Chapter V Construction and Management of Environmental Sanitation Facilities in Wuhan City

In the development of new urban areas, the transformation of old cities, new residential areas, industrial areas, tourist attractions, stations, docks, ports, airports, etc., the construction unit shall, in accordance with relevant standards, support the construction of garbage collection and transfer stations, public toilets, water suction points and other environmental sanitation facilities.

Supporting environmental sanitation facilities shall be planned, designed, constructed and put into use at the same time as the construction project. In violation of regulations, if supporting environmental sanitation facilities are not built, it shall be ordered to make up the construction within a time limit, and if the circumstances are serious, a fine of less than twice the construction cost of environmental sanitation facilities may be imposed. Urban management law enforcement departments and relevant functional departments should strengthen the construction of law enforcement teams, implement the responsibility system for law enforcement and the accountability system for administrative faults, standardize supervision and inspection behaviors, and improve the level and efficiency of law enforcement.

Law enforcement officers of urban management and relevant functional departments shall dress in a standard and wear obvious signs when performing official duties, take the initiative to produce administrative law enforcement certificates, abide by administrative law enforcement procedures, and enforce the law fairly and civilly. Urban management law enforcement departments and relevant functional departments shall establish a system of law enforcement and inspection of city appearance and environmental sanitation and a system of complaint acceptance, and timely discover and investigate and deal with violations of the provisions on city appearance and environmental sanitation management.

If a citizen, legal person or other organization accepts a complaint, it shall handle it according to law and reply to the complainant. If a party refuses to accept a specific administrative act made by the urban management administrative department and relevant functional departments, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Administrative Reconsideration Law of People's Republic of China (PRC) or the Administrative Procedure Law of the People's Republic of China.

If a party fails to apply for reconsideration, bring a lawsuit or perform a specific administrative act within the time limit, the administrative department that has made the specific administrative act may enforce it according to law, or apply to the people's court for enforcement. Urban management administrative departments, urban management law enforcement departments and other relevant functional departments and their staff shall strictly perform their duties and shall not harm the legitimate rights and interests of citizens, legal persons or other organizations.

In violation of the provisions of the preceding paragraph, in any of the following circumstances, the unit or the competent department at a higher level or the supervisory organ shall order it to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) failing to perform the duties of urban management, failing to stop or punish illegal acts that should be stopped or punished according to law, and failing to deal with complaints that should be handled according to law;

(two) in violation of the provisions of the charges, fines or do not use a unified fine receipt;

(three) abuse of power, damage the legitimate rights and interests of citizens, legal persons or other organizations;

(4) shielding or conniving at the violator;

(five) the use of authority, corruption and bribery;

(six) other illegal acts as prescribed by laws and regulations. The meanings of the following terms in this Ordinance:

(1) The term "construction waste" as mentioned in these Regulations refers to the waste such as muck, spoil, waste and sludge produced by construction units and individuals in the process of building, laying or dismantling and repairing various buildings, structures and pipe networks.

(II) The term "outdoor advertising" as mentioned in these Regulations refers to the facilities that use buildings, structures, roads, transportation facilities, airships, balloons and other outdoor carriers to introduce goods, services or public welfare content in the form of billboards, neon lights, electronic display screens, electronic fluttering devices, window displays, light boxes, physical models and posting. These Regulations shall come into force as of March 6, 2005. 19951the 12th meeting of the standing Committee of the 9th Wuhan municipal people's congress on October 6th, and the "Wuhan city appearance and environmental sanitation regulations" approved by the 13th meeting of the standing Committee of the 8th Hubei provincial people's congress on March 30th, 995 shall be abolished at the same time.
