Regulations on the Management of Mengsuo Longtan Reserve in Ximeng Wa Autonomous County, Yunnan Province

Article 1 is to strengthen the protection and management of the natural ecological environment of Mengsuo Longtan, in accordance with the "Regional Ethnic Autonomy Law of the People's Republic of China" and the "Environmental Protection Law of the People's Republic of China" , the "Water Law of the People's Republic of China" and relevant laws and regulations, and combined with the actual situation of Mengsuo Longtan, these regulations are formulated. Article 2 The scope of the Mengsuo Longtan Nature Reserve (hereinafter referred to as the Longtan Nature Reserve) is: centered on Longtan, extending to the Nanmoshan watershed, Nangui River, and Mengsuo River in the east, to the Nuokuoshan watershed in the west, and to Fumu in the south. It is the watershed of the back mountain and reaches Yangwoqing in the north.

The specific boundaries of Longtan Nature Reserve shall be delineated by the People's Government of the Autonomous County and permanent signs shall be set up. Article 3 All units and individuals operating in Longtan Nature Reserve must abide by these regulations. Article 4 The water quality of Mengsuo Longtan shall be protected in accordance with the National Surface Water Environmental Quality Class II Standard. Article 5 The management agency of Longtan Nature Reserve is the functional agency of the People’s Government of the Autonomous County for the unified management of Longtan Nature Reserve, and is under the jurisdiction of the environmental protection administrative department. Its main responsibilities are:

(1) Promote and implement relevant laws, regulations and these regulations;

(2) Organize and implement the protection management and construction plan approved by the autonomous county people’s government Implementation by relevant departments;

(3) Formulate and organize the implementation of the annual Longtan water control plan;

(4) Exercise the administrative penalty power conferred by these regulations. Article 6 The people's government of the autonomous county shall organize and coordinate the relevant departments and the people's government of the town where Longtan Nature Reserve is located to carry out the relevant management work of Longtan Nature Reserve in accordance with their respective responsibilities. Article 7 Except for the unified planned management and tourist facilities, no other facilities are allowed to be built in Longtan Nature Reserve. The original facilities must be strictly managed and must not pollute the ecological environment, and must not be expanded or converted into polluting project facilities.

It is prohibited to build any new project facilities in the runoff area east and south of the Longtan water surface and within 80 meters of the water shoreline to the west and north of the Longtan water surface. Article 8 The following behaviors are prohibited in the Longtan Nature Reserve:

(1) Taking water from the Longtan water source;

(2) Fish farming in Longtan cages, pond breeding, and enclosure Farming in Longtan and other behaviors that pollute the water quality and reduce the water surface of Longtan;

(3) Fish frying, poisoning fish, electric fishing, net fishing and killing of migratory birds, waterfowl, frogs and other damages in Longtan Behavior of aquatic animals and plants;

(4) Discharging industrial wastewater, domestic pollution, dumping or burying industrial waste, domestic garbage and other toxic and harmful substances in the Longtan water catchment area;

(5) Discarding bottles (cans), food packaging and other waste into Longtan;

(6) Swimming, bathing, washing clothes and using motor boats in Longtan;

(7) Cutting down trees, clearing forests for land reclamation, using fire in the wild and hunting wild animals;

(8) Opening mountains and blasting rocks, taking soil, and mining sand. Article 9 Organizations and individuals who enter Longtan Nature Reserve to engage in scientific research, film and television shooting and other activities must obtain the consent of the Longtan Nature Reserve management agency and go through relevant procedures. Article 10 Units and individuals that have made outstanding contributions to the protection and management of Longtan Nature Reserve shall be commended and rewarded by the autonomous county people's government. Article 11 Units and individuals who commit any of the following acts shall be punished by the management agency of Longtan Reserve in accordance with the following provisions:

(1) Those who violate the provisions of Article 7 of these Regulations shall have the illegal buildings demolished within a time limit. , and shall be fined not less than RMB 1,000 but not more than RMB 5,000;

(2) Anyone who violates the provisions of Items (1), (5) and (6) of Article 8 of these Regulations shall be given a warning, ordered to make corrections, and A fine of not less than 50 yuan but not more than 200 yuan may be imposed depending on the circumstances;

(3) Violation of Article 8 (2), (3), (4), (7) and (8) of these Regulations , order correction or compensation for losses, and impose a fine of not less than 500 yuan but not more than 3,000 yuan depending on the circumstances;

(4) Anyone who violates the provisions of Article 9 of these Regulations shall be fined not less than 100 yuan but not more than 300 yuan. Article 12 If the party concerned is dissatisfied with the administrative penalty decision, it shall be handled in accordance with the provisions of the Administrative Reconsideration Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China and relevant regulations. Article 13 If staff of the Longtan Reserve Management Agency and relevant departments neglect their duties, abuse their power, or engage in malpractice for personal gain, they shall be subject to administrative sanctions by their unit or the superior administrative department; if a crime is constituted, criminal liability shall be investigated by the judicial authorities.

Article 14 The Standing Committee of the Autonomous County People’s Congress is responsible for the interpretation of these Regulations. Article 15: These Regulations shall be adopted by the Autonomous County People’s Congress and shall be promulgated and implemented after approval by the Standing Committee of the Yunnan Provincial People’s Congress.
