What procedures and materials are needed for marriage registration?

The marriage registration procedure is mainly composed of application, examination and registration.

(1) application

Couples who meet the conditions for marriage registration may bring relevant certificates, supporting materials and registration photos. Both parties apply for marriage registration at the marriage registration office where one party's permanent residence is located, and fill in the application registration statement according to the guidance of the staff.

Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, if a China citizen applies for marriage registration in China (except Hong Kong, Macao and Taiwan), he/she must hold his/her valid marriage examination certificate, ID card, household registration book, single certificate and a statement that he/she is not related to the other party (lineal blood relatives and collateral blood relatives within three generations). If it is a divorce, you must also hold a divorce certificate to apply for remarriage.

Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) need to hold their valid passports or other identity certificates, nationality certificates, valid residence permits for foreigners, official certificates of marital status and other materials.

(2) Review

The marriage registration authority shall verify and examine the parties applying for marriage registration to find out whether the application for marriage is correct. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties and require them to provide relevant certification materials when necessary.

(3) Registration and licensing

For those who meet the conditions for marriage, the marriage registration authority shall register them and issue marriage certificates to the parties; For those who want to remarry after divorce, the marriage registration office will cancel their divorce certificate; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The divorce registration procedure is as follows:

(1) application

If a husband and wife voluntarily divorce, they shall sign a divorce agreement in accordance with the provisions, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1, marriage certificate of both men and women;

2. Valid identity documents that meet the requirements for divorce registration, such as household registration book, identity card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the divorce application is found to be correct in the first instance, the parties concerned will receive the Receipt of Accepting the Application for Divorce Registration. If the application conditions are not met, the marriage registration authority will not accept it, and if the party concerned requests to issue a notice of not accepting the application for divorce registration, it shall issue it.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, if either party disagrees with the divorce, it can withdraw the previously submitted application for divorce registration from the divorce registration office that accepts the application for divorce registration by presenting its identity certificate and the Receipt for Accepting the Application for Divorce Registration (if the receipt cannot be found, the reasons can be explained in writing), and fill out the Application for Withdrawal of Divorce Registration in person. After verification by the staff of the marriage registration authority, a Confirmation Form for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.

(4) Review

Within 30 days after the end of the cooling-off period of divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the due date), both parties shall apply to the marriage registration authority for issuing a divorce certificate with relevant documents and materials such as recent bareheaded photos, divorce agreement, marriage certificate, ID card, passport or pass. The marriage registration authority shall conduct an examination in accordance with the relevant procedures and conditions, and refuse to handle the parties who do not meet the conditions for divorce registration. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.

(5) Registration and issuance of divorce certificates
