Measures of Zhejiang Province on Implementing the Meteorological Law of People's Republic of China (PRC)

Article 1 In order to strengthen and standardize meteorological management, prevent and mitigate meteorological disasters, rationally develop and protect climate resources, and promote the development of meteorological undertakings, these Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) (hereinafter referred to as the Meteorological Law) and combined with the actual situation of this province. Article 2 Activities such as meteorological observation, forecasting, service, meteorological information dissemination, disaster prevention, scientific research and the development and utilization of climate resources within the administrative region of this province and the sea areas under its jurisdiction shall abide by the Meteorological Law and these Measures. Article 3 The people's governments at or above the county level shall strengthen their leadership over meteorological work, incorporate local meteorological undertakings into the national economic and social development plan and the financial budget of the government at the corresponding level, gradually increase investment in local meteorological undertakings, and give full play to the functions of meteorological work in serving the public, government decision-making and economic development. Article 4 People's governments at or above the county level shall, according to the needs of social and economic development, invest in the construction of meteorological projects such as meteorological monitoring and forecasting, information processing, early warning and joint defense, lightning monitoring and defense, and weather modification business systems, with funds mainly arranged by the finance at the corresponding level. Fifth competent meteorological departments at or above the county level shall be responsible for meteorological work within their respective administrative areas.

The administrative departments of planning, construction, public security, land and resources, environmental protection, technical supervision, posts and telecommunications, information industry, radio and television at all levels shall, within the scope of their respective duties, cooperate with the competent meteorological departments to do a good job in meteorological work. Article 6 The competent meteorological departments at or above the county level and their subordinate meteorological offices and stations shall perform the following duties:

(a) according to the protection of meteorological facilities and detection environment;

(two) to provide meteorological services for meteorological disaster prevention, comprehensive agricultural development, comprehensive marine development, climate resources development, ecological environmental protection, key project construction, etc.;

(three) the development and popularization of scientific and technological achievements such as meteorological disaster prevention technology and meteorological practical technology;

(four) to carry out meteorological science and technology cooperation and exchanges, and develop meteorological science and technology information industry;

(five) other duties as prescribed by laws, regulations and rules. Seventh engaged in meteorological business activities, shall abide by the national and provincial meteorological technical standards, norms and procedures.

The meteorological business activities of the meteorological offices and stations under the relevant departments of the people's governments at or above the county level shall be subject to the guidance, supervision and industry management of the competent meteorological departments at the same level.

Any organization or individual engaged in meteorological activities within the administrative region of this province and the sea areas under the jurisdiction of this province must report to the competent meteorological departments at or above the county level for the record. Eighth the following meteorological facilities construction projects shall be approved by the competent meteorological departments at or above the provincial level before the project proposal and feasibility study report are submitted for approval:

(a) in accordance with the provisions of the national or provincial project examination and approval authority shall be submitted to the provincial examination and approval;

(3) Provincial distribution projects such as meteorological observation, communication, early warning, joint defense and service;

(four) other projects stipulated by the state and the province. Article 9 It is forbidden to damage, occupy or move meteorological exploration sites, instruments and equipment, communication lines and other facilities without authorization, and interfere with special channels and channels for meteorological services.

When meteorological facilities are damaged due to force majeure, the local people's government shall take emergency measures to repair them. Article 10 If it is really necessary to relocate meteorological stations or other facilities due to the construction of key projects and the implementation of urban planning, the construction unit shall report to the competent meteorological department of the State Council or the competent meteorological department of the province for approval, and bear all the relocation expenses.

When the meteorological station is moved, the meteorological observation time of the old and new stations shall not be less than one year. During the comparative observation period, the construction unit shall not start construction. Eleventh people's governments at all levels shall, in accordance with the statutory standards, stipulate the scope of environmental protection for meteorological observation, and incorporate it into the overall land use planning and urban and rural planning; Existing testing sites that do not meet the prescribed standards shall be reformed or rebuilt.

The competent meteorological department shall formulate environmental protection measures for meteorological observation and send a copy to the planning, construction and land and resources departments at the same level. Twelfth construction projects that endanger the meteorological environment, the construction unit shall obtain the consent of the competent meteorological departments at or above the provincial level in advance, and take corresponding measures. No construction shall be carried out without consent or measures.

Where changes in the natural environment such as the growth of trees may adversely affect the meteorological observation environment or facilities, the relevant organizations or individuals have the obligation to take timely protective measures in accordance with the requirements of the competent meteorological department. Thirteenth public meteorological forecast and severe weather warning, by the meteorological stations subordinate to the competent meteorological departments at all levels in accordance with the responsibilities of unified production and release.

Other organizations and individuals are prohibited from publicly releasing public meteorological forecasts and severe weather warnings to the public. Fourteenth radio stations, television stations and newspapers designated by the government at all levels shall arrange special time or pages to broadcast and publish public weather forecasts or severe weather warnings every day.

Video, audio, Internet and other media to disseminate public weather forecasts or severe weather warnings shall be filed with the local meteorological authorities. Fifteenth public media dissemination of meteorological forecasts and severe weather warnings, must use the timely meteorological information directly provided by the meteorological offices and stations affiliated to the competent meteorological departments, and indicate the release station and release time; If it needs to be supplemented or modified, it should be supplemented or inserted in time. The income obtained through the dissemination of meteorological information shall be extracted in accordance with the proportion stipulated by the state or province for the development of meteorological undertakings.

Public media shall not broadcast or copy weather forecasts or severe weather warnings to each other. It is forbidden to publicly report meteorological information used for government internal decision-making.
