Prison, for many people, is a mysterious and frightening place. In fact, most people have no direct feelings about the prison, and most of the indirect feelings come from literary works and film and television works, such as Killing Wei Bang, White Mansion and Digging Mud Cave in Water Margin, Chili Water and Tiger Bench in Red Rock, which have left a deep impression on people. What is the prison in New China, especially in China since the reform and opening up?

I'll believe that when I see it. Since September 2000, I have interviewed more than a dozen prisons in seven provinces and cities, including Qinghai, Shandong, Hubei, Hunan, Guangdong, Shanghai and Beijing. From west to east, from economically backward areas to economically developed areas, although the hardware facilities of prisons vary greatly, they are consistent in management system and respect for human rights, that is, they are managed in strict accordance with the prison policies stipulated by the state, especially 1998.

So, what's it like in prison now?

During an interview with Tanghe Prison in Qinghai, I learned that 10 years ago, a major earthquake razed all the offices and family houses of the prison (then called the reform-through-labour farm), and 100 people were killed, but no cell collapsed on the prison wall and no prisoner died. The reason is that prison offices and family rooms are "dry-paved" (simple houses built with clay), which can't stand strong earthquakes, while prison rooms are all brick structures, which are much stronger than "dry-paved". Information about the earthquake in Tanggemu Farm was published in the white paper "The Situation of Reforming Criminals in China" issued by the State Council Press Office 1992.

When interviewed in Shandong Lunan Prison, what impressed me the most was the prisoner's big room. That kitchen is as big as two basketball courts, like the big workshops of two factories, one for staple food and the other for non-staple food. As soon as I walked into the "workshop" of non-staple food, I smelled a smell of meat. I saw two cauldrons about1.5m in diameter in cook the meat. The prisoner on duty told me that this is for the prisoners who work at night in the mine. He also told me that they have two dishes for every meal, one meat and one vegetable; The food is for everyone, and the rice is free to eat. There is no problem of not eating enough. On the wall next to it, there is a beautifully made list of prisoners' weekly recipes, which is as beautiful as a display board. It not only indicates what to eat at each meal this week, but also indicates the nutritional components and calories (calories) of these foods. For a small proportion of Muslim prisoners in prisons, recipes are specially formulated for them. In the staple food "workshop", I saw white rice steamed in a huge steamer, and white bread steamed in a stainless steel steamer more than one person high. Steamed buns are very big, one is 42. I can't help but say to Wang Libin, deputy director of the prison office who accompanied the interview: What a big steamed stuffed bun! Wang Libin said, do you want to try? I really wanted to know what was in the steamed stuffed bun, so I said, OK, try it. A prisoner immediately took out two steamed buns from the rectangular steamer he had just taken. I said one is enough. Actually, I can't eat any of them. I wanted to break the steamed stuffed bun to half of Wang Libin's, but I didn't expect the oil inside to immediately flow all over the floor along my fingers-not only meat, but also a lot of oil! Wang Libin and I stood there munching, causing the prisoners who ate next to us to look at us curiously. Wang Libin told me that it was his first time to taste the food in the prisoner's canteen, and he was still moved by my "light". Because the prison has strict regulations, prison staff are not allowed to eat in the prisoners' canteen. There is a staff canteen in the prison. It is said that it is not as good as the prisoner canteen. A bachelor said to Jiang Yushui, the deputy prison director in charge of discipline: Why don't we just give the meals to the prisoners' canteen and eat them in the prisoners' canteen? Jiang Yushui flatly refused: No, correctional officers can't take advantage of prisoners!

Later, I saw a big room like Lunan Prison and their recipes, all of which were good. Some of them even have stainless steel tableware, but I have never tasted their food again, because I can't take advantage of prisoners!

Walking into the gate of Hu Wei Prison, the first thing you see is a large green lawn as big as a football field, which is the masterpiece of Zou Jizhong, the deputy prison director in charge of discipline. At the beginning, he pushed his way through the crowd and spent only a few hundred dollars on it-the labor cost was not included, the turf was transplanted from other parts of the prison, and only the tiles around the lawn cost a little money. Among the dozens of prisons I have interviewed, Hu Wei Prison can be said to be one of the best prisons with institutionalized management and environmental transformation.

