Provisions of Xiamen Special Economic Zone on the Administration of Building Facade

Chapter I General Provisions Article 1 In order to strengthen the management of building facades, beautify the urban environment, ensure the safety of people and property, and build a high-quality and high-value city, these Provisions are formulated in accordance with the basic principles of People's Republic of China (PRC) Urban and Rural Planning Law, People's Republic of China (PRC) Construction Law and other laws and administrative regulations, combined with the actual situation of Xiamen Special Economic Zone. Article 2 These Provisions shall apply to the design, decoration, renovation, maintenance and other activities of building facades within the urban planning area of this Municipality and their related supervision and management.

Architectural facade design refers to the design of the interface between the building and the external space of the building, which embodies the architectural function and image.

Building facade decoration refers to the activities of treating the building facade with decorative materials and attaching various equipment, facilities and decorations to the building facade in order to meet certain environmental landscape and use requirements.

Building facade renovation refers to the renovation, renovation, reconstruction and other activities of building facade, including building facade renovation, overall building facade renovation and local building facade renovation.

Building facade maintenance refers to activities such as cleaning, painting, repair and restoration except building facade transformation. Third building facade management should follow the principles of safety, beauty, applicability, energy saving, environmental protection and maintaining local characteristics. Article 4 The Municipal People's Government shall strengthen the leadership, organization, coordination and supervision of building facade management, and study and solve major problems in building facade management.

The District People's Government shall, in accordance with its responsibilities, do a good job in the management of building facades within its jurisdiction. Article 5 The municipal competent department of resources and planning is the competent department of building facade design in this Municipality.

The municipal competent department of construction is the competent department in charge of building facade decoration in this Municipality, responsible for the supervision and management of building facade decoration in this Municipality, and organizing the implementation of these Provisions.

The district construction department is responsible for the supervision and management of the decoration, renovation and maintenance of the building facade within its jurisdiction. Sub-district offices (Town People's Government) shall assist in relevant work under the guidance of the competent department of district construction.

Urban management administrative law enforcement, housing security and housing management, municipal gardens, emergency management, public security, communication management and other departments are responsible for the relevant work of building facade management within their respective responsibilities. Article 6 The municipal department of resources and planning shall be responsible for organizing the compilation of the overall urban design within its administrative area and the urban design of key areas.

After the overall design of a city is approved by the Municipal People's Government, it shall be submitted to the Standing Committee of the Municipal People's Congress for deliberation and approval.

Urban design should be based on the long-term, reflecting the requirements of high value, ecological livability, regional characteristics and the style of the times. Article 7 The municipal competent department of construction shall, jointly with the municipal competent department of natural resources and planning, designate key areas and important node buildings for building facade management, and announce them to the public after being approved by the Municipal People's Government.

The designated key areas and important node buildings shall not be adjusted without authorization; If adjustment is really necessary, it shall be reported for approval in accordance with the original examination and approval procedures.

Key areas are urban key landscape areas, important public buildings, commercial centers, large-scale tourist exhibition places, stations, airports, ports and other urban key activity places, as well as major roads, railways, waterfront landscape zones and other areas. Chapter II Facade Management of Newly-built Buildings Article 8 The facade design of newly-built buildings shall meet the relevant urban design requirements.

The shape, style and color of the facade decoration of the new building should meet the requirements of urban design, be in harmony with the surrounding buildings and environment, achieve the harmony and unity of the overall visual effect of the building, and reflect the local characteristics.

The competent department of natural resources and planning shall, when reviewing the design scheme of new buildings, simultaneously review its facade modeling, style and color in accordance with the relevant urban design and urban appearance standards and the prescribed review procedures. Article 9 If the design scheme of a new building is changed after examination, it shall be submitted for approval and examination in accordance with the original procedures. Tenth building facade construction should ensure the quality and safety of the project, in line with the mandatory standards for engineering construction and other construction technical standards. Eleventh key areas and important nodes to stop construction for more than one year, the construction unit shall carry out the necessary appearance modification and maintenance, keep the appearance clean and tidy. Twelfth new building facade conforms to the planning conditions and design scheme, the competent department of natural resources and planning can verify the completion planning conditions, and the construction unit or individual can organize the completion acceptance according to the regulations.

After the completion and acceptance, no unit or individual may change the building facade without authorization. Chapter III Management of Existing Building Facades Article 13 The person in charge of building fa? ade management shall abide by the standards of city appearance and other relevant regulations on building fa? ade management, and keep the building fa? ade safe, intact, beautiful and clean. Fourteenth building facades shall not arbitrarily increase the load and other unsafe factors outside the original design.

The installation surfaces of additional equipment, facilities and decorations shall be firm and meet the safety conditions. If the strength of the installation surface does not meet the safety requirements, corresponding reinforcement, support or seismic measures shall be taken. Fifteenth balcony closed facilities shall not exceed the fence (bar) settings; Where the renovation of the facade of key areas and important nodes involves the balcony on the street side, the balcony shall be closed in accordance with the standards of urban appearance.

The outdoor unit of air conditioner should be placed in the outdoor unit of air conditioner; If there is no outdoor air conditioner, it should be placed in a safe and beautiful way that is conducive to the facade of the building; Concealed measures should be taken for the outer pipe of air conditioner, and the condensed water should be discharged in an organized way, and it is not allowed to be directly discharged to the external wall of the building and the outdoor ground.

Anti-theft protection and safety facilities shall not be set outside the external wall (outer edge) of the building and installed horizontally; If it is really necessary to install anti-theft protection and safety facilities on the frontage facades of key areas and important nodes, they should be installed internally. The setting of anti-theft protection and safety facilities should be included in the city appearance standards, and the Municipal People's Government can formulate specific management measures.
