Article 1 In order to strengthen the supervision and management of production safety, improve the production safety level of star-rated hotels, prevent and reduce production safety accidents, and ensure the safety of people's lives and property, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Production Safety, the Regulations of Beijing Municipality on Production Safety and relevant laws and regulations.

(A) to strengthen the supervision and management of production safety

(1) Relevant laws and regulations

The legislation basis of this Ordinance is People's Republic of China (PRC) Law on Work Safety, People's Republic of China (PRC) Fire Protection Law, Regulations on Safety Supervision of Special Equipment, Regulations on Fire Safety Management of Organs, Organizations, Enterprises and Institutions, Regulations on Work Safety in Beijing, Regulations on Fire Protection in Beijing and Regulations on Tourism Management in Beijing.

(2) The actual situation of safety production in star hotels in our city.

By the end of 2006, there were 700 * * star hotels in our city. Due to different star ratings, different nature of enterprises, different management modes and different levels of safety production. In the process of drafting the Regulations, we conducted a lot of investigation and study, analyzed the causes of various production safety accidents, summarized the experience and lessons of star-rated hotels' safety production work, and thought that the practical problems existing in the safety production work of star-rated hotels in this city should be solved by perfecting the system, standardizing management and unifying the standards in safety production management. Based on the safety production practice of star-rated hotels, the Regulations emphasize the process control of safety production and the management of hidden dangers of accidents, and establish a long-term mechanism to ensure safety production, which has distinctive industry characteristics and operability.

Article 2 These Provisions shall apply to the safety production of star-rated hotels within the administrative area of this Municipality; Where the relevant laws, regulations and rules have other provisions on fire safety and special equipment safety, those provisions shall prevail.

The term "star hotels" as mentioned in these Provisions refers to hotels, restaurants, resorts and other business units above one star level.

First, the safety production of star-rated hotels (state-owned, collective, private, Sino-foreign joint ventures, etc.). ) within the administrative area of this Municipality, these Provisions shall apply.

Two, the relevant laws, regulations and rules on fire safety, special equipment safety and other provisions, the provisions shall apply.

In addition to the People's Republic of China (PRC) Law on Work Safety and the Beijing Regulations on Work Safety, the People's Republic of China (PRC) Fire Protection Law and the Regulations on Safety Supervision of Special Equipment are special laws and regulations on work safety, which should also be observed by star-rated hotels.

Thirdly, it further explains the meaning of star-rated hotels, which includes all hotels, restaurants, resorts and other units engaged in production and business activities that have obtained star-rated titles.

Article 3 Safety production management adheres to the principles of safety first, prevention first and comprehensive management.

To ensure the capital investment in safety production, all equipment and facilities should meet the requirements of safety production, and hidden dangers of accidents must be eliminated in time when found, and safety should not be ignored in order to catch up with tasks and pursue benefits. To unify the understanding of safety production, the management of safety production is not a matter of a certain person or department, but depends on the joint efforts of all employees in the enterprise.

First, "safety first" embodies the principle of safety first.

When dealing with the relationship between ensuring safety and achieving the objectives of production and business activities, we should always put safety, especially the personal safety of relevant personnel, in the first place. The provisions on safety production conditions, requirements, penalties and other provisions contained in these Provisions are formulated around the principle of safety first.

We must first be realistic, respect science, explore laws, take effective control measures, and do everything possible to prevent accidents. Star-rated hotels should strictly follow the provisions of laws and regulations, and do a good job in safety production conditions, safety production responsibility system, safety production guarantee measures, education and training of employees, and emergency rescue plans. , so as to eliminate production safety accidents in the bud.

Three, "comprehensive management" is to mobilize all employees to actively participate in safety production.

The work of safety production in star-rated hotels is not the business of a certain person, a certain post or a certain department, but the business of all the staff of star-rated hotels. Every employee should firmly establish the consciousness of "safety first, prevention first, comprehensive treatment", strictly implement the post responsibility system for safety production, and enhance the consciousness of self-protection. Fourth city, district and county tourism administrative departments to implement industry supervision and management of the safety production of star-rated hotels; Public security fire control, quality and technical supervision and other departments respectively carry out special supervision and management on fire safety and special equipment safety of star-rated hotels; The safety production supervision and management department implements comprehensive supervision and management of the safety production of star-rated hotels, and guides, coordinates and urges relevant government departments to perform their duties of safety production supervision and management.