However, when it comes to prison hardware facilities, Guangdong SAR prisons such as Dongguan Prison and Shenzhen Prison are the best.

Walking in the square and prison area of Dongguan Prison, if the surrounding high-wall power grid doesn't remind me of this place from time to time, and if prisoners in standard prison uniforms don't pass by from time to time, then I will definitely regard this place as a university campus or a garden-style residential community. The teaching building of the prison is very magnificent. The amphitheatre, which can accommodate hundreds of people, is much more beautiful than the amphitheatre of PLA Art College I have read. Those psychotherapy rooms, with novel design and warm decoration, are the most beautiful psychotherapy centers I have ever seen. As for other audio-visual teaching equipment, ordinary colleges and universities can't reach it. Cui Jiqiang, deputy section chief of the prison education and reform department who accompanied me in the interview, told me that some middle school students who came here to visit were surprised to see such a good modern facility and shouted: Wow, it's so beautiful, much better than our school! If we unilaterally publicize the environment and facilities of our prison, it will have a negative effect and make some people mistakenly think that prison is a paradise and a place to live a happy life. Therefore, it should be emphasized that prisons are places to punish prisoners. Prisoners have no freedom here and should be reformed honestly. Freedom is the most precious thing for everyone.

So I think people are most concerned about not only the living conditions in prison, but also things like commutation, parole and medical parole. It is generally believed that there must be a lot of "tricks" in this regard. Frankly speaking, there were some problems in the past. Even now, such incidents happen from time to time in some places. For example, when I went to Qinghai for an interview, I heard that a section chief of the prison department was arrested by the procuratorate for taking bribes while cooperating with others to reduce the sentence of a prisoner. Not long ago, I read the result of this case in the Legal Daily: the chief of the district intermediate court and a judge were sentenced. Similar incidents have occasionally occurred in other provinces and cities, and the people involved have also been severely punished. In recent years, the Ministry of Justice has extensively carried out the activities of "making prison affairs public" in the national prison system, which greatly enhanced the transparency of the prison penalty execution process and basically put an end to the phenomenon of "black-box operation". If someone dares to take the world by storm because of human feelings or self-interest, and is "tricky" on this issue, it is inevitable to be punished by law. The above example is a good proof.

At present, prisons all over the country implement a scoring system for the management of prisoners, and when the scores accumulate to a certain extent, they can be rewarded; If the reward accumulates to a certain extent, you can make meritorious service and reduce your sentence. This experience was first summed up in Weifang Prison, Shandong Province. It was first promoted in Shandong Province, and then promoted by the Ministry of Justice throughout the country. When I was interviewed in Shandong Lunan, Hu Wei, Tengzhou and Weifang prisons, I saw that the list of each batch of people who reported commutation was published by the prisons, and anyone who has any objection can report it to the prison leaders or prison leaders. In addition, the procuratorate has a special institution in the prison, which is responsible for receiving all kinds of reports and complaints. The list of commutation reported by the prison in the prison area shall be discussed and approved by the prison Committee collectively, and then reported to the intermediate people's court in the jurisdiction. If a prisoner's commutation report is not approved by the prison Committee, then the warden or the deputy warden in charge of discipline should personally explain the situation to the parties; If the court does not approve, the court shall explain the situation to the prison. Such strict procedures not only promote the enthusiasm of prisoners' reform, but also protect a group of prison police officers-no matter who intercedes, no matter how selfish, because the system is strict, they will not make mistakes.

Skillfully shave "with thorns"

The prisoner Pan was carried to Lunan prison on a stretcher. He was sentenced to 15 years' imprisonment for theft and was initially held in Linyi prison. Before being transferred to Lunan prison, he suddenly got "hemiplegia". It is said that the reason for his illness is that he burned bricks in the brick factory in Linyi prison. When he came out of the kiln, the brick was already very hot. He broke out in a sweat and threw cold water at them. After he came to Lunan prison, he couldn't get out of bed, so he peed on the bed, which made the room stink and he couldn't get in. Besides, he speaks Lickitung, which no one can understand, just like dementia.

