How long can you get for allowing others to take drugs?

According to Article 354 of the Criminal Law of People's Republic of China (PRC), whoever allows others to take or inject drugs shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also be fined.

According to Article 12 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Drug Crime Cases, anyone who allows others to take or inject drugs shall be convicted and punished for the crime of allowing others to take or inject drugs in accordance with the provisions of Article 354 of the Criminal Law:

(a) Allowing more than one person to take or inject drugs at the same time;

(2) repeatedly allowing others to take or inject drugs within two years;

(3) Having received administrative punishment for allowing others to take or inject drugs within two years;

(4) sheltering minors from taking or injecting drugs;

(five) for the purpose of making profits, allowing others to take or inject drugs;

(six) allowing others to take or inject drugs, causing serious consequences;

(seven) other circumstances that should be investigated for criminal responsibility.

Whoever tolerates others to take or inject drugs after drug trafficking, or tolerates others to take or inject drugs and sells drugs to them, meets the conviction conditions of tolerating others as stipulated in the preceding paragraph, shall be punished with the crime of drug trafficking and the crime of tolerating others.

Allowing close relatives to take or inject drugs, if the circumstances are obvious and minor, shall not be treated as a crime; If criminal responsibility needs to be investigated, the punishment may be lenient as appropriate.

Recently, the suspects Shimou and Wang, who were detained by Meilan Public Security Bureau of Haikou City for allowing others to take drugs, were sentenced by hosts of others in Meilan District Court of Haikou City. Shimou was sentenced to 7 months in prison and fined 1000 yuan. Wang was sentenced to six months' imprisonment, suspended for 1 year, and fined 1 ten thousand yuan.
