Can I rent a hotel after the loan?

Legal analysis: after mortgage loan, the house can be rented, but not traded. Rights enjoyed by the mortgagor: (1) The mortgagor enjoys the ownership of the mortgaged house and has the right to obtain various benefits from the mortgaged house. (2) The mortgagor has the right to dispose of the mortgaged house, but if the mortgaged house is to be transferred, the consent of the mortgagor must be obtained in advance. (3) Mortgaged houses can be mortgaged many times, provided that the total amount of creditor's rights secured by several mortgages is not greater than the value of mortgaged houses. (4) Mortgaged houses can be rented.

Legal basis: Article 406 of the Civil Code of People's Republic of China (PRC). During the mortgage period, the mortgagor may transfer the mortgaged property. Unless otherwise agreed by the parties, such agreement shall prevail. If the mortgaged property is transferred, the mortgage right will not be affected. Where the mortgagor transfers the mortgaged property, it shall promptly notify the mortgagee. If the mortgagee can prove that the transfer of the mortgaged property may damage the mortgage right, he may require the mortgagor to pay off the debt or deposit the proceeds of the transfer in advance with the mortgagee.