Sun Jihai, the discipline assistant of the brigade, felt suspicious. How can a young man in his twenties be so temperamental and paralyzed by cold water?

Take him to the hospital for examination. The doctor also said that he might get sick after being stimulated by cold water, but it's not that serious. The doctor pricked his leg with a needle and asked him if it hurt. He said no; Knocking with a hammer, he didn't respond. There was no expression on her face, and she just sat there. The captain tugged at his leg, but it couldn't move. The doctor is surprised: hemiplegia, this leg should not be pulled too hard!

Taking medicine for more than two months has no effect at all. Peeing in bed all day, the stench in the room can make others breathless. The prisoner doesn't want to share a room with him, so he can only be arranged in a single room. I'm afraid he'll kill himself. I have to send someone to watch him. Prison carries out health inspection and appraisal, and this prison is always the last one. His "illness" not only involves a lot of energy of the discipline cadres, but also seriously affects the management order of the prison. Besides, you change his bedding every day. Why do you change so many bedding?

Damn it, help him up! Sun Jihai ordered the prisoner to go to the toilet, thinking that he wouldn't change his bedding if he peed on the bed again! But he thought: If I am sick, I am abusing prisoners! We must find out whether his illness is true or not as soon as possible.

In order to escape the reform through labor, some prisoners will try their best to pretend to be sick for various reasons, which is called "pseudo-disease" by the prison. Sun Jihai 1970 has been working in the prison system since he was demobilized from the army. This situation has been common for more than ten years. Not long ago, a prisoner named Xu, who was also transferred from Linyi prison, was caught red-handed by Sun Jihai for pretending to be ill.

Xu arrived several months earlier than Pan. When he was transferred from Linyi prison, he was on crutches. He is in his forties. He used to be an accountant in the countryside. He was sentenced to six years in prison for fraud. He has a glib tongue. He said that his sciatic nerve hurts and his legs can't walk or work. He walked around on crutches all day, looking around. He is one of the few idle people in prison.

Sun Jihai talked to him, and he said, "Captain, it's not that I don't work, but that my leg really doesn't work."

I went to the hospital many times and found nothing. The sciatic nerve hurts, which is hard to see. One Sunday three months later, Sun Jihai quietly went to the prison without rest. The prisoner on duty in the corridor saw him and wanted to talk, but he stopped him with his gesture. He didn't want the prisoner to know that he was coming. The prisoner is playing cards, and Xu is involved. Sun Jihai watched by the door of the room for more than ten minutes, but the prisoner never found him. Xu Qingxiang was angry at playing cards with a prisoner and quarreled with him.

The prisoner scolded Xu: "What are you doing playing dumb? When the captain came, you were ill. The captain didn't come, and you didn't turn over when you went to bed. You pretend to be a kidnapper and fool around with the government all day. Don't try to fool me! "

Xu Qingxiang was anxious and wanted to beat him up. The prisoner started to run, and Xu stood up and chased him. Run so fast that you don't turn at all. Chasing to the door and seeing Sun Jihai standing outside, I was silly.

Sun Jihai said, "Xu Qingxiang, your leg doesn't hurt, does it? How can you run so well without crutches now? Go, go, go upstairs with me! "

There is no need for Xu to pretend to be kidnapped, so he followed Sun Jihai to the classroom upstairs dejectedly.

"Xu, three months, how much work I gave you, you didn't listen. You write promises, swear by poison, and keep saying that your illness is true. I saw it with my own eyes today What else do you say? " Sun Jihai gave him a detention list. "Go, take your quilt and go to the brig ... You pretend to be sick and resist reform, which is strict enough."

Xu immediately said, "Captain, I told you not to turn me off. Don't send me to the strict management team, or I will reflect on it in the prison area and write a good inspection. "

There is also a single room in the prison. Sun Jihai asked several prisoners to watch him write a check. During the inspection, he said that the reason for his pseudo-illness was that he was almost forty years old, and he was afraid to go down to the well (Lunan prison is a coal mine prison) and wanted to "seek medical treatment on parole". It means that we must make a good reform, strive for leniency, and strive for commutation.

