State regulations on continuous working hours at high temperature
When the daily maximum temperature reaches 40℃ or above, stop outdoor work that day; When the daily maximum temperature reaches 37℃ or above and 40℃ or below, the employer shall not arrange outdoor open-air operation for workers for more than 6 hours, and the continuous operation time shall not exceed the national regulations, and outdoor open-air operation shall not be arranged within 3 hours of the maximum temperature period; When the daily maximum temperature reaches more than 35℃ and less than 37℃, the employer shall take a rest in shifts to shorten the continuous working hours of workers, and shall not arrange outdoor workers to work overtime.
Classification of high temperature operation:
The first is high temperature and strong thermal radiation operation, with high temperature and high thermal radiation intensity. Commonly used in metallurgy, ceramics, glass, casting and other operations.
The second category is high temperature and high humidity operation. This kind of operation has high temperature, high humidity and generally low thermal radiation intensity. It exists in textile, printing and dyeing, underground and other operations. The relative humidity can reach 80% ~ 90%.
The third category is summer open-air operation. Mainly engaged in all kinds of agricultural labor, field investigation, open-air loading and unloading, construction, take-away personnel, sanitation operations, military training. In addition to high temperature, such operations are often accompanied by thermal radiation from the sun and the ground, so the exposed temperature will be higher.
Preventive measures for high temperature:
(A) organizational management measures
1. The employing unit shall establish and improve the heatstroke prevention and cooling system, take effective measures to strengthen the labor protection for high-temperature operations and high-temperature weather operations, and ensure the health and life safety of workers (Measures for the Administration of Heatstroke Prevention and Cooling Measures, No.89 [2012]).
2. The employing unit shall, according to the relevant provisions of the state, rationally arrange the production site, improve the production technology and operation flow, and take good measures of heat insulation, ventilation and cooling to ensure that the workplace meets the requirements of the national occupational health standards.
3. The employing unit shall not arrange pregnant female workers and underage workers to engage in high-temperature operations above Grade III in the Classification of Occupational Hazards in the Workplace Part 3: High Temperature (GBZ/T 229.3). The employer shall not arrange pregnant female workers and underage workers to engage in outdoor open-air operations and high-temperature operations above 33℃ during high-temperature weather above 35℃.
4. During the hot weather, the employing unit shall, in accordance with the relevant regulations and according to the production characteristics and specific conditions, take reasonable arrangements for working hours, rotate operations, appropriately increase the rest time of workers in the hot working environment, reduce labor intensity, and reduce outdoor operations during the hot period.
Legal basis:
Article 17 of the Notice of the State Administration of Work Safety, the Ministry of Health, Ministry of Human Resources and Social Security and the All-China Federation of Trade Unions on Printing and Distributing the Management Measures for Heatstroke Prevention and Cooling-down, workers engaged in high-temperature operations shall enjoy post allowances according to law.
If the employing unit arranges laborers to engage in outdoor open-air operations in high-temperature weather above 35℃ and cannot take effective measures to reduce the workplace temperature below 33℃, it shall pay high-temperature allowance to the laborers and include it in the total wages. The standard of high temperature allowance shall be formulated by the provincial administrative department of human resources and social security in conjunction with relevant departments, and adjusted in time according to the social and economic development.
