When the lease contract expires, a new lease contract needs to be signed if the tenant continues to live. Not signing a new lease contract and paying the rent on time is a contractual relationship, but it is an open-ended contract. The landlord can terminate the lease at any time. You can generally refund the deposit when you don't live.

According to Article 215th of People's Republic of China (PRC) Contract Law, if the lease term is more than six months, it shall be in written form. If the parties fail to adopt a written form, it shall be regarded as an indefinite lease.

Article 236 Upon expiration of the lease term, if the lessee continues to use the lease item and the lessor does not raise any objection, the original lease contract shall remain valid, but the lease term expires.

1. If a written lease contract is not signed, it will be regarded as an indefinite lease.

2. Both parties to the indefinite lease can terminate the lease relationship at any time, so there is no termination of the contract.

3. After the lease relationship is terminated, you can ask the rental house to refund the deposit. This term is uncertain.

According to the provisions of Article 10 of the Measures for the Administration of Urban Housing Lease, the lease contract shall be terminated upon the expiration of the lease term. If the lessee needs to continue the lease, it shall, with the consent of the lessor, propose to re-sign the lease contract three months before the lease expires. Therefore, if the tenant wants to renew the lease, he must sign the contract in advance. Otherwise, he/she should find a new house as soon as possible, lest there is no place to settle down.

2. After the expiration of the contract, the lessor shall take back the house.

When the contract expires, the original lease contract shall be terminated at the expiration of the lease. If the house lease contract is not re-signed, the lessor has the right to take back the house.