After seeing Xu's inspection, Sun Jihai said to him, "Last month, when your family came to pick me up, I found the problem. Your family asked: What happened to your leg? If your leg is not good at home, she will say: Is your leg good? You said your leg caught cold. Why did you come to Lunan prison to catch a cold? "

Xu Qingxiang was speechless and said with tears, "I am convinced, captain. I can't go on like this. "

Sun Jihai said, "It's not too late to repent. You still have more than three years in prison. If you behave well, your sentence can be reduced. If you don't perform well, you can't lose a day. "

Many times, he said that he must perform well. He made an in-depth examination at the prisoners' meeting and did well later. He is active in work, study and housework. He used to be a village cadre and also came to work, often reflecting his thoughts to the government. The following year, he was elected as an activist of reform through labor, and later became the director of the "accumulation committee" of a large group of prisoners, and became the head of more than 90 prisoners in/kloc-0. Finally, my sentence was reduced for eight months, and I left. Of course, this is another story.

Pan's situation is different from Xu's. Xu has a glib tongue, Pan said foolishly, and no one could hear clearly. It's hard to talk to him.

At noon one day in June, Sun Jihai said to section chief Zhao of the life department, "Look at whether Pan is true or not."

It's already very hot, and Pan is taking a nap. This room stinks to death. Sun Jihai and Zhao Kechang held their breath and walked to the bed. They pricked Pan's toe with a prepared needle, and he raised his foot. I stabbed him again, and he lifted it again. Still not awake.

Sun Jihai exulted. He didn't respond to how he stabbed him at ordinary times, but he did when he slept, indicating that he was pretending at ordinary times and deliberately endured it.

Sun Jihai pricked his foot, which he usually pretended not to move, and woke him up.

"Pan Changsong!" Sun Jihai drink a way.

"Well ... here! Captain! " A glib tongue, not Lickitung. "You sit up."

Pan Changsong quickly sat up. In this way, Sun Jihai and the two of them know fairly well.

"Can you move this leg? Huh? "

Pan looked at the pin in Sun Jihai's hand and seemed to understand something. He bowed his head and said nothing.

"You're crazy! You pee in the house. Isn't that a boycott of reform, bitch? "

Pan Changsong cried with a "wow": "Captain, I am wronged."

"What have you wronged?"

"I am so wronged."

"What's your grievance? Tell me. "

"I'm not guilty, sentence me to fifteen years ..."

"What are you doing in prison without sin? You are dishonest! You are a paraplegic. You've been pretending for months. In the hospital, the dean gave you an injection, but you didn't move. You pretend to like it! Why are you pretending to be sick? Explain it well! "

The smell in the room was so bad that Sun Jihai told him to get up and take charge of the classroom, but he didn't walk for months and his legs didn't work. Sun Jihai called two prisoners and asked him to go upstairs to take charge of the classroom.

"What can you tell the captain? You must trust the government. "

Pan Changsong was at his wit's end and had to confess. He pretended to be ill, for one thing, he felt wronged, and for another, he didn't want to go down to dig coal.

His case is this: he and another person in the same village illegally cut down two poplars on the roadside, stole 50 kilograms of wheat, stole someone else's floor car, and loaded the trees and wheat back in the car. Another man saw it on the road and asked them what they wanted. They said to go home, and the man helped push the cart. After the incident, it happened to catch up with the national "strike hard", so it was designated as a theft gang, hell to pay. He was a first-time offender and was sentenced to 15 years imprisonment. His partner was sentenced to five years in prison, and the person who helped the cart was sentenced to three years in prison.

Almost all the prisoners are talking about his crimes, and they all think that they have been given a heavy sentence. If Pan's situation is really what he said, it should be a misdemeanor and a heavy sentence. Later, Sun Jihai carefully read his verdict, and the situation was basically true. According to the criminal law and the Supreme People's Court's judicial interpretation, according to the situation of this case, there are not many things, and he is a first-time offender. The maximum sentence is five years in prison, and the accomplice is three years and two years. The man who doesn't understand the situation and blindly helps should not be sentenced at all.

