Regulations of Chongqing Municipality on Meteorological Disaster Prevention (revised in 2005)
Meteorological-derived disasters as mentioned in these Regulations refer to landslides, mudslides, forest fires, urban fires, acid rain, air pollution and other disasters caused by the above meteorological reasons.
Meteorological disaster prevention as mentioned in these Regulations refers to the monitoring, forecasting, disaster prevention and mitigation activities of meteorological disasters and meteorological derived disasters. Article 3 These Regulations shall apply to meteorological disaster prevention activities within the administrative area of this Municipality. Article 4 The people's governments of cities, districts and counties (autonomous counties and cities) shall strengthen their leadership over the prevention of meteorological disasters, incorporate the prevention of meteorological disasters into the national economic and social development plan at the same level, and include the required special funds into the fiscal budget at the same level. Article 5 The competent meteorological departments of cities, districts and counties (autonomous counties and cities) shall be responsible for the monitoring and forecasting of disastrous weather, the assessment of meteorological disasters, investigation and verification, the assessment of climate and environment, weather modification and lightning disaster prevention. Assist relevant departments in monitoring, forecasting and reducing meteorological derived disasters.
City and county (autonomous county, city) agriculture, water conservancy, environmental protection, geology, forestry, fire protection, planning, communications, transportation and other relevant departments shall do a good job in meteorological disaster prevention in accordance with the division of responsibilities. Article 6 All units and individuals have the obligation to participate in meteorological disaster prevention according to law. Chapter II Defense Planning and Facilities Construction Article 7 The people's governments of cities, districts and counties (autonomous counties and cities) shall organize the competent meteorological departments at the same level and other relevant departments to formulate meteorological disaster prevention plans within their respective jurisdictions.
Meteorological disaster prevention planning should include meteorological disasters and meteorological derivative disasters prone areas, climate and meteorological disaster trend analysis and prediction, defense objectives and tasks, monitoring station construction, early warning and defense system and facilities construction, disaster prevention and mitigation plans and measures, and responsibilities of relevant departments. Article 8 The competent meteorological departments of cities, districts and counties (autonomous counties and cities) shall, according to the meteorological disaster prevention plan, formulate plans for the construction of meteorological disaster early warning and prevention systems such as meteorological disaster information analysis and processing system, meteorological disaster forecast and release system, early warning marking facilities, weather modification system and lightning disaster prevention system, and implement them after being reported to the Municipal People's Government for approval. Article 9 The municipal competent meteorological department shall, according to the needs of meteorological disaster prevention, jointly with the relevant competent departments of the Municipal People's Government and the people's governments of relevant districts and counties (autonomous counties, cities), work out the construction plan of the city's meteorological detection facilities, meteorological special transmission facilities, large-scale meteorological special technical equipment and other important meteorological facilities, and report it to the Municipal People's Government for approval before implementation; In accordance with the law, it should be approved by the State Council, and then reported to the State Council for approval after being approved by the Municipal People's Government. Tenth meteorological disaster prevention system construction planning and meteorological facilities construction planning adjustment, modification, must be submitted to the original approval authority for approval. Eleventh meteorological offices and stations subordinate to the competent meteorological departments shall establish and improve the meteorological disaster monitoring and early warning system; Establish and improve meteorological radar, meteorological satellite integrated processing system, automatic meteorological detection, lightning location, meteorological information transmission network and other meteorological disaster monitoring facilities. Twelfth radio management departments should arrange special channels and channels for meteorological radio to ensure the transmission of meteorological disaster information. Chapter III Monitoring and Forecasting Article 13 The municipal competent meteorological department shall organize joint monitoring of disastrous weather and meteorological disasters, and establish a cross-regional and cross-departmental joint monitoring network according to the needs of preventing meteorological disasters. Fourteenth members of the joint monitoring network are proposed by the municipal competent meteorological department and reported to the Municipal People's government for approval.
The members of the joint monitoring network include meteorological offices and stations belonging to the competent meteorological departments of cities and counties (autonomous counties and cities), as well as other relevant departments and units and their subordinate meteorological offices and observation (supervision) observation stations. Fifteenth members of the joint monitoring network shall provide timely and accurate meteorological information, rain, water and disaster information needed for meteorological disaster monitoring and forecasting to the municipal competent meteorological department. Article 16 Meteorological offices and stations subordinate to the competent meteorological departments shall strengthen scientific research on the occurrence and development of meteorological disasters, and improve the analysis and prediction ability and prediction accuracy of meteorological disasters. Article 17 The competent meteorological departments shall cooperate with the relevant departments to carry out meteorological monitoring and early warning on meteorological derivative disasters such as landslides, mudslides, forest fires, urban fires, acid rain and air pollution caused by meteorological reasons, and assist in the comprehensive prevention and control of meteorological derivative disasters. Eighteenth meteorological stations at all levels to monitor the disastrous weather and meteorological disasters have occurred or may occur, it shall immediately report to the competent meteorological departments at the same level.
The competent meteorological department shall, after summarizing and analyzing the meteorological disaster information submitted by meteorological stations, report to the people's government at the corresponding level and the competent department at a higher level in a timely manner; For the sudden meteorological disaster information that can not be fully understood at the moment, it should be reported and verified, and the follow-up situation should be reported in a timely manner according to the progress of the work, without delay or concealment. Nineteenth severe meteorological warning issued by the meteorological stations subordinate to the municipal competent meteorological department in accordance with the division of responsibilities; The forecast of meteorological derived disasters shall be uniformly released to the public by the relevant units and competent meteorological departments; No other organization or individual may announce it to the public in any form. Unless otherwise stipulated by the state, such provisions shall prevail.