Industry associations assist relevant government departments to guide member units to do a good job in safety production, formulate safety production systems and regulations, and provide related services.

First, the municipal, district and county tourism administrative departments implement industry supervision and management on the safety production of star-rated hotels.

It mainly includes checking the implementation of safety production in star-rated hotels, cooperating with relevant departments to carry out emergency rescue and accident investigation and handling, and imposing administrative penalties on violations of safety production.

Two, public security fire, quality and technical supervision departments to implement special supervision and management of fire safety and special equipment safety of star hotels.

Safety Supervision Bureau guides, coordinates and supervises other government departments to perform their duties of safety production supervision, studies and formulates government safety production principles and policies, puts forward measures to solve overall and universal major problems, acts as a good government staff assistant, organizes and coordinates special supervision and management of safety production, and organizes emergency rescue and investigation and handling of production safety accidents. Four, industry associations to assist the relevant government departments to guide member units to do a good job in production safety, formulate safety production systems and regulations, and provide related services.

A, the responsibility system for production safety refers to the star hotel in accordance with the provisions of the relevant laws, regulations and rules on production safety, combined with the operating characteristics of the star hotel, the specific provisions of the safety production management of the unit and the rules and regulations of the specific person in charge.

Two, according to the provisions of article twelfth of the "Regulations on Safety in Production in Beijing", star hotels should have the conditions for safety in production:

(a) the business premises, equipment and facilities meet the requirements of relevant laws and regulations on safety in production and national standards or industry standards;

(two) establish and improve the responsibility system for production safety, formulate rules and regulations for production safety and related operating procedures;

(three) the establishment of production safety management institutions or equipped with production safety management personnel according to law;

(four) to equip employees with labor protection articles that meet the national standards or industry standards;

(five) the main person in charge and the safety production management personnel have the knowledge and management ability of safety production that are suitable for the production and business activities;

(six) employees have received safety education and training. Special operations personnel receive special operations training in accordance with the relevant provisions of the state and obtain the qualification certificate for special operations;

(seven) other conditions for safe production as stipulated by laws, regulations, national standards or industry standards.

According to the provisions of Article 35 of the Regulations of Beijing Municipality on Work Safety, star-rated hotels shall also meet the following conditions for work safety:

(a) in the business premises to set up obvious safety exits and evacuation routes that meet the evacuation requirements, and ensure smooth;

(two) equipped with emergency broadcasting and command system, emergency lighting facilities, fire equipment in the business premises, and ensure that they are in good condition and effective;

(three) to formulate reliable safety measures and emergency rescue plans for production safety accidents, and to equip emergency rescue personnel;

(four) the person in charge can skillfully use the emergency broadcast and command system and master all the contents of the emergency rescue plan;

(five) employees can skillfully use fire fighting equipment, understand the location of safety exits and evacuation routes and the emergency rescue responsibilities of their posts;

(six) the actual number of people in the business premises does not exceed the prescribed number.

The above conditions are the basic conditions for the safety production of star-rated hotels.

Article 7 Where there are more than 300 employees in a star-rated hotel, a safety production management institution shall be set up or full-time safety production management personnel shall be equipped; Employees under 300 shall be equipped with full-time or part-time safety production management personnel, or entrust engineering and technical personnel with relevant professional and technical qualifications as stipulated by the state to provide safety production management services.

Safety production management organization refers to the internal organization responsible for the supervision and management of safety production in star-rated hotels, and its staff is full-time safety production management personnel. Safety production management agencies are responsible for organizing the implementation of national safety production laws and regulations, organizing internal safety production activities in star-rated hotels, taking charge of daily safety inspections, promptly urging the rectification of hidden dangers of accidents in their own units, and supervising the implementation of the responsibility system for safety production. Safety production management organization is the assistant of the main person in charge of safety production in star-rated hotels and an important organizational guarantee for safety production in star-rated hotels.

