Article 1 These Measures are formulated in accordance with Article 17 of the Law of People's Republic of China (PRC) on the Administration of Exit and Entry of Citizens from China.
Article 2 These Measures shall apply to mainland citizens who travel to and from Hong Kong (hereinafter referred to as Hong Kong) or Macao (hereinafter referred to as Macao) and compatriots from Hong Kong and Macao who travel to and from the mainland.
Article 3 Mainland citizens who travel to Hong Kong and Macao for personal reasons shall pass through designated ports with passports issued by the public security organs of our country. Return to the mainland can also pass through other ports open to the outside world.
Designated ports: Shenzhen to Hong Kong, Gongbei to Macau.
Article 4 Compatriots from Hong Kong and Macao who travel between Hong Kong, Macao and the Mainland shall pass through the ports open to the outside world with the Home Visit Permit or Entry-Exit Pass issued by the public security organs of our country.
Chapter II Mainland Citizens' Travel to Hong Kong and Macao
Article 5 Mainland citizens who wish to settle in Hong Kong and Macao for personal reasons shall be subject to quota examination and approval, which is conducive to maintaining and maintaining the economic prosperity and social stability of Hong Kong and Macao.
Article 6 Mainland citizens who want to go to Hong Kong and Macao for personal reasons must apply to the exit-entry administration department of the municipal or county public security bureau where their household registration is located.
Article 7 An applicant may apply to settle in Hong Kong or Macao under any of the following circumstances:
(1) One of the spouses has settled in Hong Kong or Macao and has been separated for many years;
(2) Parents who have settled in Hong Kong and Macao are old and infirm and must be taken care of by mainland children;
(three) the elderly and children who are helpless in the mainland have to rely on their immediate family members and close relatives in Hong Kong and Macao;
(four) the immediate family members who have settled in Hong Kong and Macao have no inheritance, and they must be inherited by the children who have settled in the Mainland;
(five) there are other special circumstances that must be solved.
Eighth in any of the following circumstances, you can apply for a short-term trip to Hong Kong and Macao:
(a) there are close relatives who have settled in Hong Kong and Macao who need to visit;
(two) lineal relatives or close relatives are compatriots in Taiwan Province Province, and relatives in the mainland must go to Hongkong and Macao to get married;
(three) the immediate family members of returned overseas Chinese, brothers and sisters and the immediate family members of overseas Chinese can not go back to the mainland to visit relatives, but must meet in Hong Kong and Macao;
(four) industries that must go to Hong Kong and Macao;
(five) there are other special circumstances, must go to Hong Kong and Macao for a short time.
Article 9 Mainland citizens who apply for going to Hong Kong and Macao for personal reasons must answer relevant inquiries and go through the following procedures:
(1) Submit the household registration book or other household registration certificates.
(2) fill in the application form;
(three) submit the opinions of the employer on the applicant's travel to Hong Kong and Macao;
(4) Submit certificates corresponding to the reasons for application.
Article 10 The term "certificate" as mentioned in Item (4) of Article 9 of these Measures refers to:
(1) If the husband and wife are reunited, the legal marriage certificate and the certificate that the spouse has the permanent residence qualification in Hong Kong and Macao shall be submitted;
(two) to go to Hong Kong and Macao to take care of elderly and frail parents or helpless elderly and children who take refuge in relatives in Hong Kong and Macao, they must submit proof of their relationship with relatives in Hong Kong and Macao and their permanent residence in Hong Kong and Macao;
(three) to inherit or dispose of the industry, it is necessary to submit proof of the industrial status and legal inheritance right;
(four) to visit relatives in Hong Kong and Macao, letters from relatives shall be submitted; If time is short, explanations or certificates related to the application shall be submitted as far as possible;
(five) to meet relatives in Taiwan Province Province or to meet relatives living abroad, accurate proof of the date of arrival of relatives in Hongkong and Macao shall be submitted.
Article 11 The exit-entry administration department of the public security organ shall decide whether to approve or disapprove the application for going to Hong Kong and Macao within 60 days, and notify the applicant.
Twelfth mainland citizens who have been approved to settle in Hong Kong and Macao shall be issued a pass to Hong Kong and Macao by the exit-entry administration department of the public security organ. The holder shall cancel the account at the local police station before going to Hong Kong and Macao, and go to Hong Kong and Macao within the specified time.
Mainland citizens who have been approved to travel to and from Hong Kong and Macao for a short period of time shall issue passes to and from Hong Kong and Macao. The holder shall go and return on time within the specified time.
Thirteenth mainland citizens to apply for Hong Kong and Macao, one of the following circumstances, shall not be approved:
(a) the circumstances specified in Article 8 of the Law of People's Republic of China (PRC) on the Administration of Exit and Entry of Citizens of China;
(two) does not belong to the provisions of article seventh and article eighth of these measures;
(3) fabricating information or providing false certificates to deceive the exit-entry administration department of the public security organ.
Chapter III Compatriots from Hong Kong and Macao Coming to the Mainland
Fourteenth Hong Kong and Macao compatriots to the mainland, must apply for a home visit permit for Hong Kong and Macao compatriots. Hong Kong and Macao Home Visit Permit is issued by Guangdong Provincial Public Security Bureau.
To apply for the Home Visit Permit for Hong Kong and Macao compatriots, you must submit the residence certificate and fill in the application form.
