The purchase deed tax should be borne by the buyer. Real estate deed tax is a one-time tax levied on the new owner (property owner) based on a certain percentage of the house price in the contract signed by the parties when the ownership of the house changes. According to the provisions of the "Deed Tax Law", when the ownership of land or houses is transferred within the territory of the People's Republic of China, the responsible units and individuals shall be taxpayers of the deed tax and shall pay the deed tax in accordance with the provisions of this law.
Article 3 of the "Deed Tax Law" stipulates that the deed tax rate is 3~5. However, there are preferential policies for house purchase deed tax. Currently, the "Notice of the Ministry of Housing and Urban-Rural Development on Adjusting Preferential Policies for Deed Tax and Business Tax in Real Estate Transactions" (Caishui [2016] No. 23) of the Ministry of Finance and the State Administration of Taxation of the People's Republic of China is still in effect. For individual house purchases, the preferential deed tax rate is still 1 to 3. If an individual purchases a single house with an area of ??90 square meters or less, the deed tax will be levied at a reduced rate of 1. If the area is more than 90 square meters, the deed tax is levied at a reduced rate of 1.5%. For individuals purchasing a second improved house for their family: if the area is 90 square meters or less, the deed tax will be levied at a reduced rate of 1. If the area is more than 90 square meters, the deed tax will be levied at a reduced rate of 2. When buying a house, you pay deed tax to determine the tax rate. The deed tax rate needs to be determined according to the regulations of your own city. Different cities will have differences.
When buying a house: There are three situations for paying the deed tax. In the first situation, the buyer needs to pay the deed tax before the developer hands over the house. In the second case, after signing the commercial housing sales contract, the buyer should pay the deed tax to the Housing Authority within 10 days. In the third case, the home buyer must pay the house deed tax within one year after the house is delivered for use, otherwise late payment fees will be incurred. This is also a common way to pay the house deed tax.
