Regulations of People's Republic of China (PRC) Municipality on the Administration of Entry and Exit of Foreigners

Chapter I General Principles

Article 1 These Regulations are formulated in accordance with the Exit and Entry Administration Law of People's Republic of China (PRC) (hereinafter referred to as the Exit and Entry Administration Law) for the purpose of regulating the issuance of visas and the service and administration of foreigners' stay and residence in China.

Article 2 The State shall establish a coordination mechanism for the entry and exit services and management of foreigners, and strengthen the overall planning, coordination and cooperation of the entry and exit services and management of foreigners.

The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, as necessary, establish a coordination mechanism for the entry and exit services and management of foreigners, strengthen information exchange and coordination, and do a good job in the entry and exit services and management of foreigners within their respective administrative areas.

Article 3 The Ministry of Public Security shall, together with relevant departments of the State Council, establish an information platform for foreigners' entry and exit services and management, so as to share relevant information.

Article 4 In the management of visas and foreigners' stay and residence in China, the Ministry of Foreign Affairs, the Ministry of Public Security and other the State Council departments shall provide the laws and regulations on foreigners' entry and exit and other information that foreigners need to know on departmental portals and places where applications for entry and exit certificates are accepted.

Chapter II Types and Issuance of Visas

Article 5 The scope and methods of issuing diplomatic visas, courtesy visas and official visas shall be stipulated by the Ministry of Foreign Affairs.

Article 6 Ordinary visas are divided into the following categories, and the corresponding Chinese phonetic alphabet shall be marked on the visa:

(1) Visa C is issued to international train attendants, crew members of international aircraft, crew members of international ships and their accompanying families, and automobile drivers engaged in international road transport.

(2) D visa, issued to permanent residents.

(3) F-visa, which is issued to those who enter the country for exchange, visit, inspection and other activities.

(4) G visa, which is issued to persons passing through China.

(5) J 1 visa, issued to foreign resident journalists of foreign news agencies in China; J2 visa is issued to foreign journalists who enter the country for short-term interviews.

(six) L visa, issued to inbound tourists; If you enter the country as a group, you can issue a group L visa.

(seven) M visa, issued to the entry of personnel engaged in business activities.

(8) Q 1 visa, which is issued to the families of China citizens who apply for entry and residence due to family reunion, the families of foreigners who have permanent residency in China, and those who apply for entry and residence due to foster care; Q2 visas are issued to relatives of China citizens living in China and foreigners with permanent residency in China to apply for short-term entry to visit relatives.

(9) R visas are issued to foreign high-level talents needed by the country and urgently needed professionals.

(10) Issue visas with the words S 1 to the spouses, parents, children under the age of 18, parents of spouses and persons who need to stay in China for other personal reasons of foreigners who apply for long-term visits; S2 visa is issued to the families of foreigners who apply for short-term entry to visit relatives, stay in China for work and study, and those who need to stay in China for other personal reasons.

(11) X 1 visa, issued to those who apply for long-term study in China; X2 visa is issued to those who apply for short-term study in China.

(twelve) Z visa, issued to people who apply for work in China.

Article 7 When applying for a visa, a foreigner shall fill in an application form and submit his passport or other international travel documents, as well as photos that meet the requirements and materials related to the reasons for applying.

(1) To apply for a C visa, a letter of guarantee issued by a foreign transportation company or an invitation letter issued by the relevant unit in China shall be submitted.

(2) To apply for a D-visa, the Confirmation Form for Permanent Residence of Foreigners issued by the Ministry of Public Security shall be submitted.

(3) To apply for an F visa, an invitation letter issued by the inviting party in China shall be submitted.

(four) to apply for a G visa, you should submit the date of going to the country (region) and the transfer plane (car, boat) ticket with fixed seats.

(5) To apply for J 1 and J2 visas, the applicant shall go through the examination and approval procedures and submit the corresponding application materials in accordance with China's Regulations on the Interview of Foreign Resident News Agencies and Foreign Journalists.

(six) to apply for an L visa, you should submit travel plans, itineraries and other materials as required; For inbound tourism in the form of a team, an invitation letter issued by the travel agency shall also be submitted.

(7) To apply for an M visa, an invitation letter issued by a business and trading partner in China shall be submitted as required.

(eight) to apply for Q 1 visa, and to apply for entry and residence for family reunion, an invitation letter and proof of family relationship issued by China citizens and foreigners living in China with permanent residence qualifications shall be submitted; If you apply for entry for reasons such as foster care, you shall submit a power of attorney and other supporting materials; To apply for a Q2 visa, you should submit an invitation letter and other supporting materials issued by a China citizen living in China or a foreigner with permanent residence qualification.

