If serious consequences are caused by the fault of the actor, it may constitute a negligent crime. Negligent crime refers to the crime that the actor should have foreseen the possible consequences of his actions that will harm the society, but failed to foresee them due to negligence, or credulously avoided them although he had foreseen them, resulting in such consequences. What kind of negligent crime constitutes depends on the specific behavior of the perpetrator and the serious consequences. Some common negligent crimes include negligent death, negligent serious injury and traffic accident. However, in order to determine whether an act constitutes a crime and what kind of crime it constitutes, it is necessary to comprehensively consider legal provisions, case facts, evidence and other factors. According to Article 15 of the Criminal Law of People's Republic of China (PRC), it is a negligent crime to foresee that one's actions may have harmful consequences to society, but fail to foresee them because of negligence, or think that such consequences can be avoided because of having foreseen them.
