Measures for Public Security Management in the Hotel Industry

The "Hotel Industry Public Security Management Measures" were approved by the State Council on September 23, 1987, and promulgated by the Ministry of Public Security on November 10, 1987. They will come into effect on the date of promulgation; they were passed on January 8, 2011. State Council Order No. 588 was announced to amend some provisions of the "Hotel Industry Public Security Management Measures", which will be effective from the date of announcement. There are currently 20 relevant provisions; on March 29, 2022, it was announced by State Council Order No. 752. Some provisions of the "Hotel Industry Public Security Management Measures" have been modified and will come into effect on May 1, 2022

Article 1 is to ensure the normal operation of the hotel industry and the safety of tourists' lives and property, and maintain social security , formulate these measures.

Article 2 Any hotel, restaurant, hotel, guest house, inn, carriage shop, bathhouse, etc. (hereinafter collectively referred to as a hotel) that receives tourists for accommodation, whether it is state-owned, collectively operated, or a partnership, Self-employed businesses and foreign-invested businesses, whether they are franchises or part-time businesses, whether they are year-round businesses or seasonal businesses, must abide by these Measures.

Article 3: When opening a hotel, you must have necessary anti-theft and other safety facilities. [1]

Article 4 When applying to open a hotel, one must obtain a business license issued by the market supervision department and apply for a special industry license from the local public security agency before the hotel can be opened. [1]

If a hotel that has been approved for business goes out of business, changes operations, merges, moves, changes its name, etc., it must report the change to the local county or city police within 3 days after completing the registration change with the market supervision department. Register with the bureau and public security bureau. [1]

Article 5 When operating a hotel, you must abide by the laws of the country, establish various safety management systems, set up a security organization or designate security personnel.

Article 6: Hotels must register for accommodation of tourists. When registering, the passenger's identity document shall be checked and the passenger's identity document shall be truthfully registered according to the prescribed items.

When receiving overseas tourists for accommodation, they must also submit an accommodation registration form to the local public security agency within 24 hours.

Article 7 A hotel shall set up a safe deposit box, cabinet or storage room or safe for passengers’ belongings, and designate a dedicated person to be responsible for the safekeeping. It is necessary to establish a registration, collection and handover system for the property deposited by passengers.

Article 8 Hotels shall properly keep items left by tourists and try to return them to their original owners or publicly claim them; if no one claims them after 3 months of recovery, they must register them and send them to the local public security organ for press release. Disposal of found items. Prohibited items and suspicious items must be promptly reported to the public security organs for processing.

Article 9 Hotel staff who discover illegal criminals, persons with suspicious behavior and criminals wanted by the public security organs shall immediately report to the local public security organs, and shall not fail to report or conceal the information.

Article 10 Those who open dance halls, music cafes and other entertainment and service venues in hotels shall, in addition to complying with the relevant provisions of these Measures, also be managed in accordance with the relevant provisions of the state and local governments.

Article 11 It is strictly prohibited for passengers to bring flammable, explosive, highly toxic, corrosive, radioactive and other dangerous items into the hotel.

Article 12 Prostitution, whoring, gambling, drug use, dissemination of obscene materials and other illegal and criminal activities are strictly prohibited in hotels.

Article 13: In the hotel, drunkenness, causing trouble, making loud noises, affecting other people's rest are not allowed, and tourists are not allowed to stay or transfer beds privately.

Article 14 The responsibilities of public security organs for hotel security management are to guide and supervise hotels to establish various safety management systems and implement safety precautions, and to assist hotels in training staff on safety business knowledge, in accordance with the law. Punish criminals who violate the legitimate rights and interests of hotels and tourists.

When public security personnel go to a hotel to perform official duties, they should present their credentials, act in strict accordance with the law, treat others with courtesy and courtesy, and safeguard the normal operation of the hotel and the legitimate rights and interests of tourists. Hotel staff and travelers should assist.

Article 15 If a hotel is opened in violation of the provisions of Article 4 of these Measures, the public security organs may give a warning or impose a fine of not more than 200 yuan as appropriate; if the hotel is opened without registration, the public security organs shall assist the industrial and commercial administration. The department will handle it in accordance with the law.

Article 16 If a hotel staff violates the provisions of Article 9 of these Measures, the public security organ may, as appropriate, give a warning or impose a fine of not more than 200 yuan; if the circumstances are serious enough to constitute a crime, criminal liability shall be pursued in accordance with the law.

If the person in charge of a hotel participates in illegal and criminal activities, and the hotel he or she operates has become a venue for criminal activities, the public security organs, in addition to holding him accountable in accordance with the law, should also deal with the hotel in conjunction with the industrial and commercial administration department in accordance with the law.

Article 17 Anyone who violates the provisions of Articles 6, 11 and 12 of these Measures shall be punished in accordance with the relevant provisions of the "Public Security Administration Punishment Law of the People's Republic of China"; If a major accident causes serious consequences that constitute a crime, criminal liability shall be investigated in accordance with the law.

Article 18 If the party concerned is dissatisfied with the administrative penalty decision of the public security organ, the matter shall be handled in accordance with the provisions of Article 102 of the "Public Security Administration Punishment Law of the People's Republic of China".

Article 19 The public security departments (bureaus) of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation details in accordance with these Measures, submit them to the local people's government for approval and then implement them, and report them to the Ministry of Public Security for filing.

Article 20 These Measures shall come into effect from the date of promulgation. The "Interim Management Rules for the Urban Hotel Industry" promulgated on August 15, 1951 were abolished at the same time.
