Is it illegal to work overtime on business trip? Generally speaking, the time for business trip, commuting time and preparation time for work cannot be counted as overtime because of the lack of specific work content, and this time cannot be counted as "overtime time" to ask for wages. In order to protect the rights and interests, if the business trip time is really related to the work content, it can be "based on words" in advance as the basis for determining overtime. According to the current regulations, the working hours of workers are usually no more than 40 hours per week, and workers must be guaranteed to take a day off for 24 hours in a row every week, otherwise the time conditions for overtime recognition have been met. However, overtime is not a simple matter of time, and it needs specific work to support it. Of course, the latter is more difficult to judge. I think it can be determined by combining the general situation of workers' post work, the business characteristics of employers and the payment standard of remuneration (sometimes calculated by hours or times). Generally speaking, due to the lack of specific work content, travel time, commuting time and work preparation time cannot be regarded as overtime.

Article 44 of the Labor Law

Under any of the following circumstances, the employing unit shall pay the wages higher than the wages of workers during normal working hours according to the following standards:

(1) If the laborer is arranged to work longer hours, he shall be paid no less than 150% of the salary;

(2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages;

(3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
