Measures of Shandong Province on Labor Protection in Hot Weather
State organs, institutions and social organizations arrange for workers who have established labor relations with them to carry out outdoor operations in hot weather, with reference to these measures. Article 3 The term "hot weather" as mentioned in these Measures refers to the weather in which the daily maximum temperature is above 35℃ issued by the meteorological offices and stations affiliated to the competent meteorological departments at or above the county level. Fourth people's governments at all levels should strengthen the leadership of labor protection in hot weather.
The departments of human resources and social security, health, supervision and management of production safety, economy and informatization, housing and urban construction, water conservancy, transportation, ocean and fishery shall, according to their respective functions and duties, guide, supervise and inspect the work of labor protection in hot weather.
Electric power, metallurgy, postal services, gas and other industries, according to the characteristics of their respective industries, do a good job in high temperature weather labor protection in their own industries.
Trade unions shall supervise the labor protection measures of employers during high temperature weather according to law. Fifth people's governments at or above the county level shall establish an early warning and forecasting system for high temperature weather and establish and improve the early warning information release system for meteorological disasters. After the meteorological offices and stations subordinate to the competent meteorological departments issue high-temperature warning signals, radio, television, newspapers, telecommunications and other media shall disseminate them to the public in time. Article 6 The employing unit shall establish and improve the heatstroke prevention and cooling system and implement relevant measures to ensure the health and life safety of workers. Article 7 During the following hot weather, the employing unit shall reasonably arrange working hours, reduce labor intensity, and take effective measures to ensure the health and life safety of workers:
(1) If the daily maximum temperature reaches above 40℃, the work shall be stopped on that day;
(2) When the daily maximum temperature reaches 37℃ to 40℃, the outdoor operation time shall not exceed 5 hours, and the outdoor operation shall be suspended from1to 16;
(3) If the daily maximum temperature reaches above 35℃ and below 37℃, the employer shall take a rest in shifts, shorten the continuous operation time, and shall not arrange outdoor workers to work overtime.
The provisions of the preceding paragraph shall not apply if the employer takes air conditioning and other measures to reduce the temperature of the workplace to below 33℃, or because of production, personal and property safety and public interests, etc., and because of the characteristics of the industry, it cannot stop working or needs emergency treatment. Article 8 The employing unit shall not force laborers to work in hot weather.
The employing unit shall not deduct the wages of workers because the high temperature causes them to stop working and shorten their working hours. Article 9 The employing unit shall pay the summer heatstroke prevention and cooling expenses to the workers, and the required expenses shall be included in the cost.
The standard of heatstroke prevention and cooling fees shall be formulated by the Provincial Department of Human Resources and Social Security in conjunction with relevant departments, and adjusted in a timely manner according to the social and economic development. Article 10 The employing unit shall, in accordance with the regulations, provide enough cool drinks and salty drinks that meet the hygiene standards to the workers who work or operate outdoors in hot weather; The cool drinks provided cannot cover the cost of heatstroke prevention and cooling. Article 11 The employing unit shall ensure the safety of the production environment during hot weather, provide necessary labor protection facilities and personal protective articles for workers, and strengthen the maintenance of labor protection facilities and the management of articles. Article 12 The employing unit shall, in accordance with the relevant provisions of the state, rationally arrange the production sites, improve the production technology and operation flow, and adopt good heat insulation, ventilation and cooling facilities to ensure that the production sites meet the national standards. Article 13 The employing unit shall carry out occupational health examination on the workers engaged in high-temperature operations and open-air operations during high-temperature weather, and establish or record them in the workers' health files. Workers suffering from heart, lung, vascular diseases, persistent hypertension, diabetes, tuberculosis, central nervous system diseases and other physical conditions not suitable for high temperature environment, as well as pregnant, breastfeeding, older and in poor health, should adjust their workplaces or posts during high temperature weather; If it is really impossible to adjust due to work needs, protective measures should be strengthened to prevent heatstroke and other diseases in high temperature weather. Article 14 The employing unit shall publicize and educate the workers on heatstroke prevention and first aid, and enhance their awareness of self-labor protection when working in hot weather. Article 15 The employing unit shall improve the food hygiene conditions of workers during high temperature weather to prevent diseases from spreading in summer. Article 16 The employing unit shall set up a rest place in a high-temperature working environment, equipped with seats, good ventilation or air conditioning and other heatstroke prevention and cooling facilities. Article 17 The employing unit shall, according to the number of workers and the working conditions in hot weather, set up emergency rescue places for heatstroke or provide heatstroke rescue personnel. Article 18 If a worker suffers from heatstroke while working in hot weather, the employing unit shall arrange for the worker to stop working and treat him immediately; When severe heatstroke occurs, the employing unit shall take effective measures to organize rescue in time to reduce casualties and report to the local competent department in accordance with relevant state regulations. Those who are recognized as work-related injuries shall enjoy work-related injury insurance benefits according to law.
