Provisions of Xiamen Municipality on Household Registration Management

(decree number. 138 Xiamen Municipal People's Government Decree No.20 10 was promulgated on June 5, and shall come into force as of August 20 10)

Chapter I General Principles

Article 1 In order to promote the reform of household registration system in this Municipality, standardize household registration management, safeguard citizens' legitimate rights and interests, and promote the coordinated development of population, economy and society in this Municipality, these Provisions are formulated in accordance with relevant laws, regulations and policies and in light of the actual situation of this Municipality.

Article 2 These Provisions shall apply to the registration, transfer and management of permanent residence in Xiamen.

The registration and management of temporary population shall be implemented in accordance with the provisions of Xiamen Municipality on the registration and management of temporary population.

Article 3 A unified household registration management system shall be established in urban and rural areas, with the legal fixed residence, occupation and economic source of residents as the basis for household registration.

The migration of registered permanent residence should optimize the population structure and appropriately expand the population size. Jimei district, Haicang District, Tong 'an District and Xiang 'an District were moved to the relaxed area, Siming District and Huli District were properly controlled, and Gulangyu Island was strictly controlled.

Article 4 The public security organ is the competent department of household registration management and is responsible for organizing the implementation of these Provisions.

The police station is the household registration management organ, which is specifically responsible for the household registration management within its jurisdiction.

Organizations, personnel, labor and social security, education, civil affairs and overseas Chinese affairs departments shall, within the scope of their duties, cooperate with public security organs to do a good job in household registration management.

Chapter II Entry Conditions for Permanent Residence

Article 5 If the personnel transferred, hired, recruited and hired from other places by local organs, social organizations, enterprises and institutions, units directly under the central province, foreign people's governments and institutions in Xiamen meet the requirements for transferring or introducing talents in this city, their spouses and minor children's accounts can move into this city.

Article 6 Graduates from ordinary institutions of higher learning and secondary specialized schools who meet the acceptance conditions of this Municipality may move into this Municipality.

Article 7 Overseas students who come to this city to start a business, work or want to work in this city, but their work units have not implemented it, and their spouses and minor children have not obtained foreign nationality or permanent residency in foreign countries, they can move their household registration into this city.

Eighth students studying in ordinary colleges, technical secondary schools and ordinary high schools in this city shall go through the formalities of registered permanent residence's relocation in accordance with the relevant provisions of the state, province and city.

Article 9 The spouses and minor children of foreign workers who have won the honorary titles of "Top Ten Young Migrant Workers in Xiamen" and "Top Ten Outstanding Female Migrant Workers in Xiamen" or the honorary titles of "May 1st Labor Medal", "Model Worker", "Great Contribution Award in Science and Technology", "Being Brave as an Advanced Element" and "Being Brave as a Hero" at or above the municipal level can apply for other national honorary titles.

Article 10 Foreigners who meet the following conditions at the same time may move their registered permanent residence into this Municipality:

(a) hold the city's "temporary residence permit" or "residence permit" for a certain number of years;

(two) to participate in the social endowment insurance within the prescribed time limit in this Municipality;

(3) Having a fixed occupation and signing a labor contract;

(4) Having a residence that meets the requirements;

(five) no criminal record and violation of family planning policy.

Eleventh approved to move into the city's units, their cadres and workers were reported to the municipal organization and personnel department and the municipal labor and social security department after the audit, can move their accounts into the city.

Article 12 Overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, foreign Chinese and other foreigners who come to invest and set up enterprises in this Municipality can move their domestic relatives or major employees' accounts into this Municipality as required. Enterprises and individuals from outside the city to invest and set up enterprises in this city can move the accounts of investors themselves, immediate family members or key employees of this enterprise into this city according to regulations.

Thirteenth in the purchase of commercial housing in this city, has obtained the property ownership certificate, housing construction area reached the standards set by the municipal government, housing owners and a certain number of eligible immediate family members can move their accounts into this city.

Fourteenth asylum seekers who have permanent residence in this city and meet the conditions for relatives to take refuge can move their residence into this city.

Fifteenth newborn babies shall declare and settle down according to the principle of following the father or the mother. Children of active servicemen should declare their birth accounts.

Sixteenth retired, resigned, laid-off or unemployed educated youth who go to the countryside in this city can move their own, spouses and minor children's accounts back to this city.

Men over 60 years old and women over 55 years old, who have no children in this city, can apply for an adult child and the spouse and minor children of the adult child to move with them when applying for returning to this city. If the rural educated youth who are staying outside Xiamen and their children's household registration is not in this city, they can choose one of their children to go back to the city to take refuge in the close relatives of the rural educated youth and move their household registration into this city.

