Provisions of Yangquan Municipality on Prohibiting Fireworks and Firecrackers

Article 1 In order to strengthen the safety management of fireworks and firecrackers, effectively reduce the impact of fireworks and firecrackers on air quality, effectively protect the safety of the state and the collective public as well as the personal and property safety of citizens, and maintain social order, these Provisions are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 These Provisions shall be implemented by the people's governments at all levels in this Municipality.

The public security department is the competent department that prohibits the discharge of fireworks and firecrackers.

Environmental protection, production safety supervision, industry and commerce administration, transportation, postal management and other departments shall, according to their respective responsibilities, cooperate with the public security department to implement these Provisions. Article 3 It is forbidden to set off fireworks and firecrackers in the urban areas, mining areas, development zones and their entrusted areas in the main urban areas of this Municipality.

Suburbs, Pingding and Yuxian beyond the scope specified in the preceding paragraph may, according to the needs of safeguarding public safety and public interests, designate prohibited or restricted areas.

Before the implementation of these Provisions, the decision made by other counties (districts) in accordance with legal procedures to prohibit discharge in relevant areas shall remain valid. Article 4 During celebrations and other festivals in this Municipality, if it is necessary to hold fireworks parties or other large-scale fireworks display activities in the forbidden areas specified in the preceding paragraph, it shall be decided and announced by the Municipal People's Government. Article 5 The people's governments at all levels (administrative committees), neighborhood offices, residents' committees and villagers' committees, as well as organs, organizations, enterprises, institutions and other organizations in the main city of this Municipality shall carry out publicity and education activities to prohibit the discharge of fireworks and firecrackers.

Primary and secondary schools should educate students not to set off fireworks.

Radio, television, newspapers and other news media should do a good job in the publicity, education and guidance of the relevant provisions on the safety management of fireworks and firecrackers and the prohibition of discharge. Article 6 Residents' committees, villagers' committees, owners' committees, units and individuals engaged in weddings, funerals and wedding services, as well as restaurants, hotels and other operators undertaking banquet services, shall persuade or discourage the discharge of fireworks and firecrackers in the management and service areas. If persuasion or dissuasion fails, it shall report to the public security organ in time. Seventh the following places and their surrounding areas are the key supervision parts that prohibit the discharge of fireworks and firecrackers:

(a) the office of state organs at or above the county (district) level;

(2) cultural relics protection units;

(3) Stations, shopping malls and other crowded places;

(four) urban primary and secondary roads, transportation hubs and railway line safety protection zones;

(five) oil and gas tanks, stations and other flammable and explosive dangerous goods storage places and their surrounding 100 meters and other key fire control units;

(6) Within the safety protection zone of power transmission and transformation facilities;

(7) Medical institutions, parks, schools and sanatoriums;

(eight) key fire prevention areas such as forests and grasslands;

(9) Important military facilities;

(ten) the people's governments of cities and counties (districts) shall, in accordance with the requirements of maintaining normal work and life order, determine and announce other places where fireworks and firecrackers are prohibited.

Where fireworks and firecrackers are prohibited in the preceding paragraph and its surrounding specific scope, the relevant units shall set up obvious warning signs prohibiting fireworks and firecrackers. Eighth units and individuals that set off fireworks and firecrackers outside the forbidden zone shall set off fireworks and firecrackers correctly and safely in accordance with the discharge instructions, and abide by the following provisions:

(a) shall not throw lit fireworks to the crowd, vehicles and buildings;

(two) not in buildings, roofs, balconies, manhole discharge or throwing fireworks;

(three) shall not hinder the safe passage of pedestrians and vehicles;

(four) fireworks and firecrackers shall not be set off in other ways that endanger the personal and property safety of the state, the collective and others;

Minors under the age of fourteen who set off fireworks and firecrackers shall be accompanied by guardians or other adults. Article 9 It is forbidden for any unit or individual to sell, illegally store, transport or mail fireworks and firecrackers in areas where discharge is prohibited.

Units and individuals that transport, store, sell and set off fireworks and firecrackers outside the prohibited discharge area shall abide by the relevant provisions of the state. Article 10 In case of violation of these regulations, under any of the following circumstances, the public security department shall order it to make corrections, confiscate its fireworks and firecrackers, impose a fine of not less than 500 yuan but not more than 5,000 yuan on the unit, and impose a fine of not less than 200 yuan but not more than 500 yuan on the directly responsible person in charge and other directly responsible personnel; Impose a fine of more than 200 yuan and less than 500 yuan on individuals.

(a) in violation of the provisions of the first paragraph of article third or the first paragraph of article seventh, in the area where fireworks are prohibited;

(two) in violation of the provisions of article fourth, holding a fireworks party or other large-scale fireworks display activities without permission;

(three) in violation of the provisions of the first paragraph of article eighth, illegal fireworks. Eleventh in violation of the provisions of the provisions of article ninth, by the public security organs, environmental protection, industry and commerce administration, transportation, postal management and other departments in accordance with the law. Twelfth fireworks caused losses to the state and collective property or caused personal injury or property losses to others, the actor shall bear the corresponding liability for compensation according to law; Violation of public security management shall be dealt with by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
