Article 49 of the Tendering and Bidding Law stipulates that if a project that must be subject to tender is not subject to tender, the person directly responsible for the unit shall be punished according to law. The agreement on prepayment of project funds is illegal. Any construction unit shall not require the construction enterprise to take the contract with capital as the bidding condition, and shall not force the construction unit to write this content into the project contract.