A star-rated hotel with more than 300 employees must set up a safety production management organization or be equipped with full-time safety production management personnel. Employees in less than 300 people, should be equipped with full-time or part-time safety management personnel responsible for production safety. You can also entrust engineering and technical personnel with relevant professional and technical qualifications stipulated by the state to provide safety production management or technical services. It should be noted that after star-rated hotels entrust engineers with relevant professional and technical qualifications to provide safety production management services, the responsibility for ensuring safety production is still borne by star-rated hotels.

Safety production management personnel refer to all personnel engaged in safety production management, including both the person in charge of safety production management institutions and the person in charge of safety production in star-rated hotels; It refers to both full-time safety production management personnel and part-time safety production management personnel. As a safety production manager, you must have the safety knowledge and management ability suitable for the business activities of star-rated hotels.

Engineering and technical personnel with relevant professional and technical qualifications stipulated by the state refer to those who have professional skills related to safety production outside the hotel and have passed the examination of relevant departments and obtained professional and technical qualifications. Such personnel can be entrusted by star-rated hotels to provide safety production management services.

Article 8 Star-rated hotels shall educate and train employees in production safety. Employees who have not passed the safety education and training are not allowed to work at their posts.

Star hotels should keep education and training records for at least 2 years.

The purpose of this article is to ensure that every employee receives education and training on safety in production, understands laws and regulations on safety in production, and has the knowledge and ability to operate safety in this position.

It is the legal obligation of star-rated hotels to educate and train employees in production safety, and it is also an inevitable requirement to implement the policy of "safety first, prevention first and comprehensive management", and it is also a major event related to the safety of employees.

It is an important measure to "nip in the bud" and an important embodiment of being responsible for people's lives and property to prohibit employees from working at their posts without safety education and training.

Star-rated hotels must attach importance to the safety education and training of employees, ensure the effect of education and training, and cannot go through the motions. In order to facilitate supervision and inspection, this article stipulates that "star hotels should keep education and training records for at least 2 years." Be examined.

Article 9 Special operators of star-rated hotels shall receive special safety operation training in accordance with the relevant provisions of the state and obtain the qualification certificate for special operations before taking up their posts.

Special operators refer to operators whose workplaces, operating equipment and operating contents are dangerous, which are prone to casualty accidents, or are likely to cause great harm to the safety of operators themselves, others and surrounding facilities. Such as: electrician, welder, elevator worker, boiler worker, refrigerator worker, etc. Because the work of special operators is generally potentially dangerous, it is also easy to pose a threat to people's lives and property. Therefore, special operations personnel must go through the training institutions recognized by the relevant administrative departments for safety operation training and pass the examination, and can only work at their posts after obtaining the operation qualification certificate.

Article 10 A star-rated hotel shall establish a regular meeting system for safety production and regularly study the safety production work of its own unit; Formulate effective safety production measures and check the implementation of the measures.

Eleventh star-rated hotels should establish a system for the investigation of hidden dangers of production safety accidents, clarify the responsible personnel for the parts and facilities that are prone to accidents, and formulate and implement preventive and emergency measures.

Accident hidden danger refers to all kinds of natural or human factors that may cause accidents in the production facilities and equipment of star-rated hotels.

The investigation system of hidden dangers of production safety accidents refers to the analysis by scientific methods according to the requirements of laws and regulations, combined with previous experience and lessons, to find out the parts that may cause accidents, and to control and prevent them by using existing conditions and scientific means.

Star-rated hotels are the main body responsible for production safety. According to the laws and regulations on production safety, analyze and combine the characteristics of production and business activities of the unit, find out the areas and links prone to accidents, and take effective monitoring measures to prevent production safety accidents and achieve the purpose of safe production. The main person in charge of a star-rated hotel shall regularly organize safety inspections, and designate a person to be responsible for eliminating the safety problems or hidden dangers found in the inspection; If it is difficult to eliminate it in time, it shall organize relevant functional departments to study and take effective preventive measures to avoid personal and property losses.

Article 12 A star-rated hotel shall conduct at least 1 safety inspection on the business area every 2 hours. Check should be recorded.

