Regulations of Nanjing Municipality on Fire Control

Chapter I General Provisions Article 1 In order to prevent fires, reduce fire hazards, strengthen emergency rescue work, ensure personal and property safety and maintain public safety, these Regulations are formulated in accordance with the provisions of the Fire Protection Law of People's Republic of China (PRC), the Regulations on Fire Protection of Jiangsu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the fire control work and related emergency rescue work within the administrative area of this Municipality. Article 3 Fire control work shall follow the principle of giving priority to prevention and combining prevention with elimination, implement the responsibility system for fire control safety, and establish and improve a socialized fire control network in accordance with the principles of unified leadership of the government, supervision by departments according to law, overall responsibility of units and active participation of citizens. Article 4 People's governments at all levels shall be responsible for the fire control work within their respective administrative areas, and incorporate the fire control work into the national economic and social development plan to ensure that the fire control work is compatible with the economic and social development. Article 5 The public security organs of the people's governments of cities and counties (districts) shall supervise and manage the fire control work within their respective administrative areas, and the fire control institutions of the public security organs shall be responsible for the implementation. The police station shall carry out fire control supervision and inspection and fire control publicity and education in accordance with the prescribed duties. Article 6 Maintaining fire safety is the common responsibility of the whole society.

Units and individuals have the obligation to protect fire control facilities, prevent fires and report fire alarms, and have the right to report and complain about fire safety violations. Units and adults have the obligation to participate in organized fire fighting work. Seventh units and individuals are encouraged to carry out and participate in public welfare activities and volunteer service activities such as fire prevention publicity. Encourage the establishment of volunteer fire service organizations. Article 8 The people's governments of cities and counties (districts) shall give financial support to the public welfare undertakings of fire control. Encourage units and individuals to donate to the fire public welfare undertakings. Measures for the use and management of public welfare funds for fire fighting with financial support and social donations shall be formulated separately by the Municipal People's Government. Chapter II Fire Safety Responsibility Article 9 The people's governments of cities and counties (districts) shall perform the following fire control responsibilities:

(a) the establishment and implementation of the responsibility system for fire control work, the people's government at a higher level and the people's government at a lower level, the people's governments at all levels and the relevant departments of the people's government at the same level to sign the annual responsibility book for fire control work, and assess the completion;

(two) the funds for fire fighting and emergency rescue work will be included in the fiscal budget at the corresponding level, and the investment will be increased year by year according to the economic and social development;

(three) to supervise and inspect the performance of fire safety duties by the people's government at the next lower level and the relevant departments of the people's government at the same level;

(four) to organize relevant government departments to carry out fire safety inspection;

(five) to formulate emergency response and disposal plans for fire accidents;

(six) other fire duties as prescribed by laws and regulations.

City and county (District) people's governments shall set up fire safety committees, regularly listen to the reports of fire control institutions of public security organs and other member units, inform the fire safety situation, study and guide fire control work, and coordinate and solve major problems in fire control work. Tenth fire control institutions of public security organs shall perform the following duties:

(a) the implementation of fire laws, regulations and technical specifications, to carry out fire supervision and inspection, urge the rectification of fire hazards, investigate and deal with fire violations according to law;

(two) according to the fire design audit, fire acceptance and filing of construction projects, as well as public gathering places put into use and fire safety inspection before opening;

(3) Organizing fire prevention publicity, education and training, and guiding full-time fire brigades, volunteer fire brigades and relevant units to carry out fire drills;

(four) to organize, direct and undertake fire fighting, and undertake major disasters and accidents and other emergency rescue work focusing on saving lives in accordance with state regulations;

(five) responsible for or involved in the investigation of fire accidents;

(six) other duties as prescribed by laws and regulations. Eleventh planning, development and reform, housing and urban and rural construction, land and resources and other administrative departments in the preparation and implementation of the overall urban planning and fire planning, should perform the relevant fire safety duties according to law.

Quality and technical supervision, industrial and commercial administration and other departments shall, in accordance with their respective responsibilities, strengthen the supervision and management of the quality of fire protection products.

The safety production supervision and management department is responsible for the safety supervision and management of inflammable and explosive dangerous goods.

The administrative departments of urban management, education, health care, culture, civil air defense, tourism and gardens, economy and information technology, commerce, transportation, sports, etc. shall carry out fire safety inspections in a targeted manner, and promptly urge the rectification of fire hazards. Twelfth town people's government, street offices to perform the following fire duties:

(a) establish and implement the responsibility system for fire control work, equipped with firefighters, and implement fire safety measures;

(two) to guide the residents' committees and villagers' committees to formulate fire safety conventions and guide the units under their jurisdiction to carry out mass fire control activities;

(three) to assist the public security organs and their fire control institutions to carry out fire safety management;

(four) in accordance with the relevant provisions of the state and the province to establish a full-time government fire brigade;

(five) to urge the property service enterprises to implement the fire safety responsibility, organize and guide the owners and users of multi-property buildings that have not implemented property management to implement the fire safety responsibility;

(6) Organizing or assisting in dealing with the aftermath of fire accidents.
