Regulations of Sanya Municipality on the Management of River Ecological Protection

Chapter I General Provisions Article 1 In order to strengthen the management of river ecological protection, improve the quality of water environment, restore the ecological function of water bodies, give full play to the comprehensive benefits of rivers, and create a living environment where man and nature live in harmony, these Regulations are formulated in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) River Management Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, regulation, construction, protection, utilization and related management activities of Sanya River, Ningyuan River and Tengqiao River within the administrative area of this Municipality.

Waterways and ports in river courses shall be implemented in accordance with the relevant laws and regulations on the management of waterways and ports. Third river planning, regulation, construction, protection, utilization and other related management should be included in the overall urban planning of Sanya City.

The specific scope of protection and management of river courses shall be demarcated by the Municipal People's Government according to the ecological protection red line delineated by the overall urban planning of Sanya City and the standards for the management and protection scope of provincial river courses and water projects, combined with the actual situation of this Municipality, and signs and boundary markers shall be set up and announced. Article 4 The municipal and district people's governments shall strengthen the leadership, supervision and inspection of river ecological protection and management, establish a coordination mechanism for river ecological protection and management, and coordinate and solve major problems in river ecological protection and management. Article 5 The management of river ecological protection shall follow the principle of unified management and graded responsibility, and shall combine watershed management with administrative regional management.

The municipal water administrative department is the competent authority of the river in this Municipality, and is responsible for the supervision and management of the river in this Municipality.

The district water administrative department is the competent authority of the river within its administrative area, and is responsible for the supervision and management of the river within its administrative area in accordance with its duties and powers. ?

Other relevant administrative departments of the city and district shall do a good job in river ecological protection and management within their respective responsibilities.

Yucai Ecological Zone Management Committee and farms shall be responsible for the management of river ecological protection within their respective jurisdictions in accordance with the prescribed responsibilities and authorities. Article 7 The municipal and district people's governments shall, in accordance with the principle of government investment and social participation, establish a multi-channel investment and financing mechanism, incorporate the funds needed for river ecological protection and management into the fiscal budget at the same level, strive for all kinds of relevant special funds, encourage social capital investment, and increase financial support for river ecological protection and management.

Encourage and support social forces to participate in river protection and regulation by means of capital contribution, donation, scientific research and environmental protection voluntary action.

The municipal and district people's governments shall commend and reward the units and individuals that have made outstanding contributions in the management of river ecological protection. Eighth any unit or individual has the right to stop and report violations of these regulations. Chapter II Reconstruction and Construction Article 9 The Municipal People's Government shall strengthen the construction of river information and establish a unified river information platform.

The unified platform for river information shall publicize the scope of river protection and management, river planning, implementation of river (river section) responsibility system, monitoring of water environmental quality, specific list of key pollutant discharge units and other information that should be publicized.

Key pollutant discharge units that discharge pollutants into rivers shall regularly disclose their names, discharge methods, discharge concentrations and total amounts, excessive discharge and the construction and operation of pollution prevention and control facilities to the public through the unified platform of river information.

The public has the right to apply to the people's government and its administrative departments for disclosure of information related to river ecological protection according to law. Tenth water administrative departments shall, in accordance with the relevant provisions, formulate annual plans for river regulation, and report them to the district and municipal people's governments for approval before implementation.

The annual plan for river regulation shall specify the regulation targets such as flood control and drainage, pollution interception and control, dredging and waterfront space transformation. And clearly define the name, responsible unit, task division, construction period and financing of the remediation project. Eleventh river regulation projects should be implemented in accordance with the river regulation plan. River planning and regulation shall be formulated by the municipal water administrative department and approved by the Municipal People's government.

River regulation projects include revetment, dike, dredging, sewage interception, widening, bridge demolition and construction, culvert gate setting, management and protection facilities, cross-strait greening, ecological landscape construction and other projects. After the project construction plan is submitted to the water administrative department for examination and approval, the construction unit may go through the examination and approval procedures in accordance with the basic construction procedures. Twelfth river regulation needs to occupy land, it should be handled according to law.

Land within the scope of river protection and management, and newly available land due to dike construction, river regulation and shoreline adjustment shall be given priority for river regulation. Thirteenth river regulation shall meet the requirements of natural ecology, protect the historical features of the river, and shall not change the direction of the river without authorization.

Emergency measures should be given priority to the regulation of rivers that seriously affect flood control safety and environmental landscape.

For rivers with serious water pollution and ecological damage, the municipal and district people's governments shall take timely remediation measures such as pollution control and interception, garbage cleaning, dredging and ecological restoration, increase the intensity of river management, and announce the name of the river, the responsible person, the deadline for reaching the standard and the remediation situation to the public every six months.
