Regulations of Hebi Municipality on Qihe River Protection

Chapter I General Provisions Article 1 In order to protect the ecological environment of Qihe River, promote the construction of ecological civilization, and promote high-quality economic and social development, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and utilization of Qihe River in this Municipality.

Qihe area as mentioned in these Regulations includes protected management areas and planning control areas. Protection and management area refers to the area within the administrative area of this Municipality within the main stream of Qihe River and the green line on both sides, and the planning control area refers to a certain area outside the main stream of Qihe River and the green line on both sides within the administrative area of this Municipality.

The specific scope of Qihe area shall be delineated by the Municipal People's Government and announced to the public. Article 3 Qihe River protection follows the principles of planning guidance, protection priority, territorial management and comprehensive management. Article 4 The Municipal People's Government shall strengthen the organization and leadership of Qihe River protection, establish a working mechanism, and coordinate the protection and management of Qihe River within the administrative area of this Municipality.

County (District) people's governments shall strengthen the protection and management of Qihe River within their respective administrative areas. Article 5 The water administrative department of the Municipal People's Government shall be responsible for the supervision and management of Qihe River.

The competent department of natural resources and planning of the Municipal People's Government is responsible for the management of land and space planning in Qihe area.

The competent department of ecological environment shall implement unified supervision and management of environmental protection work in Qihe area.

The competent departments of agriculture, rural areas, forestry, urban management, cultural tourism, housing and urban construction of the Municipal People's Government shall do a good job in the protection and management of Qihe River within the scope of their duties. Article 6 The people's governments of cities and counties (districts) shall incorporate the protection of Qihe River into the national economic and social development plan.

City and county (District) people's governments shall set up special funds for the protection of Qihe River, which shall be included in the fiscal budget. Eighth city and county (District) people's government departments should carry out publicity and education activities of Qihe River protection. Radio and television, newspapers, internet and other news media should strengthen publicity and report, and create an atmosphere for the whole society to protect Qihe River. Ninth any unit or individual has the right to report and complain about the destruction of Qihe ecological environment and infrastructure.

The relevant competent departments shall announce the channels for reporting complaints, and handle the feedback in time after receiving the information of reporting complaints. Chapter II Planning and Construction Article 10 The comprehensive planning of Qihe River is an important basis for the planning, construction, protection and management of Qihe area. The Municipal People's Government shall organize the preparation of the comprehensive planning of Qihe River and announce it to the public. Eleventh Qihe comprehensive planning should be coordinated with the national economic and social development planning, land and space planning, taking into account the needs of various regions and industries. Article 12 The relevant departments of the Municipal People's Government and the county (District) people's government shall, according to the comprehensive planning of Qihe River, prepare professional plans for Qihe River's surface water drinking water source, wetland park, ecological restoration, aquatic germplasm resources protection, spring area protection, historical and cultural heritage protection and industrial development. Implement according to law, and organize the implementation after being approved according to law. Thirteenth Qihe comprehensive planning and professional planning approved according to law shall not be modified without authorization, and if it is really necessary to modify it, it shall be carried out in accordance with legal procedures. Article 14 The construction activities in Qihe Protection and Management Zone shall conform to the comprehensive planning and professional planning of Qihe River. Existing buildings (structures) and other facilities that do not meet the planning requirements should be transformed according to law; If it still does not meet the requirements after the transformation, it shall be moved out or removed according to law.

For the construction projects approved in accordance with the law in the Qihe River planning control area, the construction and construction units shall formulate plans for environmental protection and soil and water conservation during the construction period to protect the surrounding water bodies, wetlands, forest and grass vegetation, wildlife resources and topography. , and restore to its original state in time after the completion of the project. Chapter III Management and Regulation Article 15 Encourage and support the following acts to protect Qihe River:

Voluntary afforestation;

(2) Pick up garbage and purify the environment;

(3) Protecting historical sites and taking good care of cultural relics;

(4) Take care of public facilities such as guardrails and signs;

(5) Donating and accepting donated funds and articles;

(six) other voluntary services and social welfare behaviors that are conducive to the protection of Qihe River. Sixteenth in Qihe area, no unit or individual shall have the following acts:

(1) Fishing during the closed fishing period;

(two) damage to flowers and plants, picking flowers and fruits such as Sophora japonica, catkin and elm;

(3) picnicking, barbecuing or swimming in non-designated areas;

(four) littering, scraps of paper, chewing gum, packaging and other wastes;

(five) cleaning vehicles and clothes in Qihe waters;

(six) other acts that are not conducive to the protection of Qihe River. Seventeenth the following acts are prohibited in Qihe protection and management area:

(1) Dumping, stacking, burying and burning domestic garbage, construction garbage, industrial solid waste and medical waste;

(two) in addition to the approved Qihe silk wrapped duck egg culture, the construction of livestock and poultry farms, breeding areas and excavation of fish ponds;

(3) Quarrying and sand mining;

(four) damage to water conservancy, hydrological monitoring and other infrastructure;

(five) illegal hunting of wild animals, destruction of wildlife breeding areas and habitats;

(six) illegal felling of trees and collection of wild plants;

(7) Reclamation and grazing;

(eight) other acts that affect the ecological environment.