(9) To apply for an R visa, the applicant shall meet the conditions and requirements for the introduction of foreign high-level talents and talents in urgent need as determined by the relevant competent departments of China Municipal Government, and submit the corresponding certification materials in accordance with the provisions.

(10) To apply for S 1 and S2 visas, an invitation letter issued by foreigners for staying in China for work, study and other reasons, proof of family members, or proof materials required for entering the country to handle private affairs shall be submitted as required.

(eleven) to apply for X 1 visa, the admission notice issued by the recruiting unit and the certification materials issued by the competent department shall be submitted in accordance with the regulations; To apply for X2 visa, the admission notice and other supporting materials issued by the recruiting unit shall be submitted in accordance with the regulations.

(twelve) to apply for a Z visa, it shall submit the work permit and other supporting materials in accordance with the regulations.

Visa authorities may require foreigners to submit other application materials according to specific circumstances.

Article 8 Foreigners under any of the following circumstances shall be interviewed according to the requirements of visa offices abroad:

(1) Applying for entry and residence;

(2) Personal identity information and entry reasons need further verification;

(3) Having a record of being refused entry or being ordered to leave the country within a time limit;

(4) Other circumstances requiring an interview.

Overseas visa agencies need to verify relevant information with relevant domestic departments and units, and relevant domestic departments and units shall cooperate with them.

Article 9 If the visa issuing authority considers that it meets the conditions for issuance after examination, it shall issue visas of corresponding categories. If it is necessary to apply for a residence certificate after entry, the visa authority shall indicate the time limit for applying for a residence certificate after entry on the visa.

Chapter III Accommodation Management

Article 10 Foreigners who enter the country with a visa can change their reasons for staying in order to facilitate entry according to state regulations, or need to stay in a group for objective reasons after entering the country with a new passport or a group visa, they may apply to the exit-entry administration of the public security organ of the local people's government at or above the county level for visa renewal.

Article 11 If a foreigner's visa in China is lost, damaged or robbed, he shall promptly apply to the exit-entry administration of the public security organ of the local people's government at or above the county level for a replacement visa.

Article 12 When applying for visa extension, renewal, replacement and application for stay certificate, foreigners shall fill in the application form and submit their passports or other international travel documents, as well as photos that meet the requirements and materials related to the reasons for application.

Article 13 If a foreigner's application for visa extension, renewal, replacement and application for stay documents meet the acceptance conditions, the exit-entry administration department of the public security organ shall issue an acceptance receipt with a validity period of no more than 7 days, and make a decision on whether to issue it within the validity period of the acceptance receipt.

If the procedures or materials for foreigners to apply for visa extension, renewal, replacement and stay documents do not meet the requirements, the exit-entry administration department of the public security organ shall inform the applicant of the procedures to be performed and the application materials to be supplemented at one time.

The passport or other international travel documents held by the applicant can legally stay in China with the receipt of acceptance during the document preservation period.

Article 14 The decision made by the exit-entry administration of the public security organ to extend the visa stay period is only valid for this entry, and does not affect the entry times and validity period of the visa. The cumulative extended stay period shall not exceed the stay period indicated in the original visa.

After the extension of the visa stay period, foreigners shall stay in accordance with the reasons stipulated in the original visa and the extension period.

Article 15 Residence certificates are divided into the following categories:

(a) work residence certificate, issued to people working in China;

(two) study residence certificate, issued to people who have studied in China for a long time;

(3) A journalist's residence permit, which is issued to foreign resident journalists of foreign news agencies in China;

(4) Reunion residence certificate, which is issued to the families of China citizens who need to stay in China due to family reunion, the families of foreigners with permanent residency in China, and those who need to stay in China due to foster care and other reasons;

(5) Residence certificates for private purposes shall be issued to spouses, parents, children under the age of 18, parents of spouses of foreigners staying in China for work, study and other reasons, and other persons who need to stay in China for private purposes.

Article 16 When applying for a residence certificate for foreigners, foreigners shall submit their passports or other international travel documents, photos that meet the requirements and materials related to the reasons for application. You should go through the relevant formalities at the exit-entry administration institution of the public security organ of the local people's government at or above the county level, and keep personal biometric information such as fingerprints.

(a) work permit shall be submitted to the work permit and other supporting materials; Foreign high-level talents and urgently needed professionals who belong to the needs of the country shall submit relevant certification materials in accordance with the regulations.