Article 17 A person whose original permanent residence is in this city and has lived in this city continuously for more than 10 years, who retires outside this city and needs to return to this city, may move his/her residence back to this city if he/she has a legally fixed residence in this city. I or my spouse, the returned overseas Chinese who originally came from this city or moved out of this city, request to move their registered permanent residence back to this city after retirement, and have living conditions in this city, I, my spouse and minor children can settle down in this city. If the owner or heir of the overseas Chinese housing who has returned the property right after the implementation of the overseas Chinese housing policy requests to settle in this city, I, my spouse and minor children can move their accounts into this city.

Eighteenth children adopted by residents of this city can be settled in this city in accordance with the provisions of the People's Republic of China (PRC) Adoption Law.

Article 19 Resettlement of demobilized military cadres, demobilized veterans, dependents of troops stationed in Xiamen, retired military cadres, retired noncommissioned officers and retired workers without military status in this city shall be handled in accordance with the relevant provisions of the State Council, the Central Military Commission and the provincial and municipal governments.

Twentieth overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and other foreigners who apply to settle in this city may apply to the exit-entry administration department of the public security organ, and may settle in this city after being approved in accordance with the relevant provisions of the state.

Twenty-first China citizens and their spouses and minor children whose permanent residence in this city has been cancelled due to studying abroad, visiting relatives, labor services and other reasons. Persons who have not obtained foreign nationality or permanent residency may apply to the exit-entry administration department of the public security organ for settlement in this city.

Twenty-second released from prison, released from reeducation through labor and juvenile correctional officers who return to this city shall restore their accounts in accordance with the relevant provisions of the state and the province.

Chapter III Administration of Household Registration

Twenty-third people who meet the requirements of household registration shall register in the place where the household registration is located according to the following provisions:

(a) in accordance with the provisions of Article 5 to Article 8, Article 11, Article 19 to Article 21 of the conditions of personnel to apply for moving in and settle down, approved by the relevant administrative departments to transfer, moving in personnel and their immediate family members, respectively, to the public security organs for settlement procedures, by the relevant departments issued by the formalities of examination.

(two) in accordance with the provisions of article ninth, article tenth, article twelfth to article eighteenth, article twenty-second, to the public security organs for settlement procedures.

Article 24 A citizen shall declare and register his permanent residence at his actual place of residence, and a citizen can only register one permanent residence. If a citizen has more than two legally fixed residences, he shall register his permanent residence in one actual place of residence.

Twenty-fifth minors may not open an account alone. Unless otherwise stipulated by the state and Fujian Province.

Twenty-sixth in Siming District, Huli District to transfer permanent residence, or in jimei district, Haicang District, Tongan District, Xiang 'an District to transfer permanent residence, should have a legally fixed residence in the place of immigration.

Jimei district, Haicang District, Tongan District and Xiang 'an District will move their permanent residence into Siming District and Huli District, which shall be handled in accordance with the provisions of Article 13 and Article 14 and the relevant provisions of the municipal government. Strictly control the population growth of Gulangyu Island. If the residence base is not in Gulangyu, the permanent residence shall not be moved into Gulangyu.

Twenty-seventh city management cadres in the city to mobilize across regions, the organization, personnel, education department audit, can handle their own and meet the conditions of the transfer of personnel accounts across regions.

Twenty-eighth jimei district, Haicang District, Tong 'an District, Xiang 'an District units to receive qualified talents and graduates, have a legal fixed residence, can be settled in Siming District, Huli District. Among them, overseas talents who have settled in Siming District and Huli District are not restricted by legal fixed residence conditions.

Chapter IV Supervision and Responsibility

Twenty-ninth relevant administrative departments in the household registration management, should be civilized law enforcement, enthusiastic service, open to the public audit conditions, procedures and time limit, strictly in accordance with the provisions, and consciously accept social supervision.

Thirtieth in the application for household registration transfer fraud, the relevant administrative departments shall not move in registered permanent residence relations, have settled in this city, the public security organs shall order them to move their household registration back to the original domicile.

Article 31 Public security organs and their staff who neglect their duties, abuse their powers or engage in malpractices for selfish ends in household registration management shall be given administrative sanctions by their units or the competent department at a higher level according to law. If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter V Supplementary Provisions

Article 32 These Provisions shall come into force as of August 1 day, 2065. On May 27th, 2003, a decree was issued. 107 The Provisions on Household Registration Management in Xiamen promulgated by the Municipal People's Government shall be abolished at the same time.
