Can I check out after checking in at the hotel?

Whether the hotel can check out after check-in depends on the situation:

1. Staying in the hotel is equivalent to establishing a contractual relationship between the guest and the hotel. The hotel provides rooms with the same conditions according to the requirements of online or telephone booking, and the guests will check in immediately, and the contract between the two parties will take effect. Check-in and check-out are generally not allowed:

(1) If the hotel has no reason to check out, it can charge an appropriate fee. If one party fails to perform the contractual obligations or does not meet the contractual obligations, it shall be liable for breach of contract such as continuing to perform, taking remedial measures or compensating for losses;

(2) If one party fails to perform its contractual obligations or fails to comply with the contract, and after performing its obligations or taking remedial measures, the other party has other losses, it shall compensate for the losses;

2. However, if the room provided by the hotel does not meet the requirements, or does not meet the check-out conditions, you can check out and ask for a full refund.

Article 1 19 of the Civil Code of People's Republic of China (PRC).

A legally established contract is legally binding on the parties.

Article 12 1

Without legal or agreed obligations, those who try to avoid the loss of others' interests have the right to demand the beneficiary to repay the necessary expenses arising therefrom. If one party fails to perform its contractual obligations or fails to comply with the contract, and after performing its obligations or taking remedial measures, the other party still suffers other losses, it shall compensate for the losses.

Article 122

Because others have no legal basis to obtain improper benefits, those who have suffered losses have the right to demand that they return the improper benefits.