(3) A journalist's residence certificate shall be submitted with a letter and a journalist's card issued by the relevant competent department.

If it is necessary to stay in China due to family reunion, it shall submit proof of family members' relationship and supporting materials related to the application; If you need to stay in China for reasons such as foster care, you should submit a power of attorney and other supporting materials.

(5) residence certificate for private reasons. If you visit relatives for a long time, you should submit the proof of kinship and the residence certificate of the interviewee as required; If you enter the country for personal reasons, you should submit relevant supporting materials for staying in China for personal reasons.

Foreigners applying for residence certificates with a validity period of more than 1 year shall submit health certificates in accordance with regulations. The health certificate is valid for 6 months from the date of issuance.

Article 17 When applying for extension, renewal or replacement of residence certificates, foreigners shall fill in an application form and submit passports or other international travel documents, as well as photos that meet the requirements and materials related to the reasons for application.

Article 18 If a foreigner applies for a residence certificate or its extension, renewal or replacement meets the acceptance conditions, the exit-entry administration department of the public security organ shall issue an acceptance receipt with the validity period not exceeding 15 days, and make a decision on whether to issue it within the validity period of the acceptance receipt.

If the procedures or materials for foreigners to apply for residence certificates or apply for extension, renewal or replacement of residence certificates are not in conformity with the provisions, the exit-entry administration department of the public security organ shall inform the applicant of the procedures to be performed and the application materials to be supplemented at one time.

The passport or other international travel documents held by the applicant can legally reside in China with the receipt of acceptance during the period of being detained for handling the documents.

Article 19 If a foreigner applies for the extension, renewal or replacement of a visa or residence certificate and applies for a residence certificate, the inviting unit or individual, the applicant's relatives and the relevant specialized service agencies may apply on his behalf in any of the following circumstances:

(a) under the age of 65-438+06 or over the age of 60 due to illness and other reasons;

(2) Not entering China for the first time and having a good record of staying in China;

(3) Inviting units or individuals to provide safeguard measures for the expenses required by foreigners during their stay in China.

If foreigners apply for residence certificates, which belong to foreign high-level talents needed by the country and urgently needed specialized talents, and the circumstances specified in the first paragraph of the preceding paragraph, they may invite units or individuals, relatives of the applicants and relevant specialized service agencies to apply for them on their behalf.

Article 20 The exit-entry administration of the public security organ may verify the authenticity of the application reasons through interviews, telephone inquiries, on-the-spot investigations, etc. The applicant and the unit or individual that issued the invitation letter and certification materials shall cooperate.

Article 21 If a foreigner is under any of the following circumstances, the exit-entry administration department of the public security organ shall not approve the extension, renewal or replacement of a visa or residence certificate, and shall not issue a residence certificate:

(a) unable to provide application materials in accordance with the provisions;

(2) Practicing fraud in the application process;

(three) in violation of the relevant laws and administrative regulations of China, it is not suitable for residence in China;

(4) Other circumstances in which it is not appropriate to approve the extension, renewal, replacement or issuance of visas and residence certificates.

Article 22 If a foreigner with a study and residence certificate needs to take a part-time job or practice outside the school, he shall apply for a residence certificate from the exit-entry administration of the public security organ with information such as the place and duration of the part-time job or practice.

Foreigners who hold residence certificates for study shall not take part-time jobs or practice outside the school without the information specified in the preceding paragraph.

Article 23 Foreigners in China who do not hold valid passports or international travel documents because their documents are lost, damaged or stolen may apply to the exit-entry administration department of the public security organ of the local people's government at or above the county level for exit formalities.

Article 24 Foreigners whose stay areas are indicated on exit and entry certificates, as well as foreigners whose temporary entry has been approved by the entry-exit frontier inspection authorities and whose stay areas are limited, shall stay in the limited areas.

Twenty-fifth foreigners in China in any of the following circumstances, it is illegal to stay:

(a) the stay and stay time exceeds the time limit stipulated in the visa and residence certificate;

(2) Foreigners who have entered the country without a visa have stayed beyond the visa-free period and failed to apply for a stay and residence certificate;

(3) Foreigners are active outside the limited stay or residence area;

(4) Other illegal residence situations.

Twenty-sixth units that employ foreigners to work or recruit foreign students shall report to the exit-entry administration of the public security organs of local people's governments at or above the county level in time if they find any of the following circumstances:

(1) The employed foreigner leaves his post or changes his work area;

(2) Recruited foreign students graduate, complete their studies, drop out of school and leave the original recruiting unit;

(3) employing foreigners or recruiting foreign students in violation of the regulations on exit and entry administration;

(4) The employed foreigners and the recruited foreign students are dead or missing.

