Introduction of Jiaozuo Bidding Network?

Jiaozuo Bidding Network belongs to Jiaozuo Public Resource Trading Center (hereinafter referred to as Jiaozuo Bidding Network). With the approval of Jiaozuo Municipal People's Government, Jiaozuo Bidding Network was established on May 5, 20 10. It is a county-level all-supply institution directly under the municipal government, with 58 employees. It consists of seven departments: General Department, Finance Department, Information Management Department, Construction Project Trading Department, Property Rights Trading Department (other resources trading department), Land and Resources Trading Department and Government Procurement Trading Department. Jiaozuo Bidding Network actively performs the corresponding duties of the provincial bidding network (Henan Bidding Network) and maintains the order of all kinds of engineering procurement projects.

Interim Measures of Jiaozuo Public Resource Trading Center for Government Procurement to Promote the Development of Small and Medium-sized Enterprises;

Article 1 In order to give full play to the policy function of government procurement and promote the development of small and medium-sized enterprises with good products, services and reputation, these Measures are formulated in accordance with the People's Republic of China (PRC) Government Procurement Law, the People's Republic of China (PRC) Small and Medium-sized Enterprises Promotion Law and other relevant laws and regulations.

Article 2 Small and medium-sized enterprises (including medium-sized, small-sized and micro-enterprises, the same below) mentioned in these Measures shall meet the following conditions:

(a) in line with the classification standards for small and medium-sized construction enterprises;

(2) Providing commodities produced by this enterprise, projects or services undertaken by this enterprise, or providing commodities produced by other small and medium-sized enterprises. The goods mentioned in this item do not include goods using registered trademarks of large enterprises.

The term "classification standards for small and medium-sized enterprises" as mentioned in these Measures refers to the classification standards for small and medium-sized enterprises formulated by the relevant departments of the State Council according to the employees, operating income, total assets and other indicators.

Small and micro enterprises that provide goods produced by medium-sized enterprises are regarded as medium-sized enterprises.

Article 3 No unit or individual may obstruct or restrict small and medium-sized enterprises from freely entering the government procurement market in their own regions and industries, and government procurement activities may not discriminate against or treat small and medium-sized enterprises on the basis of registered capital, total assets, operating income, employees, profits, taxes and other supplier scale conditions.

Article 4 All departments responsible for preparing departmental budgets (hereinafter referred to as departments) shall strengthen the preparation of government procurement plans, formulate specific plans for purchasing from small and medium-sized enterprises, and make overall plans to determine the projects that their departments (including subordinate units, the same below) purchase from small and medium-sized enterprises. On the premise of meeting the basic needs of its own operation and providing public services, more than 30% of the total annual government procurement project budget of this department should be reserved for small and medium-sized enterprises, and the proportion reserved for small and micro enterprises should not be less than 60%.

When organizing procurement activities, the purchaser or procurement agency shall indicate in the tender documents, negotiation documents and inquiry documents that the project is specifically for small and medium-sized enterprises or small and micro enterprises.

Article 5 For projects not specifically targeted at small and medium-sized enterprises, the purchaser or procurement agency shall stipulate in the bidding documents, negotiation documents and inquiry documents that 6%- 10% of the product price of small and micro enterprises shall be deducted, and the deducted price shall be used for bid evaluation. The specific deduction ratio shall be determined by the purchaser or the procurement agency.

Small and medium-sized enterprises participating in government procurement activities shall provide the letter of declaration for small and medium-sized enterprises as stipulated in these Measures (see Annex).

Sixth to encourage large and medium-sized enterprises and other natural persons, legal persons or other organizations and small and micro enterprises to form a consortium, to participate in government procurement activities not specifically for small and medium-sized enterprises. According to the joint agreement, if the contract amount of small and micro enterprises accounts for more than 30% of the total contract amount of the consortium, the consortium may deduct 2%-3% from the price.

If all parties to the consortium are small and micro enterprises, the consortium shall be regarded as small and micro enterprises and enjoy the support policies stipulated in Articles 4 and 5 of these Measures.

Large and medium-sized enterprises and other natural persons, legal persons or other organizations that form a consortium shall not have investment relations with small and micro enterprises.

Article 7 After small and medium-sized enterprises have obtained government procurement contracts in accordance with the policies stipulated in Articles 4, 5 and 6 of these Measures, small and micro enterprises shall not subcontract or subcontract to large and medium-sized enterprises, and medium-sized enterprises shall not subcontract or subcontract to large enterprises. Article 8 Purchasers are encouraged to allow large enterprises that have obtained government procurement contracts to subcontract to small and medium-sized enterprises according to law.

The amount subcontracted by large enterprises to small and medium-sized enterprises is included in the statistical amount of procurement for small and medium-sized enterprises.

Article 9 When signing government procurement contracts with small and medium-sized enterprises, purchasers are encouraged to give them appropriate support in terms of performance bond, payment term and payment method. The purchaser shall pay the procurement funds in full and on time in accordance with the contract.

Tenth encourage the introduction of credit guarantee in government procurement activities, and provide specialized guarantee services for small and medium-sized enterprises in financing, bidding guarantee and performance guarantee.

Eleventh financial departments at all levels and relevant departments should increase training guidance and professional consulting services for small and medium-sized enterprises to participate in government procurement activities, and improve their ability to participate in government procurement activities.

Article 12 Each department shall report to the finance department at the same level the specific situation of the procurement of small and medium-sized enterprises in the previous year in the first quarter of each year, and publicly keep the implementation of the project and the procurement of small and medium-sized enterprises in other projects in the government procurement release media designated by the Ministry of Finance.

Thirteenth financial departments at all levels should actively promote the construction of government procurement information, improve the transparency of government procurement information release, and provide stable channels for small and medium-sized enterprises to obtain government procurement information.

Fourteenth financial departments at all levels in conjunction with the competent departments of small and medium-sized enterprises to establish and improve the relevant government procurement system to promote the development of small and medium-sized enterprises, and strengthen the supervision and inspection of the implementation of relevant policies.

All departments are responsible for the implementation and management of government procurement in their own departments to promote the development of small and medium-sized enterprises.

Fifteenth small and medium-sized enterprises in government procurement supervision and inspection and complaint handling shall be determined by the competent department of small and medium-sized enterprises at or above the county level where the enterprise is located.

Sixteenth buyers, procurement agencies or small and medium-sized enterprises in government procurement activities in violation of laws and regulations, in accordance with the government procurement law and related laws and regulations.

Article 17 These Measures shall be interpreted by the Ministry of Finance and the Ministry of Industry and Information Technology.

Article 18 These Measures shall come into force as of1October 2002+1day.
