1. Rights and Responsibilities of Party A
1. Party A contracts the kitchen to Party B for management and operation, and hires Party B’s staff to be the chief chef of the kitchen. The period is year, that is, from the month day of the year to the day of the year. The probation period is three months, that is, from the day of the year to the day of the year. If you want to continue employment after the expiration of the term, you must sign a separate agreement.
2. Party A should ensure the supply of kitchen raw materials according to business needs.
3. Party A provides Party B with free working meals and dormitories.
4. Party B’s total monthly salary is RMB yuan, and the previous month’s salary will be paid every day of the month. Party B will provide salary payment to establish a People’s Bank of China account.
In the future, if there is a need to increase or decrease personnel according to business conditions, we will then consider increasing or decreasing the total salary. After the trial period, Party A and Party B will set reasonable business indicators based on the operating conditions. If the business indicators are achieved, Party B will enjoy the existing salary and will be rewarded if the excess is exceeded. If the business indicators are not met, the salary will be reduced appropriately.
5. Party A will give Party B’s staff one day off work per month. Party B will make reasonable arrangements as long as it does not affect normal business. Party B is not allowed to take vacation when the work is busy.
6. Party A has the right to conduct daily management of Party B according to Party A’s management system. If Party B’s personnel violate Party A’s management system, Party A has the right to impose penalties.
2. Party B’s rights and responsibilities
1. Party B must ensure that at least one person works in Party A’s kitchen (including wok person, chopping board person, cold dish person, pastry person, and waiter) Personnel), Party B’s personnel must be highly skilled to ensure product quality. The head chef, first pot, and first butcher must reach the national first-level chef level, and other chefs must also reach the national second-level chef level.
2. Party B needs to do a good job in controlling various costs in the kitchen, meet Party A’s requirements, and ensure the achieved gross profit rate. If the specified gross profit rate is not reached or exceeds, Party B will be charged the difference (the difference). The difference in gross profit margin is 10 times the total turnover of Caijin (total sales) and wages are deducted.
3. The chief chef sent by Party B should organize a weekly dish discussion meeting and invite Party A’s management personnel to participate. While ensuring the quality of the dishes, he should constantly introduce new ones and introduce hotel brand dishes and signature dishes. , to be new, strange, special and fresh (launch at least two new dishes every week).
4. Party B should launch seasonal dishes and holiday dishes in a timely manner based on holidays and special circumstances of the hotel, and organize activities such as food festivals from time to time.
5. If a customer complains or withdraws dishes due to quality problems in Party B’s kitchen, Party B shall be responsible for the loss.
6. Party B should do a good job in food hygiene. If a guest gets food poisoning or is punished by the epidemic prevention department due to Party B’s management problems, Party B will be responsible for the loss; if a fire in Party A’s kitchen is caused by Party B’s management problems, this loss will be borne by Party B. The responsibility and losses shall be borne by Party B; Party B must strictly abide by the safety operating procedures and ensure safe production. If an injury is caused due to illegal operation, not only will no expenses be reimbursed, but Party B will also be held accountable.
7. Party B’s personnel must abide by Party A’s management system. If Party B’s personnel seriously neglect their duties, commit malpractice for personal gain, cause significant damage to the hotel’s interests, or seriously violate labor discipline and cause losses to the hotel, Party A has the right to demand compensation from Party B and pursue legal action. responsibility.
7. After Party B’s personnel are hired by Party A, they are not allowed to work part-time.
8. Party B’s personnel must abide by the hotel’s schedule, take good care of Party A’s property, and keep Party A’s business secrets.
9. Party A shall make work clothes and work badges for Party B, and Party A shall bear the costs. Upon expiration of the contract, Party A shall not deduct tooling and other expenses.
10. If both parties terminate this agreement, Party B must wait until Party A finds a chef before resigning, otherwise Party B will be responsible for all consequences.
11. Party B must have personnel in place by month day; Party B must cooperate with the purchasing personnel to purchase raw materials in the market every day.
3. Matters not covered in this agreement shall be settled through friendly negotiation between both parties. If a labor dispute occurs, Party A and Party B shall resolve it through negotiation. If they are unwilling to negotiate or the negotiation fails, they may apply to the Labor Dispute Arbitration Committee for arbitration.
4. When this agreement is signed, Party A shall pay Party B’s company management fees in the amount of ***
