In order to prevent fires and casualties, and effectively reduce the air and noise pollution caused by the discharge of fireworks and firecrackers, according to the relevant contents and requirements of the Regulations on the Safety Management of Fireworks and Firecrackers (Order No.455 of the State Council of the People's Republic of China) and the Code for the Safety and Quality of Fireworks and Firecrackers (GB10631-2013), the county government decided,

First, limit the areas where fireworks and firecrackers are set off.

The main city of the county is a forbidden area for fireworks and firecrackers.

Two, the time allowed to set off fireworks (hereinafter referred to as the Spring Festival)

In the restricted area, fireworks and firecrackers can be set off during the Spring Festival every year, that is, on the thirtieth day of the twelfth lunar month (New Year's Eve) and the first day of the first month, and from 7: 00 to 22: 00 on the fifth and fifteenth day of the first month. During the period when the provinces and cities issued Class III and above warnings of heavy polluted weather, the county was completely banned.

Three, the time to prohibit the discharge of fireworks and firecrackers

Fireworks and firecrackers shall not be set off during the rest of the year except during the Spring Festival.

4. Places where fireworks and firecrackers are prohibited.

Fireworks and firecrackers are allowed to be set off during the Spring Festival, and the following regional places are prohibited:

(a) Party and government organs, hospitals, schools, parks, shopping malls, theaters, cultural relics protection units, large cultural and sports venues, archives, bazaars and other public places, bus stops and other units and its surrounding 50 meters;

(2) Gas stations, liquefied gas stations, factories, warehouses producing and storing inflammable and explosive dangerous goods and their surroundings 100 meters;

(3) Radio stations, television stations, telecommunications, postal services, financial institutions, electric power and communication lines, and corridors, aisles, roofs and balconies of houses;

(4) Important military areas;

(five) 10 floor or more than 24 meters within a safe distance of 25 meters;

(six) the residential area or high-rise building that implements property management is outside the discharge area designated by the property company;

(seven) key fire prevention areas such as forest land;

(eight) other places where fireworks and firecrackers are prohibited as stipulated by the county government.

Five, it is forbidden to set off fireworks.

During the ban period (except during the Spring Festival), it is forbidden to set off electronic salutes, electronic firecrackers and other fireworks and their substitutes.

During the restricted release period (during the Spring Festival), the varieties that can be discharged are limited to the products below Grade C by individuals, and it is forbidden to discharge all Grade A and B fireworks and firecrackers (the regular fireworks and firecrackers are marked with Grade A, B, C and D).

Six, the provisions of the fireworks

Organizing fireworks parties and large-scale fireworks display activities must be approved by the public security department of the public security organ and obtain the Fireworks Display Permit.

Seven, allow the safe discharge of fireworks during the discharge period.

All social units and individuals who set off fireworks and firecrackers should: avoid setting off fireworks and firecrackers after drinking; Shall not set off illegal, counterfeit and excessive fireworks; Don't throw lit fireworks at people, vehicles and buildings; Do not set off or throw fireworks and firecrackers on buildings, roofs and balconies; Fireworks and firecrackers shall not be set off in other ways that endanger the personal and property safety of the state, the collective and others; Minors under the age of fourteen must be accompanied by guardians or other adults when setting off fireworks and firecrackers.

Eight, fireworks management and punishment

Any unit or individual who, in violation of these Provisions, sets off fireworks at the time and place where fireworks are prohibited, or sets off fireworks in a way that endangers public safety and personal and property safety, shall be fined or administratively detained by the public security organ in accordance with the Regulations on the Safety Management of Fireworks and Firecrackers and the Law of People's Republic of China (PRC) on Public Security Administration Punishment.

If large-scale fireworks display activities such as fireworks show are held without permission, the public security department shall order it to stop the discharge, and impose a fine of 654.38 million yuan to 50,000 yuan on the responsible unit.

Refusing or obstructing law enforcement officers from performing official duties according to law, which constitutes a violation of public security administration, shall be punished in accordance with the Law of People's Republic of China (PRC) on Public Security Administration Punishment; If a crime is constituted, criminal responsibility shall be investigated according to law.
