Provisions of Hebei Province on the Administration of Weather Modification

Chapter I General Provisions Article 1 In order to strengthen the management of weather modification work, prevent and mitigate meteorological disasters, and ensure the safety of people's lives and property, these Provisions are formulated in accordance with the Regulations of the State Council on the Administration of Weather Modification and combined with the actual situation of this province. Article 2 The term "weather modification" as mentioned in these Provisions refers to the activities that, in order to avoid or mitigate meteorological disasters and make rational use of climatic resources, artificially affect the physical and chemical processes of local atmosphere under appropriate conditions through scientific and technological means to achieve the purposes of increasing rain and snow, hail suppression, rain elimination, fog elimination and frost prevention. Article 3 These Provisions shall be observed in engaging in and managing weather modification activities within the administrative area of this province. Article 4 The competent meteorological departments at or above the county (city, district) level shall be responsible for the organization, implementation, guidance and management of weather modification work under the leadership of the people's government at the same level.

Development and reform, finance, public security, transportation, flight control, communications and other departments and relevant military organs shall, in accordance with their respective responsibilities, do a good job in weather modification. Article 5 The people's governments at or above the county level shall strengthen their leadership over weather modification, establish and improve the mechanism of command, coordination and linkage, carry out weather modification in an organized and planned way, and improve the efficiency of weather modification. Article 6 The competent meteorological departments at all levels shall strengthen the scientific and technological research on weather modification and the development and application of new technologies, improve the scientific and technological level of weather modification and expand the application fields of weather modification. Seventh weather modification work carried out in accordance with the weather modification work plan approved by the relevant people's government belongs to public welfare undertakings, and the required funds are included in the financial budget of the people's government at the corresponding level.

Other weather modification activities shall be undertaken by users. Article 8 The people's governments at or above the county level shall commend and reward the units and individuals that have made outstanding contributions in weather modification. Chapter II Organization and Implementation Article 9 Provincial competent meteorological departments shall, according to the needs of disaster prevention and mitigation, ecological environment construction and the development and utilization of climate resources in this province, consult the relevant departments at the same level to prepare the weather modification work plans and plans of the whole province, and submit them to the provincial people's government for approval before implementation.

The competent meteorological departments of cities and counties (cities, districts) divided into districts shall, according to the plans and plans of weather modification work at higher levels and in combination with local conditions, consult the relevant departments at the same level to formulate plans and plans of weather modification work in their respective administrative areas, and report them to the people's government at the same level for approval before implementation. Tenth competent meteorological departments at all levels shall establish weather modification command system, communication system and weather monitoring and early warning system. Eleventh units engaged in weather modification operations shall meet the following conditions and apply to the provincial meteorological authorities:

(1) Having the qualification of a legal person;

(2) Having the infrastructure and equipment required to carry out weather modification operations in compliance with relevant safety regulations;

(three) there are personnel who meet the prescribed number and have obtained the qualifications for weather modification operations;

(4) Having a sound system of safety management and equipment maintenance, transportation, storage and safekeeping;

(five) communication tools to keep in touch with the weather modification operation command center and the flight control department.

The competent meteorological department of the province shall conduct an audit within 0/5 working days from the date of accepting the application, and issue the qualification certificate of the weather modification operation unit if it meets the conditions. Do not meet the conditions, explain the reasons in writing. Twelfth personnel engaged in weather modification operations, shall meet the following conditions, and apply to the provincial competent meteorological departments, after passing the training and examination, issued by the weather modification operation personnel qualification certificate:

(1) 18 is under 60 years old and has full capacity for civil conduct;

(2) Being in good health;

(3) Having a junior high school education or above;

(4) Having not received criminal punishment.

The list of personnel engaged in weather modification by using anti-aircraft guns and rocket launchers shall be copied by the local competent meteorological department to the local public security organ for the record. Thirteenth weather modification operation unit qualification certificate is valid for 3 years. After the expiration of the validity period, units that need to continue to engage in weather modification activities shall submit an application for extension to the provincial meteorological authorities 30 days before the expiration of the validity period. Fourteenth units and personnel who apply for the qualification of weather modification operations may also apply to the local competent meteorological department, which will send the application materials to the provincial competent meteorological department. Article 15 The competent meteorological departments of cities and counties (cities, districts) divided into districts shall, according to the local climatic characteristics and geographical conditions, put forward opinions on setting up ground operation stations (points) for weather modification such as anti-aircraft guns and rockets, and submit them to the competent meteorological department of the province for examination and determination jointly with the flight control department.

The determined operation station (point) shall not be changed at will. If it is really necessary to change, it shall be re-determined in accordance with the provisions of the preceding paragraph. Sixteenth the implementation of weather modification operations, shall meet the following conditions:

(1) Having weather conditions suitable for operation;

(2) Operating airspace and operating time limit approved by the flight control department;

(3) The operation equipment has good performance and meets the use requirements;

(4) All operators are in place;

(5) Communication with the command center and the flight control department.
