Provisions of Beijing Municipality on the Administration of Public Security in Hotel Industry

Article 1 In order to strengthen the public security management of the hotel industry, protect the legitimate rights and interests of citizens, legal persons and other organizations, and maintain public order, these Provisions are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this Municipality. Article 2 These Provisions shall apply to hotels, restaurants, guest houses and other business places (hereinafter referred to as hotels) that provide accommodation and rest services in the form of bathing, regular rest and serviced apartments within the administrative area of this Municipality. Article 3 The municipal, district and county public security organs are the competent authorities in charge of public security management of the hotel industry in this Municipality.

Tourism, health, industry and commerce, public security and fire control departments shall, in accordance with their respective responsibilities, do a good job in the public security management of the hotel industry. Article 4 To operate a hotel, the following conditions shall be met:

(1) Having the lawful ownership or right to use the business premises.

(two) there are isolation facilities between the hotel and the non-hotel part of the building where it is located.

(3) The guest room area is an independent area, separated from the entertainment, business and other auxiliary service facilities in the hotel.

(4) There are not less than two safety exits; If you use underground space to run a hotel, the safety exit goes straight to the outside.

(five) public security image information systems are available in public areas such as entrances, exits, passages and elevators.

(6) Having equipment and facilities that meet the requirements of the public security management information system of the hotel industry.

(seven) there are passengers' belongings, luggage storage room or safe (cabinet) and other safety facilities.

(eight) the per capita use area of the guest room is not less than 4 square meters.

(nine) other conditions stipulated by laws, regulations and rules. Article 5 It is forbidden to set up hotels on the above-ground part of residential buildings or on the third floor and below of ordinary basements by using civil air defense projects. Article 6 This Municipality implements a special trade licensing system for the hotel industry.

To apply for opening a hotel, the applicant shall apply to the district or county public security organ where the hotel is located for a "Special Trade License". Article 7 To apply for opening a hotel, the applicant shall submit the following materials:

(a) the identity certificate of the legal representative or principal responsible person of the unincorporated entity.

(2) Notice of pre-approval of enterprise name or notice of pre-approval of enterprise name change issued by the administrative department for industry and commerce.

(3) Proof of ownership or lease of the business premises.

(four) the hotel orientation map and its internal plan.

(five) the fire safety inspection certificate issued by the public security fire control institution.

(six) the hotel safety management system and emergency plan.

(seven) the basic situation of the person in charge of hotel safety, security personnel and registration and verification personnel.

(eight) other materials required by laws, regulations and rules. Eighth district and county public security organs shall, within 20 working days from the date of accepting the license application, review the application materials submitted by the applicant and conduct on-site inspection of the hotel operation. To meet the conditions, it shall make a licensing decision and issue a "special trade license"; If it does not meet the requirements, it shall not be permitted, and the reasons shall be explained in writing.

If the district or county public security organ cannot make a licensing decision within 20 working days, it may extend 10 working days with the approval of the person in charge of the public security organ at the corresponding level, and shall inform the applicant of the reasons for the extension. Article 9 If the licensing items such as the name of the hotel, the legal representative or the principal responsible person of the unincorporated unit are changed, the public security organ that originally made the licensing decision shall go through the formalities of change within 3 working days from the date of deciding to change the licensing items.

If the original operating conditions of the hotel are changed due to decoration, renovation, expansion and merger, the public security organ that originally made the licensing decision shall go through the formalities for the change, and the public security organ that originally made the licensing decision shall conduct on-site inspection again. Article 10 Where a hotel moves its address, it shall re-apply to the district or county public security organ where the new address is located for a Special Trade License. Article 11 If a hotel closes down, it shall file a record with the public security organ that made the licensing decision three working days before the closure. Article 12 An applicant shall truthfully submit relevant materials to the public security organ when handling the licensing procedures. Those who obtain the license of special trade by cheating, bribery or other improper means shall be revoked by the public security organ that originally made the license decision, and their applications will no longer be accepted within 3 years.

It is forbidden to alter, resell, lease, lend or illegally transfer the special trade license in other forms. Thirteenth hotels and their staff shall perform the following duties:

(a) the implementation of public security management system and public security preventive measures, found unsafe hidden dangers in a timely manner for rectification.

(two) the implementation of emergency plans, organize regular drills.

(3) Organizing staff to receive public safety knowledge and skills training.

(four) the establishment of passenger verification and registration system, in accordance with the provisions of the designated person to check the identity documents of passengers, and input into the hotel industry security management information system.

(five) the establishment of duty patrol system, the guest room area is patrolled all day, and the service desk and monitoring room are manned all day.

(6) Establish a visitor registration system.

(seven) in a timely manner to stop violations of the hotel security management system.

(eight) to ensure the normal operation of the public safety image information system during the business period of the hotel, and shall not be interrupted; The retention period of image information shall not be less than 30 days.

(nine) properly keep the property left by passengers; If it cannot be returned to the original owner, it shall be sent to the public security organ.

(ten) accept the guidance, supervision and inspection of public security organs; Cooperate with public security organs to perform official duties.

(eleven) other duties as prescribed by laws, regulations and rules.
