Regulations of Wuhu Municipality on the administration of fireworks and firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, safeguard the public and personal and property safety, and improve the environmental quality, these Regulations are formulated in accordance with the relevant laws and administrative regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and related management activities within the administrative area of this Municipality.

The provisions of relevant laws and administrative regulations shall apply to the holding of large-scale fireworks display activities such as fireworks parties. Article 3 The management of fireworks and firecrackers shall follow the principle of combining prohibition with restriction and combining education with punishment. Article 4 The Municipal People's Government shall strengthen the management of fireworks and firecrackers in the whole city, establish a joint meeting system, strengthen the long-term working mechanism of joint prevention and control, and incorporate related activities into the construction of social credit system.

County (District) people's government is responsible for the management of fireworks and firecrackers in this area, and urges relevant departments to perform their duties of fireworks and firecrackers management according to law.

Town People's Government and sub-district offices shall incorporate the management of fireworks and firecrackers into grassroots social governance.

Jiangbei Industrial Concentration Zone, Development Zone Management Committee shall, in accordance with the requirements of the Municipal People's government, do a good job in the management of fireworks and firecrackers in this area. Fifth public security organs are the administrative departments in charge of fireworks management, and are responsible for the safety management of fireworks. Investigate and deal with illegal fireworks and firecrackers according to law, and establish a joint law enforcement system with relevant departments.

The urban management department shall investigate and deal with the behavior of setting off fireworks and firecrackers affecting environmental sanitation according to law.

The housing and urban-rural construction departments shall urge the construction units to abide by the relevant provisions on the management of fireworks and firecrackers, and urge the property service enterprises to do a good job in the management of fireworks and firecrackers in the service area.

Civil affairs departments should carry out propaganda work in marriage registration, funeral homes, cemeteries and other places, and guide weddings and funerals to comply with the relevant provisions on the management of fireworks and firecrackers.

Environmental protection, education and other departments shall, within the scope of their respective duties, do a good job in the management of fireworks. Sixth organs, enterprises and institutions, social organizations and other organizations should do a good job in the management of fireworks.

Property service enterprises, hotels, hotels and other units shall promptly discourage the illegal discharge of fireworks and firecrackers in the service area; If dissuasion is ineffective, it shall report to the public security organ. Article 7 Fireworks and firecrackers are prohibited in the following places:

(1) State organs;

(2) cultural relics protection units;

(3) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(four) the production and storage units of inflammable and explosive dangerous goods and their surrounding areas within 200 meters;

(5) Within the safety protection zone of power transmission and transformation facilities;

(six) medical institutions, pension institutions, educational institutions, public cultural service places, memorial places for heroes and martyrs;

(seven) key fire prevention areas such as forests and nurseries;

(eight) other places that prohibit the discharge of fireworks and firecrackers as stipulated by laws, regulations and the people's governments of cities and counties (districts).

Where fireworks and firecrackers are prohibited, the owner, user or management unit shall set warning signs prohibiting fireworks and firecrackers, and be responsible for management and maintenance. Eighth Jinghu District, Yijiang District, sanshan district, Wuhu Economic and Technological Development Zone and Anhui Wuhu Sanshan Economic Development Zone (Wuhu to undertake industrial transfer centralized demonstration park) are forbidden to set off fireworks and firecrackers.

The time and area for prohibiting or restricting the discharge of fireworks and firecrackers in Wuwei County, Wuhu County, Fanchang County, Nanling County, Jiujiang District and Jiangbei Industrial Concentration Zone in Anhui Province shall be determined by the county (district) people's government and the Jiangbei Industrial Concentration Zone Management Committee and announced to the public. Ninth heavy pollution weather warning period, the city and county (District) people's government can take emergency measures to prohibit the discharge of fireworks. Tenth it is forbidden to set off fireworks and firecrackers in the following ways that endanger public safety or personal and property safety:

(a) Emissions in buildings and structures;

(two) for pedestrians, vehicles, buildings, structures, construction sites, trees, rivers, public green spaces, manholes, etc. ;

(three) other ways to endanger public security or personal and property safety. Eleventh city, county (District) people's government and its relevant departments, the town people's government and street offices shall organize and carry out fireworks management publicity, and increase publicity in key periods such as the Spring Festival, Lantern Festival, Tomb-Sweeping Day and winter solstice.

Radio, television, newspapers, internet and other media should carry out fireworks management and public welfare publicity to change customs.

Schools and guardians of minors shall educate students and minors on the prohibition, restriction and safe discharge of fireworks and firecrackers, and strengthen supervision. Twelfth citizens, legal persons and other organizations have the right to report violations of these regulations, and the state organs that accept the report shall keep confidential the informants.

The public security organ and the urban management department shall establish a feedback system for fireworks management reports, register and investigate relevant reports in a timely manner, and feedback the investigation results to the informants within three working days after the case is closed. If verified, the whistleblower shall be rewarded, and the reward standard shall be formulated by the Municipal People's Government. Article 13 Where a realty service enterprise, hotel, hotel or other unit violates the provisions of the second paragraph of Article 6 of these regulations and fails to dissuade the illegal discharge of fireworks and firecrackers in the service area in time or fails to report to the public security organ, the public security organ shall order it to make corrections and may give it a warning or impose a fine of not more than 500 yuan.
