How to calculate the hotel overtime?

The calculation of hotel overtime pay is determined according to different working hours. Overtime on working days can be paid at 150% of salary, overtime on weekends can be paid at 200%, and overtime on legal holidays can be paid at 300%.

1. How to calculate the overtime pay of the hotel?

The calculation basis of overtime wages in hotels is Article 13 of the Interim Provisions on Wage Payment: If the employer arranges the workers to work outside the legal standard working hours according to the actual needs after the workers have completed the labor quota or specified work tasks, the wages shall be paid according to the following standards.

(1) If the employing unit arranges the working hours of the workers in accordance with the law to exceed the Japanese legal standard working hours, it shall pay the wages of the workers not less than 150% of the hourly wage standard agreed in the labor contract;

(2) If the employing unit arranges the laborers to work on rest days according to law, but cannot arrange compensatory time off, it shall pay the laborers no less than 200% of the laborers' daily or hourly wages agreed in the labor contract;

(3) If the employing unit arranges the laborers to work on legal holidays according to law, it shall pay the laborers not less than 300% of the daily or hourly wages agreed in the labor contract. Workers who implement piece-rate wages will be paid by the employing unit at the rate of not less than 150%, 200% and 300% of the piece-rate unit price according to the above principles within their legal time.

If the comprehensive working hours system is implemented with the approval of the labor administrative department, the part where the comprehensive working hours exceed the legal standard working hours shall be regarded as the salary for extending the working hours.

Two. Labor law of the people's Republic of China

Article 40 During the following festivals, the employing unit shall arrange employees' holidays according to law:

(1) New Year's Day; (2) Spring Festival; (3) International Labor Day; (4) National Day; (five) other holidays as prescribed by laws and regulations.

Article 44 Under any of the following circumstances, the employing unit shall pay wages higher than the wages of the workers during their normal working hours according to the following standards:

(1) If the laborer is arranged to work longer hours, he shall be paid no less than 150% of the salary;

(2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages;

(3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.

That is, the overtime pay at night is 150% of my salary, 200% on weekends and 300% on national holidays. But this is only the proportion stipulated by the state, and the key to the amount of overtime pay is the salary base.

The specific payment standard of overtime wages is clearly stipulated in the law, but the specific payment needs to be handled according to the consultation between the employer and the employee, especially for the specific situation of overtime, and it is also determined by distinguishing different overtime hours in law to avoid the wrong application of the law.
