Whoever intentionally harms another person's body shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Those who cause serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Whoever negligently injures others and causes serious injuries shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. Basic compensation items include:

2. If the victim is disabled due to injury, the necessary expenses incurred due to the increase of daily needs and the income loss caused by the loss of working ability include disability compensation, disability assistive devices, living expenses of dependents, and the necessary rehabilitation expenses, nursing expenses and follow-up treatment expenses actually incurred due to rehabilitation nursing and continuing treatment.

3. If the victim dies, the compensation obligor shall compensate other reasonable expenses such as funeral expenses, living expenses of dependents, death compensation, funeral expenses of the victim's relatives, accommodation expenses, lost time and so on, in addition to the relevant expenses stipulated in Article 1 for rescue treatment.

4. If the victim or a close relative of the deceased suffers mental damage and the obligee requests the people's court for compensation, it shall be determined according to the Interpretation of the Supreme People's Court on Several Issues Concerning Determining the Liability for Compensation for Mental Damage in Civil Tort. But if it constitutes a criminal offence, there is no compensation for mental damage.