Before Pan came to Lunan Prison, he heard that it was a coal mine prison. When he gets here, he must go down into the well. Pretend to be paralyzed, epileptic and unable to move if you don't want to come. The original prison didn't want to leave a paralytic, so it was said that the list had been made, and if it couldn't move, it had to leave.

After Sun Jihai talked to him, he admitted his guilt, but it was not enough to sentence him to fifteen years. Sun Jihai knew that he had little education, was almost illiterate and didn't know the law. I asked him, "How do you know you haven't been sentenced to fifteen years?"

"Listen to other prisoners."

"Then who taught you to pretend to be sick and crazy?"

"My sentence is only five or six years. I think I have been epileptic for two years. When the captain fails, he will be released on bail. "

"Your sentence is fifteen years, how can you be released so quickly? You really don't understand the law. "

Sun Jihai told him that if he thought his case had grievances, he could write a complaint report. He said he couldn't write, so Sun Jihai asked Xu Qingxiang to write for him. After the complaint report was written, Sun Jihai sent it to the court of first instance. I sent several letters in succession, but there has been no news.

During this period, Pan felt that the captain was very concerned about him and his performance was very positive. Standing in a small post, guarding the door in the team, very serious. Anyone who wants to violate the discipline can't. He doesn't eat hard or soft. He listens to the captain and reports to him if something happens. Sun Jihai is also very concerned about his complaints. After studying with several leaders in the team, I decided to write to the court in the name of the brigade.

Sun Jihai used his evening break to study Pan's verdict and his file carefully. According to the criminal law and the judicial interpretation of the Supreme People's Court, as well as the relevant policies and sentencing standards at that time, I wrote him a review application letter, which was reviewed by the prison management department and the reconnaissance department, stamped with the official seal of the prison, read by the people of the procuratorate and sent directly to the president of Linyi Intermediate People's Court.

A month later, Linyi Intermediate People's Court sent a letter: After the dean checked, he found that the original judgment was different and sent it back to Changshan County Court for retrial. Changshan County Court retried and changed the sentence, and Pan's original sentence was changed from fifteen years to five years; The original sentence of five years was changed to three years; The original sentence of three years was changed to exemption from criminal punishment. The latter two have actually been released from prison, and the significance of changing the sentence is only to give them a new conclusion. There was no compensation law at that time, so they didn't get any compensation.

On the day when the court came to the prison to pronounce the sentence, Pan was so excited that he burst into tears after listening to the verdict read by the judge. He ran into the house and kowtowed to Sun Jihai: "Thank you, Captain Sun, and thank you for the government! I will sit in prison for ten years at once! "

At that time, he had served five years in prison and was released after changing his sentence.

The case had a strong response among the prisoners, and even the prisoners of other brigades were shouting: Captain Sun of the Second Team, that one knows the law very well! Prisoners from other teams often meet Sun Jihai on the road and take the initiative to bow to him: Captain Sun, I am from Team X, and my case is also wrong. Can you write something for me?

Sun Jihai said: I can't manage your case, I can only manage my team. You go to your captain.

The reason why he answered like this is that, firstly, he doesn't know the prisoners from other teams, and he doesn't know the reason. Second, his energy is limited, and more than 90 prisoners in his team/kloc-0 are enough for him to be busy; Third, I am afraid of affecting the relationship with other correctional officers: Do you have the ability? Are you the only one who knows the law? Are you the only one? Why do you work so hard for the prisoners?

Writing a complaint report to the prisoners in the team is within his scope of work, which is decided by the collective research of the team leaders, and no one can say anything. Beyond the scope, some things are unclear.

Sun Jihai, in the spirit of being responsible for the law, the country and the prisoners, from 1987 to 1990, a certain * * wrote a letter of appeal review for 23 prisoners in his brigade, of which 3 did not reply and 7 did, but for various reasons, the sentence was not changed. 13. Among them, a prisoner named Wang Changqun in Artest was sentenced to five years instead of twenty years.

Wang Changqun, nicknamed Wang San, has been in and out of the juvenile detention center since he was a teenager. He is very famous in Taian. Everyone knows Wang San, and some people use him to scare children. When Wang San came, the children were too scared to cry. As a result, he was unlucky in popularity.

