Regulations of Dalian Municipality on Fireworks and Firecrackers

Legal Analysis: Notice of Dalian Municipal People's Government on Strengthening the Safety Management of Fireworks and Firecrackers.

In order to strengthen the safety management of fireworks and firecrackers, and ensure the safety of the public and people's lives and property, according to the relevant provisions of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council, combined with the actual situation in Dalian, the relevant matters concerning strengthening the safety management of fireworks and firecrackers are hereby notified as follows:

First, Zhongshan, Xigang, Shahekou, Ganjingzi, Xinghai Bay and High-tech Zone are restricted areas for fireworks and firecrackers, and the discharge time is from the 23rd of the twelfth lunar month to the 15th of the first month of the following year. During this period, departure is allowed from 6: 00 to 23: 00 every day (New Year's Eve to the third day of the first month). At other times, all units, individual industrial and commercial households and individuals are prohibited from setting off fireworks and firecrackers.

In areas other than the above-mentioned restricted discharge areas, the district, city and county people's governments may, according to the needs of safeguarding public safety and interests, designate areas and time for restricting the discharge of fireworks and firecrackers.

Two, it is forbidden to set off fireworks in the following places:

1. Cultural relics protection units, museums and archives;

2. Important military areas;

3. Radio stations, television stations, newspapers and other important news units;

4. Telecommunications, postal services and financial institutions;

Large-scale energy and power facilities, water conservancy facilities, power transmission and transformation facilities and water, electricity, gas and heat supply facilities in the safety protection zone;

6 railway stations, passenger (cargo) stations, airports, primary and secondary trunk roads, bridges (including overpasses and overpasses), tunnels and other transportation hubs and railway line safety protection zones;

7. The safe distance between the place where inflammable and explosive articles are produced, sold and stored and its surroundings is within 100 meters;

8. Party and government organs, medical institutions, kindergartens, nursing homes, teaching and scientific research units, large cultural and sports venues, bazaars, shopping malls, supermarkets, cinemas, commercial pedestrian streets and other crowded public places;

9. Housing corridors, aisles, roofs, balconies and windows;

10.10 floors above 24 meters or within a safe distance of 25 meters;

1 1. The residential area or high-rise building with property management is outside the discharge area designated by the property management company;

12. Key fire prevention areas such as mountains and forests.

Third, it is forbidden for party and government organs, people's organizations, state-owned enterprises and institutions and financial institutions to set off "closing guns" and "opening guns" before and after the Spring Festival.

Four, without obtaining the "fireworks permit", no unit or individual may hold fireworks and other large-scale fireworks display activities. Individuals are not allowed to set off fireworks, small fireworks, friction fireworks, smoke fireworks and inner tube fireworks with a single internal diameter greater than 30mm, a single dose greater than 25g and a total dose greater than 1200mg.

Five, in the area that can be set off, shall not violate the safety distance of fireworks and firecrackers marked on the outer packaging.

Six, in violation of the provisions of this notice, the public security organs shall be punished in accordance with the relevant provisions of the "Regulations" on the safety management of fireworks; If it constitutes a violation of public security administration, it shall be punished by the public security organ in accordance with the relevant provisions of the People's Republic of China (PRC) Public Security Administration Punishment Law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Seven, this notice shall come into force as of the date of promulgation.

Legal basis: Regulations on the Safety Management of Fireworks and Firecrackers

Article 1 These Regulations are formulated for the purpose of strengthening the safety management of fireworks and firecrackers, preventing explosion accidents and ensuring the safety of the public, people and property.

Article 2 These Regulations shall apply to the production, operation, transportation and discharge of fireworks and firecrackers.

Fireworks and firecrackers as mentioned in these Regulations refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other items used for the production of fireworks and firecrackers.

Article 3 The State applies a licensing system to large-scale fireworks display activities such as production, operation, transportation and holding fireworks parties.

Without permission, no unit or individual may produce, operate or transport fireworks, or hold fireworks parties or other large-scale fireworks display activities.
