I. Types of trademark registration of catering enterprises

At present, according to the international classification of goods and services registered by trademarks, catering enterprises involve the following categories.

1, catering service trademark category:

Category 43

Provide catering service and temporary accommodation. Including services provided by individuals or facilities for consumers, as well as services provided by hotels, homestays or other temporary accommodation facilities such as hotels, cafes, cafeterias and hotels.

Three. Trademark registration procedure

1. Pre-application consultation (optional step).

At present, it takes about two years for a trademark to be registered. It is not clear whether the reapplication can be approved. Therefore, before applying for trademark registration, it is best for the applicant to inquire about the trademark, understand the rights status, make a judgment according to the inquiry results and submit the application.

2. Prepare the application documents and make an application.

According to the Application for Trademark Registration sealed by the applicant (legal person or other organization) or signed by the applicant (natural person), fill in the commodity category and trade name of the trademark according to the provisions of the commodity classification table. This form needs typing or printing, not handwriting.

The pattern is required to be clear, and the specification is 5 cm long and 10 cm wide. When specifying colors, five color patterns and 1 black and white patterns are attached.

Where a trademark agency is entrusted, the applicant shall pay the trademark registration fee and agency fee to the trademark agency.

Three. Review and approval

After receiving the application, the Trademark Office, after formal examination, determines that the procedures are complete, fills in the instructions, and generally sends an acceptance notice to the applicant by registered mail in about 3 months. Where a trademark agent is entrusted to apply for trademark registration, the Trademark Office will mail the Notice of Acceptance to the trademark agent.

If the application for trademark registration is rejected and the applicant refuses to accept the rejection decision, he may apply to the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce for reexamination within 15 days from the date of receiving the notice of rejection.

If the applicant objects to the trademark application for registration and is not satisfied with the ruling of the Trademark Office, he may apply to the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce for reexamination within 15 days from the date of receiving the complaint of objection.