Hong Kong and Macao compatriots who do not come to the mainland often can apply for entry and exit passes. The application method is the same as applying for the Home Visit Permit for Hong Kong and Macao compatriots.
Fifteenth in any of the following circumstances, Hong Kong and Macao compatriots shall not be issued a home visit permit or an entry and exit permit:
(a) it is considered that criminal activities such as robbery, theft and drug trafficking may be carried out;
(2) fabricating information or submitting false certificates;
(3) mental patients.
Article 16 Hong Kong and Macao compatriots driving motor vehicles to the Mainland shall apply for driving licenses in accordance with the relevant provisions of the Guangdong Provincial People's Government, and drivers shall also apply to the Exit-Entry Administration Office of the Guangdong Provincial Public Security Bureau for permission to drive motor vehicles from Hong Kong and Macao to the Mainland.
Article 17 Hong Kong and Macao compatriots who come to the Mainland for a short period of time shall register for temporary residence in accordance with the household registration regulations: if they stay in hotels, restaurants, guest houses, schools and other enterprises, institutions, organs, organizations and other institutions, they shall fill in the temporary residence registration form; If you live in the home of a relative or friend, you should go to the local police station or household registration office for temporary registration within 24 hours (72 hours in rural areas).
Eighteenth Hong Kong and Macao compatriots who wish to settle in the mainland shall apply to the municipal or county public security bureau in advance. After approval, the permanent residence formalities shall be handled at the place of residence with the Home Visit Permit of Hong Kong and Macao compatriots and the endorsement of the Home Visit Permit.
Chapter IV Entry-Exit Inspection
Article 19 Mainland citizens travelling to and from Hong Kong and Macao and compatriots from Hong Kong and Macao travelling to and from the Mainland shall present their entry and exit certificates to frontier inspection stations at ports open to the outside world or designated ports, fill in entry and exit registration cards and accept inspection.
Twentieth in any of the following circumstances, the frontier inspection station has the right to stop the exit and entry:
(1) Failing to hold a passport to and from Hong Kong and Macao, a home visit permit for Hong Kong and Macao compatriots or other valid documents;
(2) Holding forged, altered or other invalid passes to and from Hong Kong and Macao or home visits for Hong Kong and Macao compatriots, and fraudulently using others' passes to and from Hong Kong and Macao or home visits for Hong Kong and Macao compatriots;
(3) refusing to submit the certificate.
In accordance with the provisions of the second paragraph of the preceding paragraph, and can be handled in accordance with the provisions of article twenty-sixth.
Chapter V Certificate Management
Twenty-first Hong Kong and Macao compatriots home visit permit shall be kept by the holder, valid for ten years, and can be used many times during the validity period. If the validity period expires or the check page runs out, a new card can be issued. The application for renewal of a new certificate shall be handled in accordance with the provisions of Article 14 of these Measures.
Twenty-second travel permits to and from Hong Kong and Macao are valid once within the validity period. The validity period of the Travel Permit between Hong Kong and Macao is five years, which can be extended twice, each time not exceeding five years. The certificate shall be kept and used by the holder. Every time he goes to Hong Kong or Macao, he shall go through the application procedures in accordance with the provisions of Articles 6, 8 and 10 of these Measures, and go through the round-trip endorsement after approval. Public security organs specially authorized by the Ministry of Public Security can make multiple round-trip endorsements.
Twenty-third Hong Kong and Macao compatriots who have lost their Home Visit Permit after coming to the Mainland shall report the loss to the city or county public security organ or the transportation department. After investigation, the public security organ will issue a certificate, and the exit-entry administration department of the public security organ will issue a valid exit-entry pass to prove the return to Hong Kong and Macao. Hong Kong and Macao compatriots who have lost their Home Visit Permit in Hong Kong, Macao or the Mainland may reapply for their Home Visit Permit in accordance with the provisions of Article 14 of these Measures.
Twenty-fourth mainland citizens who lose their passes to and from Hong Kong and Macao before going to Hong Kong and Macao shall immediately report to the original issuing authority and make a statement in the newspaper. After investigation and verification, a new certificate will be issued.
Twenty-fifth Hong Kong and Macao compatriots home visit permit holders have one of the circumstances stipulated in Article 15 of these measures, and their certificates shall be revoked.
The revocation of the certificate shall be decided by the original issuing authority or its superior authority and shall be confiscated.
Chapter VI Punishment
Article 26 Anyone who holds forged, altered or other invalid passes to and from Hong Kong and Macao, passes to and from Hong Kong and Macao, home visits for compatriots from Hong Kong and Macao and entry and exit passes shall be given a warning or detained for up to five days, depending on the seriousness of the case.
Article 27 Whoever forges, alters or transfers a Hong Kong and Macao Pass, a Hong Kong-Macao Pass, a Home Visit Permit for Hong Kong and Macao Compatriots and an Entry-Exit Pass shall be detained for not more than 10 days; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law of People's Republic of China (PRC).
Article 28 Whoever fabricates information, provides false certificates, or obtains Hong Kong and Macao passes, Hong Kong and Macao travel passes, Hong Kong and Macao compatriots' home visits and entry and exit passes by bribery, if the circumstances are minor, shall be given a warning or detained for not more than five days; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law of People's Republic of China (PRC).
Twenty-ninth public security organs in the implementation of these measures, the use of authority to ask for and accept bribes or other illegal dereliction of duty, if the circumstances are minor, can be given administrative sanctions by the competent authorities as appropriate; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law of People's Republic of China (PRC).
