Is it legal to charge a service charge for bringing your own wine?

It is illegal for a hotel to charge a service fee for bringing your own alcohol.

“The prohibition of bringing your own drinks, setting minimum consumption in private rooms, charging service fees, etc. are all overlord clauses in the catering industry and a kind of industry monopoly.”

Legal basis:

Article 26, Paragraph 2 and Paragraph 3 of the "Consumer Rights and Interests Protection Law" stipulates: Operators shall not exclude or restrict consumers' rights or mitigate consumer rights through standard clauses, notices, statements, store notices, etc. Or exempt operators from liability, increase consumer liability, and other unfair and unreasonable regulations on consumers. Standard clauses and technical means may not be used to force transactions. If the format terms, notices, statements, store notices, etc. contain the contents listed in the preceding paragraph, their contents are invalid.

Catering operators take advantage of their advantageous position to make unfair and unreasonable regulations that increase consumers' responsibilities. This is an overbearing clause. Consumers can negotiate and settle with the store first. If settlement fails, they can contact the Consumers Association or call the Consumers Association. Complain to the 12315 hotline, or file a lawsuit directly with the court, requesting the court to confirm that the "overlord clause" is invalid.