1983 One day, a robbery happened in a market in Tai 'an, which made people panic. The robbers then met another group of enemies and the two sides fought. The scene was in chaos, and no one outside knew who was with whom. Then someone shouted: Wang San is coming, run! The two groups broke up with a bang.

It is said that the man who was robbed at that time was mentally ill. When he was frightened, his mental illness recurred, which was a serious problem. The public security bureau filed an investigation, looked for witnesses everywhere and asked who robbed them. They all said they didn't know, and they all said they heard someone calling Wang San. So the investigator put the case on Wang Santou.

After Wang San was arrested, I asked him where you were when there was a robbery and gang fight that day. He said I knew about the fight and heard that there were robbers, but I wasn't there. Of course, the investigators didn't listen to him, saying that you should not be dishonest. He always refused to admit his debts. When he got angry, he said to the case handler, What are you? Wearing a big hat, he looks decent and knows nothing about the law! Despise investigators and despise the law. Isn't that a cannon bump? At that time, it was a "strike hard" period, and the key targets were people who endangered social order like him. They took it upon themselves to formally arrest him.

During the trial, he never admitted that he was involved in the robbery, but voluntarily confessed that he had been in love with a young woman and had sex. So there are two charges in his sentence: robbery and rape-molesting and raping young women on the pretext of falling in love. He was sentenced to 17 years for robbery and 3 years for rape, with 20 years combined.

After Wang Changqun entered the prison, he never obeyed the reform and his performance was very bad. He is strong and doesn't pretend to be ill, but he doesn't work well. He writes a complaint every day, and it is said that there are hundreds of letters, which are sent everywhere by the High Court of the Intermediate People's Court, and there has been no reply. When you are in a bad mood, you beat and scold prisoners and threaten correctional officers. No team can manage it and no one wants it. Later, they got the second brigade in Sun Jihai.

Sun Jihai talked to him: "If you have something to tell the captain, you can't resist the reform and undermine the prison discipline. If you hit someone, you will get an extra sentence. "

He said: "Twenty years, how to increase? Or the death penalty or something? Twenty years, no hope. It doesn't matter if I'm guilty. I am not guilty. "

Sun Jihai said, "If you think the verdict is wrong, you can continue to complain. This is your right. "

He said, "What's the use of appealing? I see through it. People like me make no sense! "

Before long, he violated the prison regulations again. Watching TV that night, a tall prisoner blocked him in front. He didn't say anything. He took a stool and hit him on the head, knocking him down at once.

The other prisoners were frightened: "report to the captain, kill someone!" " "Wang San killed XX!"

Fortunately, the prisoner was unconscious and did not die. But Wang Changqun went beyond the national laws and regulations, which is not bad!

Sun Jihai gave him a detention order, and before announcing it, he said, "I'll go to the detention room." He belongs to the kind of person who is said to have "courage" in the Jianghu.

Usually prisoners eat well, but in the brig, they are rationed. There are rations for work and rations for non-work. Wang Changqun is strong and eats a lot. He didn't have enough to eat in the brig. After three days, he couldn't stand it. He said to Sun Jihai, "Captain, I won't fight."

After coming out of the brig, he sincerely said to Sun Jihai, "Captain, please worry about my business. My previous letters were written in vain. "

Sun Jihai said, "If others don't do it for you, I will do it for you?"

As far as Sun Jihai knows, for the sake of Wang Changqun, people from the prison administration have been to Tai 'an Intermediate People's Court. Somehow it didn't work. Presumably this case is more complicated and more difficult.

But Sun Jihai decided to give it a try. He used his evening break to carefully check Wang Changqun's file and found that the verdict was full of loopholes. First of all, Wang Changqun was under the age of 18 at the time of the crime. If the case is true, it should also be given a lighter punishment according to regulations; Second, there were witnesses to the robbery, but who robbed it? I don't know. People don't know those people. Third, robbery leads to the recurrence of mental illness of the parties. Where is this man? What's his name? It's not in the verdict. Fourth, the crime of rape is based on Wang Changqun's own confession, and there is no proof from young women or any third party.