Twenty-seventh financial, educational, medical, telecommunications and other units need to verify the identity information of foreigners when handling business, they can apply to the exit-entry administration of public security organs for verification.

Article 28 The issuance and administration of residence certificates for foreigners staying in China for diplomatic or official reasons shall be carried out in accordance with the regulations of the Ministry of Foreign Affairs.

Chapter IV Investigation and Repatriation

Twenty-ninth public security organs can set up repatriation places according to actual needs.

According to Article 60 of the Exit and Entry Administration Law, foreigners detained for examination shall be sent to detention centers or repatriation places within 24 hours.

If deportation or deportation cannot be carried out immediately due to the weather or the health condition of the parties concerned, foreigners shall be detained in detention centers or repatriation places on the basis of relevant legal documents.

Thirtieth in accordance with the provisions of Article 61 of the Exit and Entry Administration Law, if the scope of activities of foreigners is restricted, a decision on the scope of activities shall be issued. Foreigners whose activities are restricted shall report to the public security organ at a specified time; Without the approval of the decision-making organ, it is not allowed to change the residence or leave the restricted area.

Article 31 Where an alien is expelled from the country in accordance with Article 62 of the Exit and Entry Administration Law, the organ that made the expulsion decision shall determine the specific time limit for the expelled alien not to enter the country according to law.

Article 32 The expenses for expelling foreigners from the country shall be borne by them. I can't afford it, which belongs to illegal employment and is borne by illegal employment units and individuals; Other circumstances shall be borne by the units or individuals that provide guarantee measures for foreigners to stay and stay in China.

Expulsion of foreigners from the country shall be carried out by the public security organs of the local people's governments at or above the county level or the entry-exit frontier inspection organs.

Article 33 If a foreigner is decided to leave the country within a time limit, the organ that made the decision shall cancel or confiscate his original exit and entry certificate, go through the residence formalities for him and limit the time limit for leaving the country. The maximum time limit for leaving the country shall not exceed 15 days.

Article 34 A visa or residence certificate held by a foreigner shall be declared invalid by the issuing authority under any of the following circumstances:

(1) The visa or residence permit is damaged, lost or robbed;

(2) Being ordered to leave the country, expelled from the country or leaving the country within a time limit, and the visa and residence certificate have not been confiscated or cancelled;

(three) the original reason for residence has changed, and it has not been declared to the exit-entry administration of the public security organ within the prescribed time limit, and it has not been declared after the announcement by the public security organ;

(4) Not issuing visas or residence certificates as stipulated in Articles 21 and 31 of the Exit and Entry Administration Law.

If the issuing authority declares the visa or residence certificate invalid according to law, it may declare it invalid on the spot or declare it invalid.

Article 35 A foreigner's visa or residence certificate shall be cancelled or confiscated by the public security organ under any of the following circumstances:

(1) Being declared invalid by the issuing authority or being fraudulently used by others;

(2) illegally obtained by forging, altering, defrauding or other means;

(3) The holder is decided to leave the country, be deported or be deported within a time limit.

The organ that makes the decision of revocation or collection shall promptly notify the issuing organ.

Chapter V Supplementary Provisions

Article 36 The meanings of the following terms in these Regulations:

(1) The number of entry visas refers to the number of times that the holder can enter the country within the validity period of the visa.

(2) The entry validity of a visa refers to the valid time range of the visa held by the holder. Unless otherwise stipulated by the issuing authority, the visa will take effect from the date of issuance and will be valid until the expiration date of 24: 00 Beijing time.

(3) The term of visa stay refers to the period that the holder is allowed to stay after each entry, counting from the day after entry.

(4) Short-term means staying in China for no more than 180 days (including 180 days).

(5) Long-term and permanent residence means staying in China for more than 180 days.

The time limit for examination and approval and the validity period of the acceptance receipt of the entry-exit administrative organ of the public security organ as stipulated in these Regulations shall be calculated in working days, excluding legal holidays.

Article 37 With the approval of the Ministry of Foreign Affairs, visa agencies stationed abroad may entrust relevant local agencies to undertake the reception, entry and consultation of visa applications for foreigners.

Article 38 The format of visas shall be formulated by the Ministry of Foreign Affairs in conjunction with the Ministry of Public Security. The style of residence permit shall be stipulated by the Ministry of Public Security.
