supported meteorological disaster risk insurance system. The funds required for meteorological disaster prevention and emergency response are included in the fiscal budget.

The township (town) people's government (including street offices, the same below) shall do a good job in the prevention of meteorological disasters within its jurisdiction in accordance with the prescribed duties. The township (town) people's government shall determine meteorological assistants to assist in the propaganda of meteorological disaster prevention knowledge, emergency contact, information transmission, disaster report and disaster investigation. Sixth competent meteorological departments at or above the county level and the relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the prevention of meteorological disasters within their respective jurisdictions. Seventh people's governments at or above the county level and their relevant departments and competent meteorological departments shall encourage and support the research, popularization and application of meteorological disaster prevention technology, and improve the scientific and technological level of meteorological disaster prevention. Article 8 People's governments at all levels, relevant departments, news media, enterprises and institutions, and village (neighborhood) committees shall take measures to publicize and popularize the knowledge of meteorological disaster prevention and rescue, and enhance the public's awareness of meteorological disaster prevention and their ability to avoid disasters, avoid risks, save themselves and help each other.

The competent meteorological departments at or above the county level shall do a good job in popular science propaganda and consulting services for meteorological disaster prevention and rescue.

The education administrative departments of the people's governments at or above the county level and all kinds of schools shall incorporate meteorological disaster knowledge into relevant courses and extracurricular education contents. Chapter II Prevention Article 9 The people's governments at or above the county level shall organize competent meteorological departments and relevant departments to conduct a general survey of the types, frequencies, intensities and losses caused by meteorological disasters within their respective jurisdictions, establish a meteorological disaster database, conduct meteorological disaster risk assessment according to the types of meteorological disasters, and work out meteorological disaster risk zoning and delimit meteorological disaster risk zones according to the distribution of meteorological disasters and the results of meteorological disaster risk assessment. Article 10 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to formulate meteorological disaster prevention plans in accordance with the Regulations on Meteorological Disaster Prevention, and formulate meteorological disaster emergency plans according to meteorological disaster prevention plans and local meteorological disaster characteristics, and report them to the people's government at the next higher level for the record.

The relevant departments and units shall, in accordance with the provisions of the Regulations on the Prevention of Meteorological Disasters and other laws and regulations, formulate emergency plans for meteorological disasters in light of their own characteristics. Eleventh people's governments at all levels shall organize meteorological disaster prevention emergency drills to ensure that meteorological disaster emergency plans can be started in time and effectively implemented. Article 12 People's governments at or above the county level and their relevant departments shall strengthen the construction and maintenance of meteorological disaster prevention facilities such as seawalls, dikes, reservoirs, safe havens, shelterbelts, sheltered anchorages, emergency materials storage places, disaster avoidance and resettlement places, and improve their meteorological disaster prevention capabilities. Thirteenth township (town) people's government, village (neighborhood) committees and key units of meteorological disaster prevention shall make good preparations for defense in accordance with the requirements of meteorological disaster prevention. Meteorological disaster prevention preparation includes the construction of necessary meteorological monitoring facilities and disaster avoidance and resettlement places, the reception and dissemination of early warning information, the improvement and exercise of emergency plans, the publicity and training of meteorological disaster prevention knowledge, and the implementation of responsible persons and work responsibilities. Key units for meteorological disaster prevention shall be determined by the people's government at the county level.

The people's government at the county level shall organize the competent meteorological departments and relevant departments to supervise and inspect the meteorological disaster prevention and preparation work of the relevant units specified in the preceding paragraph. Article 14 The relevant departments and units shall, according to local meteorological disasters such as typhoon, lightning, rainfall, snowfall and freezing, organize inspection of various defense facilities, strengthen inspection of areas prone to geological disasters and maintenance of roads, electric power and communication lines, and do a good job in strengthening dangerous reservoirs and dangerous houses. Fifteenth people's governments at or above the county level shall strengthen the organization and coordination of weather modification work. The competent meteorological departments at or above the county level shall, according to the needs of disaster prevention and mitigation and the weather modification work plan approved by the people's government at the corresponding level, timely implement weather modification operations such as artificial precipitation enhancement and hail suppression. The relevant departments shall, in accordance with the division of responsibilities, cooperate with the competent meteorological departments to do a good job in weather modification.
