Is daily rental legal?
Daily renting is legal. Daily rental housing is also known as short-term rental housing, family hotels, mobile apartments, daily rental apartments, youth hostels, self-service apartments, serviced apartments and farmhouses. It is a new property type. Many daily rental houses on the market are labeled as "good quality and low price". Not only do they not require complicated procedures and are convenient to check in, but they also have an absolute advantage over hotels in terms of price. Daily rental housing is gradually becoming popular.
There is no law prohibiting daily rental, so daily rental is legal. The so-called illegal behavior, also known as illegal behavior, refers to behavior that is carried out or caused by a specific legal subject, that is, an individual or unit, due to subjective fault, has certain social harm, and should be held accountable in accordance with the law. Illegal behavior manifests itself in abuse of rights beyond the limits permitted by law, conduct prohibited by law, and failure to perform statutory positive obligations.
State agencies, enterprises, institutions and other organizations, social groups or citizens violate the provisions of the law, causing the social relations and social order protected by the law to be damaged, and should bear legal responsibility in accordance with the law.
Therefore, although daily renting a house is not illegal, it does not comply with certain legal provisions. The rental of the house must be registered with the public security organ.
Legal basis: Article 143 of the "People's Republic of China and Civil Code"
