Provisions on the prohibition of setting off fireworks and firecrackers in urban areas

Article 1 In order to ensure the safety of public property and citizens' personal property, prevent environmental pollution and maintain urban social order, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of the State Council on the Safety Management of Fireworks and Firecrackers and other laws and regulations, combined with the actual situation of this district.

Article 2 It is forbidden to set off fireworks and firecrackers in the urban area east of Seed Dock River, south of Nanxiang Road-Wuyi Road-Ermaoyou River, west of Shenfeng North Road-Hufeng Avenue-Jinhai Road-Xiangfeng Road, and north of the area surrounded by Shugang Canal.

Article 3 Fireworks and firecrackers are prohibited in the following places and places outside the forbidden zone:

(a) state organs, people's organizations, education, scientific research, medical care and other units, radio stations, television stations, newspapers and other important news units, communication operators, postal enterprises, express delivery enterprises, banks, securities, insurance and other financial units;

(2) Railway stations, bus stations, airports and other transportation hubs, public parking lots, post and telecommunications, cable broadcasting lines and water, electricity, gas and heat supply facilities, large-scale energy and power facilities, power transmission and transformation facilities and railway line safety protection zones;

(3) bazaars, shopping malls (supermarkets), cinemas (theaters), cultural and sports venues, leisure and entertainment venues, tourist attractions, commercial streets (districts), parks, hotels, guest houses and other crowded public places and their surrounding areas 100 meters;

(four) institutions for the aged, children's welfare homes, kindergartens and their surrounding areas 100 meters;

(five) museums, libraries, archives, art galleries, cultural relics protection units and their surrounding areas 100 meters;

(6) Protected areas of military facilities, production and business premises of enterprises, and material storage warehouses;

(7) Places where inflammable and explosive articles are produced and stored, such as gas filling stations and their surrounding areas 100 meters, gas (oil) pipelines, power transmission and transformation (transformer) facilities and overhead power and communication lines;

(eight) construction sites, buildings (structures) using external wall insulation materials, roofs, balconies, stairs, corridors, windows and underground garages (parking lots) for residents;

(nine) other places and places where fireworks and firecrackers are prohibited by laws and regulations.

No-entry places and property units or users of places can set no-entry signs; If the property right unit or the use unit is not clear, the town (district), street offices and communities are responsible for setting the no-release sign.

Fourth prohibited areas prohibit the layout of fireworks wholesale places and retail outlets.

Article 5 The district government shall set up a working leading group composed of Dazhong Street, Fenghua Street, Economic Development Zone, District Government Office, Public Security Bureau, Civilization Office, Market Supervision Bureau, Housing and Construction Bureau, Emergency Management Bureau, Urban Management Bureau, Media Center, Culture, Radio, Film and Television Tourism Bureau, Health and Health Commission, Education Bureau, Transportation Bureau, Ecological Environment Bureau, Commerce Bureau and Administrative Examination and Approval Bureau (e-government Office). The office is located in the district public security bureau.

The district government should strengthen the leadership, coordination and guarantee of the management of fireworks and firecrackers, and all departments should do a good job in prohibiting the discharge of fireworks and firecrackers according to their respective responsibilities.

Sixth District People's governments and relevant departments should carry out publicity and education to prohibit the discharge of fireworks and firecrackers.

The education department should strengthen the publicity and education on students' prohibition of setting off fireworks and firecrackers.

Radio, television, newspapers and other news media should do a good job in the publicity and education of prohibiting fireworks and firecrackers.

Guardians of minors shall educate minors about the prohibition of setting off fireworks and firecrackers.

Article 7 If it is really necessary to hold large-scale fireworks display activities such as fireworks evening in the forbidden area specified in Article 2 of these Provisions, the organizer shall apply to the public security organ for administrative license.

Article 8 No unit or individual may illegally produce, operate or transport fireworks and firecrackers.

Article 9 It is forbidden to carry fireworks and firecrackers on public transport, to mail fireworks and firecrackers, and to carry fireworks and firecrackers in checked luggage, parcels and mails.

Tenth citizens, legal persons and other organizations have the right to report to the supervision and management departments when they find violations of these provisions. After accepting the report, the supervision and management department shall investigate and deal with it in a timely manner if it is under its jurisdiction; If it is not under the jurisdiction of this department, it shall be transferred to the competent department in time.

Eleventh in areas and places where fireworks are prohibited, the public security department shall order it to stop and impose a fine of more than 500 yuan 100 yuan according to law; Those who violate the administration of public security shall be punished according to law.

Other acts in violation of these provisions shall be punished in accordance with the provisions of relevant laws and regulations.

Article 12 These Provisions shall come into force on June 65438+1 October1day, 2023, and shall be valid until February 3 1 day, 2027. The Provisions on Prohibiting (Restricting) the Setting off of Fireworks and Firecrackers in Dafeng City (No.1 [20 15]) issued on May/May/May, 2015 shall be abolished at the same time.