In order to clarify the responsibility of patrol inspection, enhance the sense of responsibility of patrol personnel in star-rated hotels, and urge them to carry out patrol inspection seriously as required, leaving no dead ends. Thirteenth star hotel distribution room with a total rated capacity of more than 630 kV and a voltage level of 10 kV, a special person shall be arranged to be on duty 24 hours a day. Records should be made when on duty.

Dangerous goods and sundries shall not be stored in the power distribution room.

Article 14 The power transformation and distribution room shall be equipped with safety technical data such as electrical equipment and distribution line layout, as well as necessary working tools and labor protection articles, and a simulation board for the operation of the power transformation and distribution system shall be set in an obvious position.

Doors, windows and cable trenches in the distribution room should be equipped with waterproof facilities and rat traps.

Setting the simulation board of power distribution system operation in an obvious position can intuitively make the electrician on duty master the operation state of the hotel electrical system, and the simulation board is consistent with the actual operation mode.

Water and rats are natural enemies of safe electricity use. Water leakage and rat bites caused damage to cable insulation, resulting in many local or large-scale power outages. Therefore, it is very necessary to install waterproof facilities on the doors, windows and cable trenches of the distribution room. More importantly, it is necessary to install mousetraps on the doors of the distribution room that directly lead to the outside, and regularly put rat poison into the cable trenches.

Fifteenth star hotels to set up power lines should comply with national standards or industry standards; Temporary power lines shall take effective protective measures; Electrical equipment should be equipped with leakage and overload protection devices.

Electric power is the main power source of hotel production and operation activities. Once it breaks down, it will seriously affect the normal business order. However, production safety accidents caused by improper use of electricity are common every year. Accidents caused by electrical equipment and distribution lines are one of the common production safety accidents in star-rated hotels. The main causes of accidents are: aging equipment, improper use, short circuit, overload, excessive contact resistance and electric spark. In order to reduce the occurrence of electricity accidents, use electricity correctly and effectively, and strengthen the safety, installation and operation management of electrical equipment for power users, the relevant power departments have formulated the Electrical Code, which has played a normative and guiding role for power users. Therefore, the "Regulations" stipulate the setting of power lines in star-rated hotels.

Star hotels often hold various activities for promotion or business needs, or connect temporary power lines for reasons such as equipment and facilities maintenance and local decoration. In order to ensure the safety of temporary power lines, an application must be made to the hotel safety management department before connecting the temporary power lines. After approval, professional electricians will install and dismantle temporary lines. Temporary lines must use rubber sheath line or double insulated plastic sheath line. When crossing the ground, protective measures should be taken to prevent trampling and rolling, and temporary line power supply should have leakage protection device.

Installation of leakage protection devices in star-rated hotels can effectively prevent electric shock accidents. Check the leakage protection device at least once a month and make records. If the leakage protection device fails, it should be updated immediately, and it is forbidden to reuse it after maintenance.

Installing overload protection device is an important means to effectively prevent electrical fire. The line is equipped with overload protection device. Once the current passing through the line exceeds the allowable safe current, the overload protection device will act to cut off the power supply, thus avoiding the occurrence of electrical fire caused by serious overcurrent of wires or electrical equipment.

Sixteenth star hotels should ensure smooth export; Do not close or block the exit; There should be no threshold at the exit.

Evacuation doors should be opened in the direction of evacuation, and rolling doors, revolving doors, hanging doors and sliding doors are not allowed. No steps shall be set inside or outside the door1.4m..

If the safety door opens inward or adopts shutter doors, revolving doors, hanging doors and sliding doors, it is undoubtedly impossible to ensure safe evacuation.

In the process of evacuation, when there are many people, they often don't care whether there are obstacles under their feet. If they go out, they will step on it, which will easily make people fall in the air and lead to a stampede accident. Therefore, it is stipulated that "no steps shall be set inside or outside the door 1.4 meters".

Article 17 The number of safe exits, the safe evacuation distance, the width of evacuation doors and evacuation passages in the business area shall meet the national standards or industry standards.

The National Code for Fire Protection Design of Buildings clearly stipulates the number of safety doors, the length of safe evacuation distance and the width of safety doors and evacuation passages.
